Diaries of a Pro Se Litigant
Some of the hardest things about being a Pro Se litigant are being taken seriously, getting your emails and your calls returned, and helping attorneys realize that you are far, far from an easy target.
About a year or so ago I was trying to unravel exactly how three attorneys were representing my Lender on Bay and why. I spoke to one gentleman who was arrogant and cocky. He also laughed at me before he hung up on me. In that moment, don't ask me how, I knew that at some point he would realize he had made a mistake.
When you file a Complaint, oftentimes the bank will hand the case off to one of the older, more experienced litigation attorneys. Low and behold, that litigation attorney turned out to be the gentleman who had laughed at me before he hung up on me. Funny how things go sometimes.
With 36 years at the bar and as a seasoned trial attorney, he filed a Response that would potentially be a huge embarrassment to him, his experience and his firm. If you recall I had posted that his Response was to a Chapter 7 Trustee in the Western District of Michigan.
Further he wrote my mortgage was filed in the Clerk's office in Kalamazoo. I live in NJ and my bank statements certainly don't reflect a balance of a Chapter 7 Trustee.
Having been in this field at most points for almost half my life, I have learned that sometimes when an attorney is strapped for time, they will file anything to meet the bar date. In other words there was the distinct possibility that his answer was irrelevant and moot "accidentally on purpose."
With that in mind I called Chief Judge Ferguson's Deputy and she advised me to call him, so I did. We actually ended up having a very nice conversation and he wasn't laughing at me anymore, especially after I asked him if he was trying to "lawyer" me.
He also thanked me and said not many people would have called him. I told him I'm not most people and I "fight" fair. He indicated he would file an Amended Answer and I put a 7 day deadline on my calendar.
Within that 7 days (on the 5th actually), I emailed him about the Hearing of November 12, and asked when he would be filing his Amended Response. I received no answer to my email, of course. So, while he may not have been laughing at me on the phone I recognized that old familiar pattern of being lawyered.
When, on the 7th day, I received no Amended Response, I filed for Summary Judgment and I'm pretty sure that is when he wasn't laughing in his head either. I also filed to have the other 4 parties in the case declared in Default by the Clerk.
The day those pleadings were entered in PACER, he emailed me immediately and asked me why, after my gracious offer (his words), the Motion and the proposed Defaults were filed. I emailed him back and said that while I still would not object to an Amended Response being filed, we needed to keep this moving because after almost 6 years I want this over.
I also told him quite honestly and very nicely that just because he said he was going to do something does not guarantee it. I asked him if he had any idea how many attorneys over the last 5.7 years have told me they would do something and they didn't. I also spoke of other experiences I had which lacked respect and professionalism.
Further, I told him that with his 36 years of experience at the bar as a trial attorney, if he thought I was looking forward to going to trial against him he was wrong; that predictably I will find myself puking in the morning before Court like I did when I fought TD Bank.
He responded by thanking me for my kind words. He said that he would have an Amended Response filed by Thursday or Friday of this past week. He said that it would be that late only because he had trial in the Camden seat all week long.
I thanked him and left it at that. I figured he would file something at the last minute and that too, would be that.
Friday I checked my docket toward the end of the day and nothing had been filed. I can't say I was surprised or that I cared because really, his filed Response only worked in my favor, especially when it indicated that both the Note and the Lien had been satisfied.
The day we spoke on the phone I had him read his Response to allegation number 9 of my Complaint. Then I read my corresponding allegation and said to him: "I have no problem with that answer if you don't, as you just denied the Lien my Bay house remained. I'll gladly go into Court with that as your Response of record." This was when I definitely knew he wouldn't laugh at me ever again.
About 15 minutes after I checked my Docket, I got an email from him that said the ECF system was being cranky and that it would not let him file his Amended Response, that he attached it to the email for me and would file it on Monday. PACER was acting up on me too, so he was definitely telling the truth as the ECF and PACER are interfaced. Also, this gentleman's religion requires he is home by sundown on Fridays.
I emailed him back and thanked him for being a man of his word. I cannot tell you how shocked I was that he emailed me at all. He could have simply filed it on Monday without saying a word to me.
When I tell you that I was feeling like, I don't know... maybe not only shocked and surprised but respected as well, I'm not kidding. This attorney owes me nothing really, except the respect and professionalism he would give to any other Adversary, and he actually gave it to me. Diplomatically I will say: "Well wonders never cease!"
I certainly wasn't craving his approval or his respect, because I learned long ago it is not important, generally speaking. Additionally, in no way do I need it to help me to define my role in this case, or validate me, as my success speaks for itself.
What I also felt was as silly and sophomoric as that may sound, and I was pleased to find he is a man of character. I was beginning to wonder if people of character ceased to exist, at least in this forum.
Then I opened his Amended Response and I understood why I got that email: to the 44 or so allegatory statements I made in my Complaint, I would have to say that 2/3 were answered: "This is a conclusion of law and requires no Response." The 1/2 of the other 1/3 read: " Defendant neither admits nor denies ....and leaves the Plaintiff to her Proofs" and the rest read: "The Defendant denies this allegation." Finally, his Affirmative Defenses read as weak to non-existent for several reasons, mainly as a conclusion of law.
I don't have any idea if I will prevail in this matter. I don't know enough about the law overall, and specifically the real estate law of NJ, which has historically been considered some of the most confusing in the Country. What I do know is that this man who is well paid and well respected, took the time to carefully address every allegation I made and realizes that I do indeed have a case.
Then he treated me with the respect I earned.
This is perhaps the deepest feeling of accomplishment I have felt in this case, because all my "winning" came at price. His respect came from a place of distinct understanding that I am not stupid and further, that I am a formidable opponent.
Finally, somebody dropped something in my well instead of drinking for free.
It represents a payment of sorts, rather than me paying that price of "winning." This is the true definition of winning to me actually, because regardless of whether I prevail or not, I still got paid.

Stop me if you've read this statement before. 'It's a toss-up between the two: Young might be the better QB but Stroud has a higher floor and Young is much more risky'.
That seems to be the consensus view, not just on big networks, but even on draftnik twitter, this forum, and various internet draft gurus.
I do understand that Young's size is a massive concern, and that is likely the genesis of these takes. But having studied these prospects in depth, I have come to the opposite conclusion. Stroud, not Young, has a higher variance of outcomes, while Young is more NFL-ready and mature, and likely much closer to his peak than most QB prospects.
#1 - Offensive system:
Young played in the pro-style B O B offense at Bama, and while it was college-ized (i.e. Young took majority of snaps out of shotgun with 5 step drops), Young took heavy responsibility for pre-snap protections and adjustments. Nick Saban said that he routinely gave Young two plays pre-snap and Young made decisions on the fly play-calling wise.
Stroud played under Ryan Day's oft-criticized Ohio State system, a much more QB-friendly scheme. Most of his throws were to his first read, and most pre-snap adjustments were done in the OSU fashion with Day taking 90% of the play clock to react and analyze defensive information. Additionally, Day instructed his QBs not to run around - see Fields - and tried to limit the amount of reads they needed to make.
Mentally, Young is ahead of Stroud as he was tasked with much more at Bama than Stroud at OSU.
#2 - Ability to deal with pressure:
Simply put, Young is a savant at escapability and delivering under pressure. He has rare ability to deliver off-platform throws and manipulate his arm to fit the ball into tight windows both at the LOS and beyond. He has the 2nd lowest sack % and by far the best passer rating and production under pressure. This will translate to the NFL.
Stroud is not bad at dealing with pressure, don't get me wrong, but he has one of the lowest 'expected pressure' rates in the entirety of CFB history. He very rarely saw rushes in his face, and when he did, it was a mixed bag. The common rebuttal is 'the Georgia film' but in Notre Dame, Wisconsin, Iowa, N'Western, Michigan games you see Stroud time and time again reluctant to use his feet. Stroud has worse 'under pressure' numbers than Young by far, and makes weird decisions against the rush. While there is certainly untapped upside there, it does not consistently show up on tape, and this key trait is not something that usually gets corrected at the NFL level.
we KNOW Young will be able to deal with pressure beyond any doubt. Do we KNOW that about Stroud yet? some will say we do, but there is also a preponderance of evidence to say Stroud has more question marks. If Stroud can show that Georgia film consistently, he may be Joe Burrow level good. If not, he may be Sam Darnold.
#3 - Supporting Cast:
It is laughable to suggest that any Alabama player is dealing with a weak supporting cast. But in 2022, Young's receivers and line were not as good as the Alabama brand suggests. Ja'Corey Brooks, Kobe Prentiss, and Demarius Burton are simply nowhere near as good as JSN, Egbuka, and likely top 5 pick Marvin Harrison Jr. In 2021 they had comparable receiving casts (let's say Wilson/Olave = Jameson/Metchie), but again Stroud's WR3 and 4 were JSN and MHJ, aka top 15 picks.
Stroud was great at fitting the ball into tight windows and giving receivers a chance to make a play, but his weapons at OSU will 100% be better than his weapons at the NFL level. At Bama, Young's O-line and WRs were actually disappointing in 2022, and he had to fight through more adversity to elevate that offense than Stroud did to OSU's.
#4 - The physical size/ injury debate:
Yes, the issue with 'floor' always comes down to the idea that Young won't be able to survive the rugged NFL hits, and yes his size is unprecedented. But he hasn't suffered any serious injuries in college, hasn't had any issues seeing over the tall 6'5" line at OSU, and in fact has the best numbers completing passes over the middle in the entire nation.
All the size concerns have not appeared in any way in reality, just hypothetically. Plus, while Stroud certainly has a stronger arm, Young's arm talent is fine. It limits his ceiling more than Stroud's but that is my exact point - he will be able to complete the vast majority of passes at the NFL level, even deep balls.
Injuries - I honestly don't think size correlates that much with them. Cam Newton and Andrew Luck, both done before age 28, had perfect, prototypical size, yet struggled with recurring injuries and had early ends to their prime. Joe Burrow tore his ACL despite having prototypical size. These things happen to anyone in the NFL - and while it looks bad when Young gets hit, I would argue his injury risk is only 2-3% higher than anyone else's, perhaps even lower as he knows how to protect himself. All it takes is one slip or bad hit and anyone, even your golden boy with the perfect body, can miss an entire season.

TL;DR: Young is more advanced mentally, accustomed to a pro-style offense with much more responsibility pre snap and calling plays. He has demonstrated beyond any doubt an ability to deal with pressure, deliver accurately to receivers, and win over the middle. His arm talent and size are limitations, but he is more pro-ready than Stroud. Meanwhile, Stroud has question marks over transferring to a pro offense with less talented receivers, has questions dealing with pressure, and is not a runner or physical outlier in his own right (slight frame despite being 6'3"), and does not have the mental intangibles Young possesses.
The adjustment period for Young will be shorter than that for Stroud. Young has a lower ceiling, but he will make plays, guaranteed. The biggest question mark is Stroud's ability to handle pressure and play off-script -- and that makes him a boom or bust candidate to me: he could be All-Pro Burrow-lite if he booms, an Alex Smith/Goff in a good outcome for him, but there also is the risk that he could be Darnold if he fails to handle pressure well. I have very little concern about Young's floor as an NFL player, but his ceiling remains nebulous due to his lacking arm talent.
As for injury risk, I really think it's overstated. Size != ability to stay healthy, and really every NFL QB is one play away from missing 8 weeks, no matter what their physical traits are.

So I'm not really sure how I compare against other potential applicants and what schools I'd be a strong applicant at. It seems to me that many of the big schools in RFIC research are also schools that are overall incredibly competitive, e.g. Berkeley, Stanford, UCLA
Any school suggestions or general advice would be appreciated as well. My current list is: most UC schools, USC, Stanford, Cal Tech, Oregon State, Michigan, Texas A&M, UIUC, Georgia Tech, UVA, Virginia Tech (my undergrad), NCSU, Columbia, Cornell

Ok so I have a question for the vets in Texas. I’m thinking of moving there. I spent a decent amount of time there while still serving. I liked it. The people the weather, the atmosphere in general. As of late I’ve been seeing a lot of people on various forums talking about leaving Texas or moving back home to their original home/state. So my question is why? For those of you born and raised and also those that moved there from another state what are your feelings for Texas and experience living there. For reference I’m in Michigan and have never like this state, even when I was a younger adult. I spent alot of time all over the country when I was in and I just really liked Texas above all the rest. But I wasn’t there long enough to really know if it was good, bad or indifferent. Anyway give me your thoughts. Thanks!!

I posted earlier, but I received bad college counseling was told that my best case scenario was in-state/regional flagships and applied accordingly. Discovered internet forums soon after, realized my mistake. Hastily arranged a bunch of T20 apps, they were def not bad but they were def not my best work.
I'm pretty nervous that as an already fringe candidate in an incredibly competitive process, the hastily written essays are going to get me totally fucking panned. Is that a legit fear?
Solutions:
Also - if I somehow get into UVA/Michigan but nowhere else, should I still try to run things back with the gap year? Is that an insane person take? I don't know anymore!

Amber Sellers is a member of the Lawrence City Commission. She was first elected in 2021. She has a masters degree in Public Administration as well as a background in both public and private non-profit organizations such as Head Start programs.
I attended the City Commission meeting last night and I simply could not be more disappointed in this individual as a community representative.
[The subject matter of the meeting was the proposed Pallet Shelter Village on N. Michigan St. To be transparent - I am neither pro nor anti this proposal (though leaning pro), and was looking forward to hearing more about it.]
So, for starters, Comm. Sellers was completely dismissive of her constituents' concerns. Dozens of petitioners took to the lecturn, and her obvious scoff and disdain for them was apparent. This was particularly galling as the majority of the people speaking were doing so on behalf of their own low-income neighborhoods.
Following that, the commissioners debated the proposal. One commissioner, Bart Littlejohn, questioned the speed at which this project went through. In response, Comm. Sellers accused Comm. Littlejohn of "gaslighting."
This last fact was so absurd I wanted to pull my hair out. In what world does an elected official, debating - in a public forum, with another duly elected official - accuse their colleague of intentional, manipulative emotional abuse for mere disagreement on a public policy issue?
I was absolutely flabbergasted.
For this alone, Amber Sellers does not deserve re-election to our city commission.

New to the Forum my 3rd Subaru & 1st turbo charged engine. I imagine if I wanted to get the most reliability out of it I’d leave it stock but really want to get a after market air intake and probably a cat back exhaust mostly for sound and any minimal benefits in pwr hp/tq. Apart from a catch can are there any suggestions which can be given. I easily put over 200k miles on my Foresters and dont see why I couldn’t do the same w my 22 WRX. All input is welcomed. Oh I live in Mid Michigan so yea it can get cold through the winters.

Got this car back around September of 2022 and it came in black raven. I bought the car sight unseen (was in desperate need at the time, was actually looking for a CT5 BW but the prices were insane then) and on a cloudy day. When the sun came out a few days later I noticed swirl marks ALL over the car. There was also "orange peel" all over the car. After scouring the forums it seems many people had the same issue, partly due to GM paint and partly due to cars sitting in the Michigan GM lot for a while with a nearby railroad releasing rail dust all day. Black wasn't my first choice in color anyways due to the fact that I felt like it hides the carbon fiber. After some research and meeting an awesome local guy named Brent who is EXCELLENT at his job (shout out to @SWBwraps in Shreveport, Louisiana; follow him on IG [yes I live in a shithole]), I decided to get it wrapped. I had wanted to do a red similar to the cadillac infrared tintcoat but it was difficult to find one that fit exactly. Finally Brent recommended this color changing wrap called "red black iridescent" by KPMF. He had not used it before but looking at videos online on instagram and google made it seem like it was pretty legit. It was difficult to obtain due to supply shortages but then some came in stock, and I had to make a decision quick. Decided to go with it and see what happens.
He was able to wrap my entire car with only having to disassemble the door handles and rear spoiler (plus the emblems). No carbon fiber up front had to be removed nor did the bumper, which I was very happy about. He did an EXCELLENT job and honestly it looks like paint in real life. I kept the roof black (wrapped black) and he kept the door handles black along with blacking out of the front emblem.
In the sun, this color looks AMAZING. It's really a deep red but where the sun hits it turns into a very bright red that is incredible to see (as you can see in the pictures and videos, the direct sunlight areas are very bright). It is "color changing" in that it goes dark red/maroon with black accents but in the sun turns into a bright red. The car has gotten so many compliments especially in sunny days. On cloudy days or darker days the car appears to be more of a maroon color - still looks great, but not as flashy as it does in the sun. Overall I absolutely love love love how it looks and am extremely happy with it. He also did my key as a surprise which was awesome (shown in the pictures). The orange peel is not visible at all except on the black roof in certain lighting conditions.

Sorry if this kind of post is annoying, I’ve gone the other routes of posting on Michigan marijuana forums, and as far as finding someone at an event, my job makes the timing hard for that. My name is max, I grew up with split parents: a mom with trauma that she never dealt with, and a dad who was emotionally incapable of helping her or myself. It made it so I basically had to be an emotionally numb person, and at 24, I’m just now figuring out how I can be a person along with my trauma. I’ve been using dab pens for the last few months to provide me with relief, however I’ve been vaping since I was 14, and my lungs have started to reject anything in them. I switched to Rick Simpson oil, and it’s been working great. If I could find someone who makes that, that would be ideal. Any help is appreciated, sorry if I’m rambling 🙏

To start, I'm likely the biggest Euchre newbie in this forum. I'm originally from Michigan, and while most of my family plays Euchre, I've spent a majority of my life playing video games. Card games are a mystery to me.
Recently, I decided that I would combine my love of programming software with learning how to play Euchre. It's forced me to learn the rules, much of the basic terminology, and some simple strategies (many by reading the posts in this forum, so thank you!).
I have a very rudimentary PC-based Euchre game that has a few "test" player types:
While researching Euchre and how to reason about the game, I've come across many posts that talk about how much of Euchre is based on luck vs. strategy. I've read that luck can play a large component, and I've also read that someone with unusually high win rates "must be cheating." Because of this, I thought I'd share some statistics that are at least interesting to me, and hopefully others.
Each of the following game combinations were run with a mix of the above player types as a single team, and each team operated at the same "level." So, an "AI" team has two identically-leveled AI players. A "random" team would have two random players, etc. Each scenario ran 5,000 games 3 times (for a total of 15,000 played games each) for these statistics:
I certainly have a lot more to learn, but I thought that these numbers might be interesting in the meantime.

I’m looking to upgrade my old sportsman power pole to have a remote control system. The power pole brand sells one for ~300$. I have seen one guy on the pass forums that installed one he found for ~150$ but his links don’t seem to work.
I am also seeing some remote start kits online for ~50$ that are for marine/tv/car use.
Has anyone installed a remote kit? Or know of anyone who has? Is there a cheaper alternative to the 300$ power pole kit?

2023.03.15 14:36 According-Net8330 Why is Marquette to the Final 4 so popular?

To me the East region is the region where hell is gonna break loose.
Everyone is talking about Purdue being unranked to top 10 AP (those teams are like 2/60 to make the Final 4), but Marquette fits that as well. I also saw that teams with a scoring margin under 10 are 12/172 to go to the Final 4 in I believe the past 20 years (Marquette fits that too).
Then factor in Shaka Smart’s tournament record (L in R64 4 times, L in 32 2 times, and only 1 F4 appearance), idk how I can trust them. Edit: especially when you look at the coaches they’d potentially be playing against (Izzo, Calipari)
That being said, this region to me is anyone’s to come out of, but I think it’s worth taking a look at maybe Duke, Memphis, or Michigan St. Curious what y’all think

I have an old power pole sportsman model and want to attach and aftermarket remote controllers. Power pole offers one for ~300$. This seems steep to me. I have found a guy on YouTube/ a bass forum that found a unit for ~150$ but his link doesn’t work and the video is from like 2011.
Does anyone have recomendations for a cheaper remote unit I could install. On Amazon I can find on/off marine/truck/rv remotes I assume for powering on and off a car ect. Could this work for my application since I will need to engage the up or down only as long as I want the pole to be extending down or up. First of all, I am not talking about Tenerife, European islands, America coastal areas etc..
I am talking about regular inland lakes, regular Obesed out of shape people (200lb 90kg) working full time jobs.

Lets be honest, 12 knot is the THRESHOLD of fun. People say ohhh sure you can foil in 10 knot, you can do some non-planning longboard sloshing around, its still better than sitting in front of a desk typing excel sheets. But.. Is that really windsurfing? Windsurfing is getting your board out of water, PLANING, FLYING.. but in order to get people to have a taste of that, you NEED 12 knot.

For regular people without wetsuit drysuits, July/August are the only 2 prime month we can get people to try this sport. Everybody knows that unless you live by the ocean, summer time wind condition is just pathetic. In Illinois/Wisconsin inland lakes, the days over 12 knots are less than 5%.
Wind condition of inland lake of Wisconsin. 12 knot days are sub 5%. Of course we have the big lake Michigan next to us, but I can't safely bring my beginner friends on that.

Personally, I think this forum probably know me by now, I was that crazy guy last year.. I have 5 different boards, 3 different sets of foils, iqfoil full set, etc. The best combination I have found is a 2400cm slingshot front wing, IQfoil board, w/ a 9.5 cambered sail to PLANE without pumping in 8-10 knot conditions. But this is ridiculous amount of money just to get people to have a taste of planing..

Towards the spring or fall time, wind condition drastically improves in our inland Illinois, we have 20% 12 knot days, and in November, we have close to 30% 12 knot days. But when its closer to 40 to 50 degree air temp, we need 4mm+ thickness wetsuits, or drysuits, which also cost quite a bit. On top of that, booties, gloves, beanies.. its at least 300-400 bucks..

This year, I'm definitely going to try harder to get all my buddies to try windsurfing.. I just found a 220L used Goya board for like 700 bucks, that will make my buddies session much more enjoyable instead of using my 165L starboard GO. I have been saving all my buddies birthdays so I'm gifting them 5mm wetsuits on their bday, this way they have no excuses lol.
But I am definitely a little scared of this sports future.. I sincerely hope there is a major breakthrough coming, some ultra lightweight 12m sails maybe? some crazy foil shape that can lift up 200 pounders in 5 knots without pumping etc etc..
