2023.03.20 15:44 Lopsided-Flower7217 Legal advice regarding sick pay violations! Please help!!

Hi Reddit,
I am currently employed at an independent pharmacy in New York. I work part time, on average 3 days/week since December 2021. I recently discovered that I am legally entitled to sick pay according to the NYS Paid Sick Leave Policy that I did not receive thus far. I figured I was not entitled to sick time because of my part time status and I don't have other benefits such as vacation/holiday pay. To my knowledge, I was supposed to be paid at least 5 days sick pay when I got COVID and had to quarantine right when I started the job in December 2021. In addition, I did not receive 40 hours in 2022 (I have accrued enough hours for the year at the 1 hour accrued per 30 hours worked). I also got sick last month and was supposed to work 27 hours but left early mid shift only working 12 hours (leaving 15 hours that should have been paid using sick time). After learning this, I contacted my employer today and he said (after much back and forth) that he will not pay me any sick time as I was not "qualified". I referenced the NYS Paid Sick Leave policy to which he responded he will no longer debate with me and if I wanted to contest him, that I should just hand in my keys and "we should just end it here." At the end of work today, someone came to collect the keys. My questions are:
  1. I have very clearly in writing that bringing up this sick time pay as a debate would lead to immediate termination. This looks to me very clearly as retaliation. Do I have a strong case for a wrongful termination lawsuit? Is it worth pursuing this route? My sister is a lawyer who would represent me at no charge, but don't know how much compensation these cases usually pay out.
  2. He contacted me later tonight saying that officially I will be terminated April 15 and if I can confirm my schedule for next week. Should I continue to work until April 15, and try to recuperate my sick time after termination? Or would this diminish the above retaliation/wrongful termination case?
Basically, I can go one of two ways here. Work until April 15 with confirmed pay and try to get my sick hours payed out to me. Or, I can confirm with my employer that giving my keys today was my termination and very clearly retaliation then sue and try to receive a settlement. Any thoughts are appreciated!

2023.03.20 15:32 ghostgabe81 Respect the Godzilla Family (Godzilla Neo)

Godzilla Neo is a series of fanart and fanfiction by artist and writer Matt Frank. The goal of the series is to create a cohesive timeline that includes (almost) every Godzilla movie, as well as comics and games. The series contains several incarnations of Godzilla, as well as many monsters derived from his DNA that could be considered extended family. This thread will cover them.
Kaiju Threat Level Explanation.
This is taken from the Godzilla Fanon Wiki. While it seems to be written by Frank, I cannot confirm this. It's the only explanation of the threat levels that I can find, so take it with a grain of salt.

The Godzillas

Godzillasaurus

A therapod dinosaur that lived in what is now Southeast Asia, several Godzillasaurs survived the extinction brought about by the battle between King Ghidorah and Gigamoth. By the 1950s a pair of brothers were living on Lagos Island where they were mutated by the Castle Bravo nuclear tests, becoming Godzillas I and II.
Statements of Power

Godzilla I, the standard Godzilla

In 1954, the first Godzilla appeared on Odo Island and eventually attacked Tokyo, only to be killed by Dr. Serizawa's Oxygen Destroyer. His awakening started the modern Age of Monsters.
The initial Godzilla Bio covers all 4 "main" Godzillas in the series. Feats from that Bio should apply to Godzillas II-IV as well.

Strength
Speed
Durability
Atomic Breath
Other Abilities

Godzilla II

The sibling of Godzilla I, this Godzilla appeared a year later in a battle with Anguirus. He became the most prolific of the Godzillas, spending almost 40 years rampaging and fighting countless other Kaiju. He died in Tokyo in 1995.
Statements of Power
Strength
Speed
Durability
Atomic Breath
Other Abilities

Burning Godzilla

A Mutated form of Godzilla II, who's increased power would lead to his own death. Fought Destoroyah in 1995

Godzilla III, Godzilla Junior

Hatched from an egg in 1993, Junior was adopted as Godzilla II's son and grew fast. After being killed by Destoroyah in 1995, the radiation from Godzilla II's meltdown was absorbed by his body, reviving him and mutating him into a full grown Godzilla. He fought a number of kaiju before dropping off the map in 2013, presumed dead due to injuries from a battle.

Atomic Breath

Godzilla IV, Ghost Godzilla

The reborn original Godzilla, grown from the skeleton used in Kiryu. He attacked Japan in 2004 but was stopped and contained in Antarctica, only to be released to combat the Kilaak invasion 50 years later.
Statements of Power
Strength
Speed
Durability
Atomic Breath

Legendary Godzilla

An ancient ancestor to Godzillasaurus called Gojirasaurus Prodigious, it hibernates for millennia at a time into the modern day. It awoke to fight the Shinomura, introducing the world to Titan Class Kaiju
Power
Abilities

Shin Godzilla

The result of an American experiment to grow controllable, weaponized Kaiju, this Godzilla-like creature was released into Tokyo Bay by the scientist who created him after becoming disillusioned with both America and Japan. After a long rampage it was contained by G-Force.

Final Form

Super Godzilla

After Godzilla IV was put into a coma after defeating Kaiser Ghidorah, he was revived using the Amulet of Orochi to save the planet from the threat of Bagan. He eventually proved to be the last monster standing on Earth, and peacefully left to go back to the sea.
Power

Extended Family

Biollante

A chimera of Gojiran, plant and Godzilla DNA. She is the first of many Kaiju created from Godzilla's C-Cells, who migrated into space after several battles with Godzilla.

Spacegodzilla

An alien made of crystals and energy, Spacegodzilla formed a new physical body from the DNA of Godzilla Junior. He was banished to another dimension after trying to kill Godzilla and conquer the planet, and later made a bid to escape during 2007's Crystal Incursion.
Crystal Form
Gojiran Form

Zilla

A kaiju who was mistaken for Godzilla when it invaded New York city to build a nest. The creature was killed, but one of its eggs survived and befriended several humans when it hatched. Later revealed to be a marine iguana mutated by G-Cells.

G-Cell Mutations

A group of several kaiju with DNA strangely similar to Godzilla's. It was discovered that they, along with Zilla, are the result of secret French experiments with G-Cells, creating five new kaiju that escaped containment.
C-Rex
El Gusano
Kamoebas
Komoditrax

Orga

A fusion of Millenian Consciousness with G-Cells, creating mutated alien creature. It tried to consume Godzilla III in order to fully clone itself into him but was killed in the process.
Starship
Gojiran Hybrid

Megaguirus

The Meganula were a species of insect genetically engineered by the Millenians shortly after the extinction of the dinosaurs. After an experimental weapon brought some to the present, they harvested Godzilla III's power and DNA to mutate their Queen, creating Megaguirus. Fought Godzilla but was defeated when Rodan helped him, and was moved to Monster Island.
Speed
Power
Attributes

Kiryu

A cyborg built around the bones of Godzilla I to fight Godzilla III. Kiryu's hardware and software both ran off of the ingrained abilities of Godzilla's body, causing the kaiju to reawaken within the cyborg several times. It eventually became Godzilla IV after going AWOL.
Power
Attributes

Bagan

The single most powerful kaiju in existence, created as a superior successor to King Ghidorah by an alien death cult. A chimera of Godzilla, Ghidorah, and the Orochi-spawn Jyarumu and Balkzardan, he was finally defeated by the combined forces of Super Godzilla, Gigamoth and Mecha-King Ghidorah.

2023.03.20 15:23 Delicious_Reveal3608 Tamil Nadu Budget 2023-24 Announcement

Notwithstanding the several massive welfare schemes that are being implemented during the last two years, owing to the unprecedented and difficult reforms undertaken, we have reduced the annual revenue deficit of around Rs.62,000 crore which we inherited on assuming office, to around Rs.30,000 crore in the Revised Estimates of the current year. It is noteworthy that this is approximately Rs.5,000 crore lower than the level of the pre-COVID year of 2019-20. In accordance with the mandate of the Fiscal Responsibility Act of achieving Zero-revenue deficit, the State will adopt a smooth glide path without compromising on our welfare initiatives and developmental priorities
The main reason for the fiscal stress faced by the Government at the time of assuming office was the fall in tax revenue in the previous years. The State‟s own tax revenues which were at a healthy 8 per cent of the Gross State Domestic Product (GSDP) during 2006-11 have witnessed a precipitous fall in the last 10 years and reached 5.58 per cent in 2020-21. This is much lower when compared to other large States such as Maharashtra and Karnataka. Though the Tax-GSDP ratio has increased to 6.11 per cent in the current year due to the efforts of this Government in the last two years, concerted action is needed to raise it further to find financial resources for welfare schemes.
The Hon‟ble Chief Minister adroitly handled the second wave of Covid, major floods in Chennai and severe financial stress. In spite of these constraints, he was able to fulfill the promises to the people and has several achievements to his credit. He has urged us to strive to fulfill the expectations of the people in the coming years and I have prepared this budget keeping these instructions in mind. With these introductory remarks, let me now proceed to sector-wise view of the Budget 2023-24.
To honour the legacy of Tamil martyrs Thiruvalargal Thalamuthu and Natarajan, who sacrificed their lives to protect Tamil in the struggle against Hindi imposition, a memorial will be established at Chennai.
In order to propagate the ideals of Annal Ambedkar, the father of the Indian Constitution and the architect of a progressive and egalitarian India, the Government will provide a grant of Rs.5 crore to translate his works into Tamil language.
To give an impetus to the growth of Tamil as a global language by promoting its usage in the technology sector, an „International Conference on Tamil Computing‟ will be held with the participation of renowned experts from across the world. This will greatly encourage development of software in Tamil language.
With a view to celebrating the glory of Tamils who have conquered many lands overseas, efforts will be taken to promote and support sea cruises that will connect places of significance in Tamil culture. These cruises will showcase the rich history, literature, art, culture, handicrafts and cuisine of Tamil people and will spread the State‟s glory across the seven seas.
The Government has been providing free bus pass to elderly Tamil scholars in recognition of their invaluable contribution to our language. In the coming year, the Government will extend this benefit to 591 more Tamil scholars.
To enable the younger generation to imbibe and appreciate our celebrated art heritage, the Government will expand the widely popular Chennai Sangamam cultural programme to 8 major cities in the coming year. It will provide a platform to nurture folk art and artists and celebrate the shared cultural ethos of the Tamil people. An amount of Rs.11 crore is provided in this Budget for this purpose.
To preserve folk arts and to ensure that these traditions continue to flourish in the future, 25 part time folk art training centres will be set up across the State.
The Cholas are one of the greatest dynasties who conquered seas and the lands beyond, and ruled vast stretches of India and South East Asia for many centuries. Tamil art, music, architecture, sculpture, crafts and dance reached their pinnacle during the Chola period and their glory spread far and wide. To highlight the contribution of the Cholas who ruled the world, and to preserve artefacts and relics of that age, a “Grand Chola Museum‟ will be set up in Thanjavur.
The Hon‟ble Chief Minister intervened on humanitarian grounds to send essential commodities to help the people affected by the severe economic crisis in Sri Lanka. After securing the consent of the Union Government, 40,000 MT of rice, 500 MT of milk powder and 102 MT of medical supplies, worth Rs.197 crore have been sent in three ships.
We have been continually requesting the Union Government to grant Indian citizenship to Sri Lankan Tamils residing in India. Pending this request, this Government had announced that 7,469 houses will be constructed in the rehabilitation camps for Sri Lankan Tamils, with the objective of providing safe and quality accommodation. In the first phase, 3,510 houses were taken up for construction at a cost of Rs.176 crore and the works are underway. In the second phase, the Government will sanction Rs.223 crore towards construction of the remaining 3,959 houses in the coming financial year.
Recognizing the valour and supreme sacrifice made by security forces in guarding our nation, the ex-gratia that is being offered by the State Government to the next of kin of armed forces personnel hailing from Tamil Nadu who are killed in wa war-like operations will be doubled from Rs.20 lakh to Rs.40 lakh. Further, the monetary grants that are offered to gallantry awards/distinguished service medal winners in armed forces hailing from Tamil Nadu will be enhanced four times.
Ensuring quality education and medical facilities to all is the fundamental objective of this Government. It is in pursuance of this goal that the Government is implementing pioneering schemes like Makkalai Thedi Maruthuvam and Innuyir Kappom, besides taking several initiatives to strengthen the public health infrastructure in the State. The Government is implementing the novel Makkalai Thedi Maruthuvam scheme, where non-communicable diseases are identified and addressed at an early stage. This Government which is deeply concerned about the welfare of workers, who are the bedrock of our economy, will launch a new initiative to address the issue of non-communicable diseases among workers in factories and in unorganised sectors like construction. The Makkalai Thedi Maruthuvam scheme will be expanded to 711 factories covering 8.35 lakh workers in the first phase. Health checkup camps will be held in these factories with specific emphasis on non-communicable diseases like high blood pressure and diabetes. Migrant labourers will also benefit under this scheme.
Under the Chief Minister‟s Comprehensive Health Insurance Scheme, insurance coverage of Rs.5 lakh is being given per year per family. During the current year, so far, 11.82 lakh patients have availed treatment worth Rs.993 crore, which is the highest since the inception of the scheme.
The 1,000 bedded Kalaignar Memorial Multi Super Speciality Hospital in the premises of King Institute of Preventive Medicine and Research Centre, Guindy will be inaugurated this year. New speciality hospital buildings are being constructed in three Government medical college hospitals at Madurai, Coimbatore and Kilpauk at a total cost of Rs.1,020 crore and they will be put to use shortly
New buildings will be constructed at a cost of Rs.110 crore in the Mahatma Gandhi Memorial Hospital, which caters to the medical needs of people in Tiruchirappalli and its surrounding districts. In order to fulfil the medical needs of people in North Chennai, a new multi-speciality block, nurses training school and hostel will be constructed in Stanley Hospital at a cost of Rs.147 crore.
The first Government Siddha Medical College in the State was established in Palayamkottai in 1964. At present, there are 100 undergraduate and 60 post-graduate students in this institute. Further, treatment is also being provided to nearly 1,000 patients on a daily basis. The Government will undertake works to improve the infrastructure of the college and hospital at a cost of Rs.40 crore. Rs.18,661 crore has been allotted towards Health and Family Welfare Department in the Budget.
Due to the various initiatives launched by this Government in the last two years, the student enrolment in Government schools has increased significantly. Therefore, the Government had launched the „Perasiriyar Anbazhagan School Development Scheme‟ to modernize and upgrade physical infrastructure at an outlay of Rs.7,000 crore over a period of five yeaRs.During the current year, works to the tune of Rs.2,000 crore have been taken up. In the upcoming financial year, the Government will construct classrooms, laboratories and toilets at a cost of Rs.1,500 crore.
The „Ennum Ezhuthum‟ Programme aims at achieving Universal Foundational Literacy and Numeracy for students in classes 1 – 3 by 2025. Owing to the positive response received, this programme will be expanded to classes 4 and 5 with an outlay of Rs.110 crore in the upcoming financial year.
The goal of social justice can be fulfilled only when knowledge is made widespread and accessible to people in the remotest of places. With this objective, moving beyond Chennai, book fairs were conducted in all districts and five literature festivals were successfully conducted during the current year. This great initiative will continue next year also, at a cost Rs.10 crore. The Government successfully organized the first edition of the Chennai International Book Fair in January 2023 with participation from 24 countries. An unprecedented number of 355 MoUs were signed between publishers from Tamil Nadu and various countries paving way for knowledge and copyright exchange. This international book fair will also be conducted next year.
Educational institutions play a vital role in establishing social justice, equality and equity in all walks of life. Therefore, the Government has been taking multiple initiatives in the last two years to improve the quality of education through schemes such as Ennum Ezhuthum, Schools of Excellence, Hi-tech Labs, Model Schools, and Perasiriyar Anbazhagan School Development Scheme. It is essential that the benefits of these programmes reach all students. Requests have been received to operate and maintain Adi Dravidar Welfare Schools through the School Education department in the State High-Level Vigilance and Monitoring Committee meetings held under the chairmanship of the Hon'ble Chief Minister on 19.8.21 and 12.4.22. To achieve the goal of social justice in the field of education, to improve the quality of schools functioning under various departments and to ensure that all students are provided quality education, all schools functioning under various departments like Adi-Dravidar and Tribal Welfare, Backward Class, Most Backward Class & Denotified Communities, Hindu Religious & Charitable Endowments and Forest will be brought under the School Education department. It will be ensured that the service conditions and benefits of teachers and staff presently working in these schools are protected.
The Government is using data based governance to remove various shortcomings in the implementation of schemes. In order to reduce the unnecessary delay in the disbursement of scholarships by various departments and to ensure that scholarship amount reaches eligible students in a timely manner, directly to their bank accounts, an integrated scholarship portal will be created.
An iconic eight-storeyed library in two lakh square feet, with all modern amenties is being constructed in Madurai, the seat of Tamil Sangam. This library will cater to all sections of the society including children, students, researchers, youth who are preparing for competitive exams, homemakers, senior citizens and the differently abled. The library will feature special facilities including children‟s section with colourful books, separate area with internet facility for those writing competitive exams, braille books for the visually impaired, air conditioned meeting halls, art gallery to exhibit the cultural heritage of Southern Tamil Nadu and an exquisite repository of the writings and speeches of Muthamizharignar Kalaignar.
In the first phase, this library will house 3.50 lakh books in Tamil and English relating to various subjects like literature, culture, science, engineering, law and medicine. This modern temple of knowledge in Southern Tamil Nadu will be named Kalaignar Centenary Library to mark the commencement of centenary celebrations of Muthamizharignar Kalaignar, in recognition of his immense contribution to the Tamil society. This library will welcome its first readers in June this year. Rs.40,299 crore has been allocated towards School Education Department in the Budget.
The Government is cognizant of the fact that human resource is the greatest wealth of the State and has been investing heavily in its development. We recognise that a highly skilled workforce is a unique competitive advantage to attract investments into the State. Therefore, to create a workforce suited for the rapidly changing industrial ecosystems, a scheme is underway to transform 71 Government ITIs to Centres of Excellence at a cost of Rs.2,877 crore. The works will be completed and students will be enrolled in new courses in the coming academic year itself.
In the next phase, the Government will launch a programme in the coming year to transform and modernize the Government Polytechnic colleges into „Centres of Excellence‟ in accordance with the Industry 4.0 standards in collaboration with industry partners. The programme will focus on infrastructure modernization, industry relevant course content creation, capacity building of faculty members and employment opportunities for the students. 54 Government polytechnics will be upgraded as „Centres of Excellence‟ at a total cost of Rs.2,783 crore under this scheme.
The Government proposes to establish a world class skill centre named “Tamil Nadu World Innovation and Skill Training Hub” (TN-WISH) at Ambattur at a cost of Rs.120 crore with the objective of providing skill training to trainers in ITIs and polytechnics and to create a highly skilled workforce. The hub will provide training in advanced technologies such as Mechatronics, Internet of Things, Advanced Automobile Technology, Precision Engineering and Advanced Welding.
The Hon‟ble Chief Minister had launched the visionary programme “Naan Mudhalvan” last year to train 10 lakh students and youth in industry relevant skills and thus generate job opportunities for them. This programme is being implemented in all engineering and arts and science colleges in collaboration with industry partneRs.Academic curriculum has been revised to include industry relevant courses to improve employability of students. Currently, about 12.7 lakh students from engineering and arts and science colleges are being trained under this programme. 12,582 engineering faculty and 7,797 arts & science faculty have also been trained. Rs.50 crore has been provided for this scheme in the budget.
To scale up skill training infrastructure in a massive way, factories will be used as Skill Development Centres. Industries will be incentivized to provide on-the-job-training to youth in factories. In this Budget, an amount of Rs.25 crore has been allocated for this „Factory Skill Schools‟ programme. A state-of-the-art Skill Development Centre will be established, at an estimated cost of Rs.80 crore, in SIPCOT Industrial Park, Shoolagiri in Krishnagiri district, which is emerging as the third largest industrial cluster in the State.
The Perunthalaivar Kamarajar College Development Scheme was launched last year with an outlay of Rs.1,000 crore for improving infrastructure and basic amenities in Government colleges over a period of five yeaRs.In the current year, works such as construction of new classrooms and additional laboratories have been taken up in 26 Government polytechnic colleges and 55 Government arts and science colleges. These works will be carried out in the coming financial year also at an estimated cost of Rs.200 crore.
It is seen that the number of students from Tamil Nadu clearing the Civil Services Examinations has been on the decline in the last few years. With the objective of reversing this trend, Tamil Nadu Skill Development Corporation (TNSDC) will implement a scheme in co-ordination with Anna Staff Administrative College to help civil services aspirants to access better coaching facilities and materials. Every year 1,000 civil services aspirants will be short listed through a screening test. Each aspirant will be provided Rs.7,500 per month for 10 months to prepare for the preliminary examination. Those students who clear the preliminary examination will be provided a lumpsum amount of Rs.25,000. For this programme, an amount of Rs.10 crore has been allocated to TNSDC in the Budget Estimates 2023-24. In aggregate, an allocation of Rs.6,967 crore has been made to the Higher Education Department in this Budget.
With the realization that tomorrow‟s society is the responsibility of today‟s youth, this Government is committed to making the youth strong and vibrant. With the successful conduct of International Chess Olympiad in Chennai and the competitions for Chief Minister‟s Trophy being held across the State, the sports sector has been given a new impetus. As the next step, the Government through the Chennai Metropolitan Development Agency will set up a state-of-the-art Global Sports City in Chennai which will promote the development of sports and emerge as a favoured destination for leading sports events. For this purpose, a detailed project report will be prepared by engaging international experts.
The Government will undertake a comprehensive renovation of the iconic Jawaharlal Nehru Outdoor Stadium, Chennai and equip it with modern sports facilities at an estimated cost of Rs.25 crore.
This Government, which is founded on the principles of social justice and equitable growth, attaches highest priority to the development of Adi-Dravidars and Tribals. With the objective of increasing the Gross Enrolment Ratio of Adi Dravidar and Tribal students in higher education and providing them safe and quality accommodation, four new hostels will be constructed with modern facilities in Madurai, Coimbatore, Tiruchirappalli and Nilgiris at an estimated total cost of Rs.100 crore. These hostels will be maintained and managed by engaging professional agencies.
It has been a long pending demand to enact a legislation to ensure effective implementation of the Scheduled Castes and Tribal Sub Plan. Heeding to this request, the Government will bring a new legislation to ensure adequate allocation of funds and effective implementation of the Scheduled Castes and Tribal Sub Plans. The draft bill will be introduced in the next session of the Assembly after due consultation with stakeholdeRs.
The practice of manual cleaning of sewers and septic tanks is a blot on humanity. In order to completely prevent deaths due to manual cleaning of sewers and septic tanks, a new scheme has been recently launched by this Government. By transforming sanitary workers into entrepreneurs and facilitating them to procure modern machinery, this scheme will enable them to undertake these works in a safe manner and generate income. In this scheme, priority will be given to families of sanitary workers who died during manual cleaning and to persons currently engaged in sanitary work, on the basis of their willingness. In the first phase, the scheme will be implemented in the Chennai Metropolitan area. Based on this pilot exercise, the scheme will be expanded to the entire State.
It is seen that the share of persons from Scheduled Caste and Scheduled Tribe communities who avail various entrepreneurship promotion subsidies from the Government is very low. In order to promote economic development of SC/ST entrepreneurs, a new scheme called „Annal Ambedkar Business Champions Scheme‟ will be launched in the coming financial year. The new scheme will provide 35 per cent capital subsidy and offer 6 per cent interest subvention for loans to procure machineries and equipment. A sum of Rs.100 crore is allocated for this scheme in the Budget Estimates 2023-24.
To revive the Welfare Board for Puthirai Vannars, Rs.10 crore will be provided to undertake livelihood development and welfare activities.
A new scheme named „Iyothee Thass Pandithar Habitation Development Scheme‟ will be launched to ensure basic amenities in Adi Dravidar habitations in both urban and rural areas and to bring about comprehensive socio-economic development. The scheme will be implemented at a cost of Rs.1,000 crore over a period of 5 years.
A sum of Rs.3,513 crore has been allocated to the Adi Dravidar and Tribal Welfare Department in this Budget.
It is well known that it was Muthamizharignar Kalaignar who coined the term „Differently Abled‟. Given the importance of this department, it is directly looked after and works are closely monitored by the Hon‟ble Chief Minister. RIGHTS project is being implemented at a cost of Rs.1,763 crore with financial assistance from World Bank. The main objective of this project is to create an inclusive society by promoting accessibility through creation of barrier-free structures and employment opportunities through vocational training. The project will be implemented in 15 districts in 2023-24. At the divisional level, 39 One Stop social care service centres will be established to provide services including disability assessment, certification and early intervention. Further, 150 neighbourhood centres manned by volunteers will be set up to provide treatment at home and assistance in availing benefits under various welfare schemes.
For the benefit of the 6.84 lakh differently abled persons across the State, the Hon‟ble Chief Minister has already issued orders to increase the pension from Rs.1,000 to Rs.1,500 and the maintenance allowance from Rs.1,500 to Rs.2,000 for severely affected persons with disabilities. Towards this, a sum of Rs.1,444 crore has been allotted in the Budget.
The State Government is providing guarantee and interest subsidy for the development of enterprises of differently abled persons. Through these initiatives, Tamil Nadu has facilitated loan assistance to 11,155 differently abled persons to the tune of Rs.50 crore through National Handicapped Finance Development Corporation this year, placing Tamil Nadu in the first place in the Country.
The Government is developing a comprehensive database of differently abled persons to ensure effective delivery of benefits under Government schemes. In the first phase, a database of 9,08,000 persons who are benefitting from various welfare schemes has been created.
The Government has been taking various steps to improve the functioning of Backward Class and Most Backward Class hostels by upgrading infrastructure, and providing nutritious food. In the last two years, works for the construction of 9 hostels at a cost of Rs.36.25 crore are being implemented. Further, based on the requirements of students, fifteen school hostels have been upgraded as college hostels.
In the Budget Estimates, a sum of Rs.252 crore has been allocated towards Pre-Matric and Post-Matric scholarship schemes. An amount of Rs.305 crore has been earmarked towards distribution of bicycles to students. A sum of Rs.1,580 crore has been allocated to the Backward Class, Most Backward Class, Denotified Communities and Minorities Department.
Following the ancient Tamil tradition, many leaders of the Tamil society have introduced pioneering schemes to eradicate poverty and promote the educational development of students. In 1920, Sir Pitti Theagarayar, the then chairman of the Chennai Municipal Corporation introduced mid-day meal programme in Chennai for the first time in the Country. During Perunthalaivar Kamarajar‟s tenure as the Chief Minister, the mid-day meal scheme was expanded at the state level, marking a transformational change in the history of education in Tamil Nadu. This was followed by further efforts to eliminate hunger including the Nutritious Meal Programme by Puratchi Thalaivar MGR and the scheme to provide eggs along with nutritious meals by Muthamizharignar Kalaignar.
At this juncture, it has come to light that some children studying in Government schools are suffering from stunted growth and malnutrition. Recognizing that students may be unable to concentrate on studies as they come hungry to schools without eating breakfast, the Hon‟ble Chief Minister launched the „Chief Minister‟s Breakfast Scheme‟ last year, which is the landmark scheme of this Dravidian Model Government founded on social justice. This historic scheme was inaugurated on September 15, the birth anniversary of Perarignar Anna.
The Chief Minister‟s Breakfast Scheme is being implemented in 1937 Government Primary Schools and it is benefitting 1,48,315 students studying from Class I to Class V. Out of the 1,543 Elementary schools, where the scheme was implemented in the first phase, the attendance of students has increased in 1,319 schools. The attendance has increased by 10per cent in 624 schools, 20per cent in 462 schools and 30per cent in 193 schools. In Tiruppathur, Perambalur, Ariyalur and Tiruvarur districts, attendance of students has increased in all the schools where the Breakfast scheme was implemented. To translate the noble vision of the Hon‟ble Chief Minister that we will make any sacrifice to ensure that no child remains hungry while learning and to make learning joyful and education universal, the Chief Minister‟s Breakfast Scheme will be expanded to cover all the 30,122 Government primary schools in the State from the coming academic year. Rs.500 crore is allotted for this scheme in this Budget which will benefit 18 lakh students studying from Class I to Class V.
Educated women are essential for a prosperous and self-sufficient society. Well aware of this, Muthamizharignar Kalaignar introduced the Moovalur Ramamirtham Ammaiyar Marriage Assistance Scheme in 1989 to promote women's education. Realizing that many girls from poor families in Tamil Nadu are unable to continue higher education after completing 12th standard, this Government has redesigned the scheme as Moovalur Ramamirtham Ammaiyar Pudhumai Penn Scheme, under which all girl students studying from 6th to 12th standard in Government schools are provided Rs.1000 rupees per month for their higher education. At present, 2.20 lakh girl students are benefitting under this scheme every month. Compared to the year 2021-22, 29 per cent more girls have entered colleges this year, which is an addition of 20,477 girl students. The fact that the many girls who did not pursue higher education after completing their schooling have now enrolled in colleges is a testimony to the success of this scheme.
The self-help group movement, that was pioneered by Muthamizharignar Kalaignar in the country in 1989 at Dharmapuri, has today blossomed into a massive people‟s movement. This Government is undertaking several measures for capacity building and livelihood development of women self-help groups. In the current year, so far, women self-help groups have received bank loans of around Rs.24,712 crore. In the coming financial year, a target of Rs 30,000 crore has been set for credit linkage to SHGs.
Women entrepreneurs continue to face difficulties in accessing adequate, timely credit and marketing of products. To address these challenges, the Government will establish an exclusive „Start-up Mission‟ for women. This mission will facilitate women entrepreneurs in all aspects of their business.
Since 2021-22, a total of 213 godowns have been constructed with a storage capacity of 2.86 lakh MT at a combined cost of Rs.238 crore to augment storage capacity and minimize losses. Further, 12 godowns with a storage capacity of 28,000 MT are being constructed at a total cost of Rs.54 crore.
To meet the liabilities of the important poll promises fulfilled by this Government, a sum of Rs.2,393 crore for the waiver of agricultural loans, a sum of Rs.1,000 crore for the waiver of jewel loans and a sum of Rs.600 crore for waiving self-help group loans, totalling an amount of Rs.3,993 crore has been allotted in the Budget.
The Government will frame a comprehensive long-term plan to carry out structural reforms in Tamil Nadu Civil Supplies Corporation to improve efficiency in operations and fiscal sustainability. An amount of Rs.10,500 crore has been provided in this Budget towards Food Subsidy in the Public Distribution System. An allocation of Rs.16,262 crore has been made to the Co-operation, Food and Consumer Protection Department in this Budget. The Government is taking several efforts to restore and rejuvenate the water bodies. Under Tamil Nadu Irrigated Agriculture Modernisation Project, the Government has sanctioned rehabilitation works in 341 tanks, 67 anicuts and 11 canals at an estimated cost of Rs.462 crore. Further, repair, renovation and restoration works are being undertaken in 309 tanks at an estimated cost of Rs.258 crore.
Long term flood mitigation works are being undertaken at a cost of Rs.184 crore in the districts of Chennai, Tiruvallur, Kanchipuram and Cuddalore. Of these, 9 works have been completed and 2 works are in progress. In the current year, 12 flood mitigation works have been undertaken in Chennai, Kanchipuram, Chengalpattu and Thiruvallur districts at a total cost of Rs.434 crore.
The Tamil Nadu Animal Welfare Board, under the chairmanship of the Hon'ble Chief Minister, has been restructured to promote the welfare of animals in the State. In order to control the burgeoning street dog population, it is necessary to set up Animal Breeding Control Centres. To strengthen and improve the effectiveness of the Animal Welfare Board, an amount of Rs.10 crore has been provided in the Budget. This fund will be used to carry out animal breeding control activities, provide training to local Government employees and implement animal welfare activities.
This Government is empathetic to the welfare and special needs of fisher folk and has increased the special allowance during lean months to Rs.6,000 from Rs.5,000. An allocation of Rs.389 crore has been made to benefit 4.3 lakh beneficiaries for implementing the fishermen welfare schemes such as Lean period assistance, Ban period relief assistance and Savings cum Relief schemes.
Coral reefs provide shelter and food to fish and increase the probability of survival of fingerlings. To improve the livelihood of country craft fishermen, 217 units of artificial reefs will be established at a cost of Rs.79 crore in the 3 Palk Bay districts and 200 units will be set up at a cost of Rs.64 crore in other districts.
Due to increasing vagaries of climate change and pressure caused by the burgeoning population, the coastal ecosystem and the livelihood of coastal population are likely to be severely affected in the near future. The Government will implement the „Tamil Nadu Coastal Restoration Mission‟ with the objective of preventing sea erosion, reducing marine pollution and conserving marine biodiversity. The mission will be implemented with World Bank assistance at an estimated cost of Rs.2,000 crore in the next 5 years.
A contiguous stretch of protected forests is essential to protect endangered wildlife. The Government will notify a new wildlife sanctuary „Thanthai Periyar Wildlife Sanctuary‟, with an extent of 80,567 hectares in the forest areas of Anthiyur and Gobichettipalayam Taluks in Erode district to link the Nilgiris Biosphere Reserve with Cauvery South Wildlife Sanctuary. This will be the 18th wildlife sanctuary in the State.
Tamil Nadu is located in the Central Asian Flyway and hosts a large number of migratory birds every year. In order to promote conservation of birds, encourage research in the field of ornithology and create awareness about the role of birds in nature, the Government shall set up an „International Bird Centre‟ at Marakkanam at an estimated cost of Rs.25 crore.

Water in recessed slab pouring out from a pipe, what is the pipe connected to?
Hi plumbers!
I have a small amount of water pouring out of a pipe into a small recessed area in my basement concrete slab, just under my electric furnace. It started few days ago, it's manageable for now but we're concerned.
It looks like a drain pipe. What do you think this pipe is connected to and what does it mean to have water pouring out?
Thanks a lot !!!

2023.03.20 15:01 FlipDaly Flashback to COVID content, long

This is a repost. Welcome to flashback time. Original posts made over the course of 2020 by u/SleepyLi in nyc. Edited for readability.
March 15 2020
PSA for folks worried about how they’ll eat during this time
TL;DR at bottom.
This is the first post I’ve ever put up on Reddit, so excuse me if this shit jankey asf, or in the wrong place. A comment I left on someone’s post received some really good feedback, so I figured there would be other folks who might be experiencing a rough time as well, so here I am being proactive.
As we all know, COVID-19 is fucking shit up. Most folks are working from home, but that’s generally for folks working white collar jobs with job security, which a fuckton of NYC heads don’t have. Folks in the service industry don’t get paid if they don’t work, so there’s no “I’m going to WFH and bus my own fucking table” or “Let me make that drink for you bud” in ya own kitchen for ya cat. So money is tight for some of y’all. And I get it. I’ve been in that position before, shit sucks and gurgles donkey dick. So here’s my PSA:
I help run a wholesale/retail meat shop in NYC, specifically the LES, in Chinatown. I’m open, cause how else is everyone going to eat and cook at home? Just as I told someone before, I’ll say the same thing here: $10 will get you something like 13 pounds of chicken drumsticks, plus a dozen eggs. Don’t like drum sticks? Fine, get something else, our prices are lower than your GPA and your parents’ expectations for you. We don’t sell rice, but a 20lb bag of rice runs like $25 bucks in our area and if you ask, I’ll tell you exactly where to go. Our location is:
47 DIVISION STREET GROUND FLOOR NEW YORK, NY 10002
B/D to Grand Street, F to East Broadway
Now you might say some shit like “this is a shameless cash grab, etc.” And you know what my response is to that?
What the fuck are you talking about, and you can suck my fucking ass. I’m not going to get rich making ten bucks off 13 pounds of drumsticks and a dozen eggs (if we even have anymore). This is for folks that are hurting real bad or just plain about to fucking be put out cause $10 is all they have. If I was trying to get rich, being the local pig boy is obviously not the right trade to get into, now is it.
For those that also see this and start scheming on if you can roll up on my spot and try to make me run my pockets for $10: come and find out whether or not you have a first class ticket to meet God, express lane. Or just come and tell me you want to shoot the fair one for fun, I’ll oblige too.
If you have a healthy savings account, please don’t come to my shop at this time. If you’re stocked up and can weather a self quarantine, again, please don’t come to my shop at this time. I’d appreciate the business during a more normal period of time, but as of now, it’s geared towards my fellow NYers who are most at risk due to their economic situation. I have a limited supply of produce and I’d like to give us all a fighting chance.
In this time of great uncertainty and fear, we New Yorkers must stand together and be each other’s keepers. Take care of your folks, your neighbors, each other. We’ve weathered 9/11 together, Superstorm Sandy, shit, the fucking 2016 election, and this too will be something that we will weather and emerge victorious from.
TL;DR: if you’re a poor fuck and worried about how you will eat during COVID-19, come hither you poor child, for I have wares for cheap. But for real, give me $10 and I will feed you for a week.
47 Division Street Ground Floor New York, NY 10002

——————————————————————— Edit: figured it should be said, but for those that might not be aware: because we cater to a low income demographic already, we accept EBT, cash, and debit card. We don’t accept credit. This is what something like 90% of people with rocky income use, so that’s what we’ve gone with.
02Edit: I've been reached out to by a number of people about a possible pay it forward program/scheme/initiative. I thank you and commend ya'll for coming together to help those in need. I'm trying to get in touch with some folks or organization that do grocery shopping/meal prep for the elderly/folks that are most at risk and can't do it themselves. I'd like to use those funds to provide the supplies for cooking and shit at cost. If I can't get in touch with some folks, I'll start a Facebook group/some other jankey shit to better coordinate based on geographical location and have it vertically integrated into the business. Will set up a venmo or something later in the day. Also: we're located in Chinatown, so don't gawk and be surprised if you see shit like chicken feet, pork and beef trotters, and the like. Welcome to eating head to tail.
Thanks for the feedback.
---
UPDATE- Getting a lot of push back from my wholesalers and suppliers; they're rationing our orders. Everybody is short. Doing my best to get more orders from source, but jesus fuck the prices are being gouged the fuck out rn. Will keep trying to keep everything affordable to everyone.
---
02UPDATE 18MAR2020-
I created a Venmo. The handle is Sleepyli-LocalPigBoy Avatar should be a pissed off cat.
All transactions will be public. For those that use cash for the pay it forward as the lady with the nice glasses and vans did today, I have a repurposed envelope that I will insert the money in and deduct for orders going out. Trying to do this as legit as possible, with logs of each transaction so mfs don’t come at me like I’m a mega church asking for donations to buy me a jet. Let your poor and broke ass friends know that they don’t need to starve in times like this.
Also: Due to whatever issues are being had further up the supply chain, same as my first update: supplies are getting tight and assholes are beginning to capitalize on it. $10 will no longer get you what was originally offered unfortunately: it’ll get you 7lbs of drumsticks and a dozen eggs now.
Eggs are climbing up and drumsticks are getting fucking stupid. I received two cases today. I ordered 40. They deadass rationing everybody, with jacked prices. I’m sorry, but I’m raising prices to literally break even. My salary is currently on hold cause I can afford it, but others can’t.

03UPDATE 25AUG2020-
Old Venmo has been deleted. New Venmo is: FourSevenDivisionStreetTrading

Cheap Meat
Not sure if this is allowed, but fuck it, we're hurting and desperate times create desperate people who do desperate things.
TL;DR: Local butcher shop with cheap prices. Trying to keep afloat and keep folks fed. Address at bottom.
Sup ya'll, it's your favorite local meat boy (for those that don’t get it, here's my first post: original NYC meat boy post).
Despite COVID cases in NYC having dropped a fair amount, a lot of businesses that have opened up aren't doing so hot, and still some are not going to open up ever again. While there's unemployment insurance for individuals, there really isn't much for small local businesses. I also know that the pandemic boost for UI is about to run out end of month, so if you're sweating about how you're going to eat, I got you.
Most of America's economy began to feel the effects of The Rona around March of this year, but businesses located in Chinatown were fucked as early as January. America's reporting on COVID centered around China being the bad guy, which trends to loop all Asian Americans as "others" and "not really American." Chinese businesses tanked and hate crimes shot up. People within the community began their own self-imposed quarantine due to increased fear of being caught slacking by some racist fuckstick. Then came the formal lock down in March, which really flipped us over, bent us over the couch for good leverage, and fucked us deep and hard. At the time of 14JUNE2020, less than half of Chinatown's restaurants are open, and less than a third of total businesses are open (Bloomberg article supporting claim). Most funds meant as relief for small businesses got snagged by large corporations. And now all the SMEs are floundering. As of now, the end of July, still less than a third of Chinatown businesses have opened up, especially since most of them couldn't apply for any assistance due to language barriers.
So again, here I am peddling my wares. I also have $9.75 left from someone that wanted to pay it forward earlier in the year for what it’s worth.
We’re a small local meat shop. A butcher shop. A boutique culinary protein throwback to simpler times. Whatever the fuck you want to call it. We sell meat. You get the idea. Our prices are real fucking low. Lower than your self esteem. Lower than what your parents think of you. And that’s a good thing. Cause you like cheap things, you cheap fuck. Save all the money you can. While I can’t guarantee that we’re the cheapest you’ve ever seen, I can guarantee that we’ll be top five in cheapest prices in NYC.
What do you want? Cause more likely than not, we got that shit.
POULTRY. We got all kinds of birds. Chicken, silkies, qual, squab, duck, goose, stewing hens. Fuck you want? Still debating on whether drums or mid’s are better with your friends? Fuck around and cop a pound of each for under $5 per person: mid-wings are $3.89 a pound, drums are back to $.69/lb. Want more meat? Fine. A whole ass chicken leg and thigh, $.89/lb. You fuck with feet? It’s 2020, more power to you my guy. Chicken feet stands at $1.69/lb, duck feet at $1.49/lb. You into titties? Of course you're into titties: chicken breast coming in hot at $4.95 for a 2.2lb net weight bag. Into retirees and GILFs? All you Jack Black: Stewing Hens are two for $5.95. Haven’t gotten neck and head in a hot minute cause of COVID, or your Tinder and Hinge profile is just that basura? Say less: duck heads and necks at $1.39/lb. Into spawn kill? My guy: we got a dozen eggs for $2.95, 30 pack for $6.50. Duck eggs, six for $3.95.
PORK. My man, let me tell you something. You fuck with pork chops? Even if you don't, for $2.39/lb, you fuck with pork chops. We got tenderloins for $3.19/lb. Bones for stock? $.99/lb. Let me guess, you miss eating authentic char siu over rice with the sauce from Chinatown. At $2.69/lb for char siu meat, you can afford to fuck up three times and still come out ahead instead of buying it from a restaurant. Since it's getting hot, you're going to want to throw BBQs, right? Hopefully they're socially distanced, everyone is responsible and wearing a mask, and all you motherfuckers got COVID tested prior. Got you some ribs for $2.89 a pound. You want some of them dim sum ribs? Them itty bitty, little tiny cuts of ribs? Small just like your feelings when your ex left you? $3.59 a pound. You been going through a rough time and need an ear to listen to you. $3.39/lb for pig ears buddy, say more. If you been fucking with feet and chicken and duck feet don't cut it, do it like J. Cole "so big it's like a foot is in yo' mouth" cause I got pre-cut pig trotters for $1.49 a pound. Oh, you deadass want the whole foot in your mouth? Weird, but we're being open-minded here: whole uncut pig trotters at $1.79/lb.
BEEF. Let me guess: you haven't gotten enough foul language from this post and need a better tongue lashing? You filthy, sick, sorry, piece of shit. Beef tongues will run you $6.99 a pound. Or you want to boss up, but instead of being bad and boujee, you've been sad and boujee cause of COVID. Well, fear not, cause with femur bones at $1.95/lb, you can split them right down the fucking middle to get to that sweet, sweet, succulent marrow and feel like you're out brunching, spending $80 you don't have for a meal you can't afford to flex on hoes you couldn't really give less of a shit about. What's that? Pig trotters don't cut it? You trying to deepthroat the shit? I mean, do mama proud I guess. I got beef trotters/feet at $1.89 a pound. I mean, with skills like that, why you even buying from me? You belong on the yacht of some old rich man. But do you. Oh what's that? Your girl says your stroke game shit and you falling short of getting up in her guts? No fix for that, sorry, but you can cop honeycomb tripe or stomach at $3.39 a pound and know for a fact you can absolutely beat the ever living fuck out of these guts. You trying to fuck with flank steaks? $7.45 my guy. New York Strip? $8.99. T-Bone? $7.99. My bone? Ten camels. Where my Jamaicans at? Waa gwaan? I know oxtail is AT LEAST $6.75/lb where you’re at. We have them on deck for $5.99/lb.
Or maybe you’re a rapper. You’re on SoundCloud pushing music and living out your mama’s crib. No shame, it’s rough out here King. Want to know how to really blow up? What did Eminem call himself in 8 Mile? That’s right, B-Rabbit. And you know what I got? Rabbit for $4.69 a pound. You are what you eat man. I’m not saying that eating rabbit will immediately blow your rap career the fuck up and give you the lyrical genius of Eminem, but I’m not saying it won’t either. For less than $5 a pound, you really gonna chance it? What if the other rappers cop it and you don’t and they blow up? Don’t get left behind my guy. You a King and King’s gotta do what they don’t want to do sometimes for the betterment of the folks. And the folks want to hear your music.
Or maybe rabbit not your thing. You right, it’s too lean and lacks fat. Eat too much rabbit and nothing else and you’ll starve your body of fat. So how about goat? You want to be the GOAT, don’t you? Reddit’s even got a badge for it. If you want to be the Goat, guess what you gotta do? That’s fucking right, you are what you eat and here I am, your fucking pusher man for goat.
You're fancy and trying to be boujee. Let me guess: lamb? Say less, I got you that bonjour hon hon hon rack of of lamb chops. Want a quarter of lamb? Got that too. All you gotta do is ask.
I'm not going to really keep going down the list. You get the idea. I work at a fucking meat shop, I'm going to sell meat. I sell wholesale to restaurants and retail to walk-in folks. It's a pretty simple fucking concept. Is our meat fresh? As fresh as, if not more so, than any large chain due to constant turn over on wholesale side.
Why are our prices so low? Because we're a small mom-and-pop brick and mortar shop. We're located in Chinatown. Ever heard of FUBU? Same concept: we're built by Chinese immigrants, for Chinese immigrants. Unfortunately, the Chinese population in NYC is one of, if not THE poorest communities we have. Raising prices will price out the community and jack the reason why we're even here: to feed the community. This also means that our margins are fucked, but we're making it work. Yes, we look janky asf. I know, we're not "modern" and our aesthetic looks like some tossed together shit from the 60's. Shit, our band saw is from the 80's. But we're clean, we're sanitary, we pass all health standards and inspections, and we're doing our fucking best. We're literally the definition of "no frills." To hear some say it, we'd be considered ghetto. I prefer the term resourceful, so fuck you.

Cheap Meat Guy Scammed the Fuck Out Ya'll
Title says it all.
TL;DR: if you the free food and meals provided by the city conflict with your diet, etc, send me a PM with the title Groceries, \insert borough, insert neighborhood\** and I’ll hook you up with some meat.
Context, second post: https://www.reddit.com/nyc/comments/hvxiku/cheap_meat/?utm_source=share&utm_medium=ios_app&utm_name=iossmf
I, Cheap Meat Guy, scammed the fuck out you all. I have hoodwinked a great many of you, in a slightly more elaborate and grandiose "Let me hold a dollar" or the "You listen to music?" scheme. I appreciate my vacation, paid for courtesy of ya'll. I am currently in Mar del Plata, Argentina, enjoying my delicious alcoholic beverages and tiny little triangle cut Ojo de Bife sandwiches. I am in nothing but a bright neon yellow 3M reflective speedo with a 24k gold chain around my neck. Bruno Mars’ 24K Magic and Finesse are playing in the background and I am fucking feeling myself. I have never felt more opulent or lavish. 2020 has been a rough year. I deserve this.
So no fucking shit, obviously I didn't scam you all. Many of ya'll have seen my face. I'm not trying to get caught slacking one day and get hit with a "Yo, you cheap meats?" and get rocked by fifteen people wielding massive frozen pork chops and Iberian hams, followed by me on the floor looking real bad, only to eat a bunch of fucking Timbs. But I just wanted to announce something. Also: my fault for not responding to all the messages and comments and shit; I’ve been working around the clock and getting fucking spanked by the work load. Being the only person who has some type of command of the English language means, you guessed it, I’m doing all the shit that’s in English. All the shit that’s done with computers. Working the floor, cutting the meat, prepping the orders, moving all the damn boxes. You see the dudes pushing handtrucks in Chinatown with boxes of shit on it? Come to Chinatown early enough and you’ll catch me being one of those dudes. See that ugly ass truck on google maps when you look us up? Come early enough and you’ll see me loading that truck. I’m more stressed than Ted Cruz trying to mack on a pornstar over twitter, gaining a fuck ton of weight cause I’m drinking and eating like shit, and just over all a piece of shit. My b.
Here's the run down:
First off, on the real, what the fuck. Second of all, what, and I can't stress this enough, the absolute fuck. All you salty shits raised some serious fucking bank. My phone went off often and frequently enough the first few days from Venmo notifications that if I wanted to, I could have used it as a damn vibrator on my balls. For OPSEC, I’m not going to disclose exactly how much was Venmo’d, but just know that for a minute I felt like I would be able to treat myself to some Starbucks while Tyga’s Rack City played in the background, so you know that’s money. But all you fuckers Venmo'd me bank WITHOUT KNOWING WHO THE FUCK I AM OR BUYING ANYTHING, which blows my mind*.* Me, some random guy who curses a lot and talks shit like I'm a 6'17" guy who wears cooked to hell black high top AF1's and got two pistols by my side. Some of ya'll have met and seen me and know for a fact that I am most definitely not 6' fucking anything. Makes me feel as though I should start an OnlyFan's or Premium Snapchat. But seriously, what the fuck. For those that are willing to do the math, it was over twenty million Schrute Bucks.
There were a couple donations that stated they were there to keep the business open, to be shared among the employees, or for me to treat myself. An executive decision was made: every single dollar that we received (aside from those that were used for retail purchases) will be spent on those that need aid the most. While we as a business are hurting, there are still those that are less fortunate than us.
First and foremost, the City has done an amazing job in providing for folks. If you’re hurting and straight broke with no cultural, dietary, or any other limitations/restrictions, peep these sites for food security:
https://dsny.maps.arcgis.com/apps/webappvieweindex.html?id=35901167a9d84fb0a2e0672d344f176f
https://www.google.com/maps/d0/viewer?mid=1uVjjVxXfLFU4R6V7qjXXRoxCy-IwfMSP&ll=40.711199875063635%2C-73.99326878216021&z=15
Shits is free. No questions asked, take as much as you want. If you broke and you not taking advantage of this, you got some problems my guy. Extreme intelligence not being one of them.
Having said the above, I’ve tried the meals myself and I believe they are not as culturally sensitive as they should be in a city that is as culturally and ethnically diverse as we are, and particularly suck ass if you’re lactose intolerant, as most Asian seniors are. Shitting your brains out at any age is not pleasant, and I’m going to assume that doing so when you’re 70-plus with a weak pelvic floor is doubly more so. I'm currently working with a few local organizations that cater specifically to seniors within the Asian community (26% of the Asian community in NYC live at or below the poverty level, with the percentage being higher when we focus on seniors) who provide either free meals, groceries, or both for them. I think having the option to cook their own meals provides them with some semblance of normalcy, independence, and most of all, dignity.
So on some real shit: thank you all. A lot of the funds have already been used, but because the funds were raised from Reddit, I believe it's only fair that I give back to the reddit community, so I saved some with this in mind specifically.
I am aiming to provide 70 households from Reddit within NYC with the options of:
  1. Ten lbs of drumsticks
  2. Eight lbs of quarter chicken legs or
  3. Six and a half lbs of drum sticks with a dozen eggs
However, because we’re already understaffed and over worked, it’s not entirely feasible for us to pack/deliver the groceries on our own. I’m also not going to have folks come pick up and congregate at the business due to lack of physical space. I also know for a fact, as per Murphy’s Law, that if I had you guys come and pick it up, there’s going to be some dick head buying a bunch of shit and about to pay, pulls out a stack of hundreds or something, and when I hand over a bag of groceries without asking for payment, said dickhead with the racks are going to ask me about it and then demand that I comp their shit. I’m not trying to do or go through all that. So I’m asking that a couple of Redditors with the means come and pick up the bulk orders, however many of which type that will be, and prepare and segregate the orders off premise. Logistically, this means:
- Someone with a vehicle to accommodate and transport
- A clean space/location to prepare these orders, ideally commercial - Folks who have a food handling certificate to prepare the orders - Someone/s with a vehicle to accommodate and deliver the orders to whoever needs them
Did I just ask for free labor? Yes, I did. Because choosingbeggars. But yo, the fucking groceries are for free. I’m trying to give back to Redditors in NYC and I’m hoping that some folks will step up and do the thing Zhu Li. Like I said, we’re a little pressed on personnel. Given that we’re still dealing with Rona, those that are willing to help out with this task will be given face masks.
So what’s the criteria for you to receive these groceries? Someone that is sensitive or unable to consume the free food provided by the city, whether it be conflicting with them culturally/religiously/whereverthefuckly. I know families with kids currently enrolled in NYC Public schools get $420/child in assistance via P-EBT, but if that’s not enough, I’m your guy. Also, if you have a child enrolled in public school and you don’t know what I’m talking about with the $420, I highly suggest you sign the fuck up for P-EBT:
https://otda.ny.gov/SNAP-COVID-19/Frequently-Asked-Questions-Pandemic-EBT.asp
However, the ideal candidate would be someone or a family/household that don’t qualify for any or limited assistance. The elderly come to mind, where many rely solely on their social security to get by, as well as immigrants who don’t speak English and rely on their children to translate shit for them and don't qual for benefits, or immigrants who don’t have children and are just hustling like fuck to make it happen on their own. I’m mostly thinking of communities historically disenfranchised, but it’s really a free for all. At the end of the day, this shit is honor code, so no one is going to check your finances. If you decided to be a dickhead and finesse this, it’s on you to explain to your maker why you literally took food out the hands of those who are less fortunate. I will also hope you get drop kicked in the kidneys by a Kangaroo spontaneously the one time you decide to hang out in Central Park. And that at some point, you fall asleep on the MTA and some hobo jerks off and nuts on you, catching you square on the forehead. Better yet, I hope it happens on your morning commute to work, on a Monday, so your whole week fucked. Take a power nap at 0830 in the morning, wake up at 0834 cause a bum busted on your forehead, slightly to the left and right above your eyebrow so it drips onto your eyelashes and grazes your lips as it drips down. The day ain’t even start yet and it’s already fucked up and completely gone, and now you got a bum bump developing for the rest of the week. All that for ten pounds of chicken drums. Talk about a shit ROI. wallstreebets anyone?
I digress.
If you trying to get the groceries, send me a PM with the title Groceries, option, \insert borough, insert neighborhood\**
If you’re a MVP and trying to help me out with the pick up, splitting and bagging, delivering, etc, PM with the title Grocery Help, DriveLocation/Food handling (choose whatever role you can fulfill)
I would like to continue being able to do this, so shameless plug: our venmo is still the same and hasn’t changed u/FourSevenDivisionStreetTrading.
Oh! And we started an IG acc! Again, shameless plug: 47_division_st_trading_inc
So yea, that’s about it ya’ll.
Keep it real, be good to each other, be nice to your parents, your neighbors, give you pets extra scritches, and most of all, be kind to yourself if you going through it, cause for real, 2020 is really blowing ours.

Free Groceries for Those in Need
Context: Initial post that was fueled by scotch and sleep deprivation New post that isn't fueled as much with scotch and sleep deprivation as the previous, so should be a bit more coherent and easier to understand.
No TL;DR cause fuck you. I'm giving out free fucking groceries. Read the fucking post.
I put up a post and surprisingly didn't receive any PMs requesting groceries, so here I am again.
I am aiming to provide 70 households from Reddit within NYC with the options of:
A) Ten lbs. of drumsticks B) Eight lbs. of quarter chicken legs or C) Six and a half lbs. of drum sticks with a dozen eggs
Ideal candidates are those that are unable to eat the free food provided by the city due to food sensitivity, conflicts of religion, culture, health reasons, etc.1 This is aimed to help those that are seriously in need of assistance, with a heavy preference given to the elderly, young students, immigrants, folks that don't quality for any or limited assistance, etc. Communities that have historically been disfranchised, you get the idea. Families that have children enrolled in NYC public schools should be receiving $420/child/month for food2. If the aid is still not enough, I'm your guy. While this is geared towards Redditors, if you know someone that isn't on Reddit but is also really struggling, shoot me a PM with their info. This is going by honor code for everyone, so square up with your maker on your own time.
If you're trying to get groceries, send me a PM with the title "Groceries, insert borough, insert neighborhood, insert which option"
In order for this to work, I'm going to ask for some assistance from the Reddit community. Due to the limited space of our shop, I am not going to have folks congregate at the business trying to pick up their orders. That being said, I need a couple of Redditors with the means come and pick up the bulk orders, however many of which type that will be, and prepare and segregate the orders off premise. Logistically, this means:
- Someone/s with a vehicle to accommodate and transport o 700lbs of drums, or o 560lbs of quarter chicken legs, or o 455lbs of drums and 70 dozen eggs, or o Most likely some combination of all three - A clean space/location to prepare these orders, ideally commercial - Folks who have a food handling certificate to prepare the orders - Someone/s with a vehicle to accommodate and deliver the orders to whoever needs them
I am asking for volunteers and free labor because I'm broke as shit and I'm unable to make this happen on my own, within my own means, otherwise I wouldn't be asking for assistance in the first place. Volunteers will be provided face masks.
If you’re a MVP and trying to help me out with the pick up, splitting and bagging, delivering, etc., PM with the title Grocery Help, DriveLocation/Food handling (choose whatever role you can fulfill)
I would like to continue being able to do this, so shameless plug: our Venmo is still the same and hasn’t changed @ FourSevenDivisionStreetTrading.
We also now have an IG: 47_Division_Street_Trading_Inc

For those that give a shit: decided to write this a bit more carefully and not off the cuff as I'm apparently known for because I think it helps to not distract from the actual content. Also cause couple of commenters called me a meth head due to the way I write, which I can't have cause I'm still in the military. Would love to meet privately with said commenters though.

Training

I (38F) was not actually training for this race. I have done 3 half marathons in the last 2.5 years. Following a cardiac ablation for AVNRT in 2020, I was finally able to actually run (previously had tried and failed many times over the years, due to getting dizzy, etc., before being diagnosed with AVNRT). Started the Couch to 5K in August 2020, then 5K to 10K (1:04 10K in Jan. 2021), then did my first half in April of 2021 in 2:39:38 (with an average HR of 178). After that, things started to get worse again, and I started running less. I managed another half in September 2021 in 2:56, then started some new medications which messed me up even more, and stopped running entirely for about the first half of 2022. I found out I had a B12 deficiency, started supplementing and running again in June 2022, but much slower than before because my HR was still staying very high (160s at a 14 minute pace, 190s for 12 min, etc). I pushed through anyway and kept running but getting slower, then ended up with peroneal tendonitis in September. Recovered from that for a little bit more training before my 3rd half in November (3:09). I had signed up for the Shamrock full, but feeling disheartened after the November half, decided to drop down to the half. Saw my doc again, did more testing, and started a new heart medication for IST in mid-January.
After starting the new medication, things changed drastically. My HR now hovers in the 140s for what is now an easy 12:30 pace, where before, as I said, a 14 minute pace was putting me in the 160s - now I can run a 10:30 pace before hitting the 160s. Literally life changing. I decided to start a new training plan, for a theoretical April 30th half (I'm not signed up for a race around then, will likely just do it on my own), even though I had Shamrock planned for this weekend. My goal for Shamrock was just to finish, as I'm only halfway through the current plan (I'm using a Garmin Coach Greg McMillan plan), and hadn't run anything longer than 8 miles in the last several months. I was scheduled for a 2 hour easy run, which includes a warm-up and cooldown, so the plan was just to get through that, then walk the rest if I needed to. With my previous easy run pacing, I figured that would get me about 10 miles, then walk the remaining 5K, so an expected finish around 3 hours.
Another note - despite the amazing change from the heart medication, I think I may have also been suffering from RED-S. I don't know how else to explain getting slower and slower like I was. My HR was always on the high end before, but suddenly it was even higher than ever at a slower pace. To combat that, I've been trying to eat more, and eat more frequently. I have ADHD, and one of the biggest issues for me is remembering to eat when I get busy with something, so this has been a huge struggle, but something running has made abundantly clear I need to work on.

Pre-race

Whew, okay, now that that's all out of the way. As I said, my goal was just to finish, but I also didn't want to feel awful like I did in the last half, and I really wanted to beat that time even if I had to walk a lot. Starting on Thursday, I made sure to eat more snacks during the day, to make sure I was properly fueled. Friday wasn't as good, but still probably enough. On Saturday, I woke up early to prepare for the even earlier Sunday, and had oat bran at about 6am, followed by eggs, toast, and half an avocado at 8am, then a kale smoothie at about 10:30 (from Run Fast Eat Slow). Ran some errands and picked up my packet, then had a tuna sandwich for lunch around 2. My husband and I have been on a Great British Baking Show kick, so I decided to do some baking, and spent the next several hours making some recipes from Run Fast Eat Slow, and a lemon meringue roulade (Mary Berry's recipe, and OMG IT WAS SO GOOD). I was probably on my feet more than I should have been for the day before a half, but oh well. Snacked a bit here and there as I cooked. Finally around 7 we made some pear and goat cheese crostinis and ate those while dinner (feta and spinach stuffed chicken, and roasted red potatoes and zucchini) cooked. Had dinner around 8:30, a big slice of the roulade around 9, then went to bed at about 10pm.
Sunday morning, I woke up at 5am and had a big serving of homemade granola and greek yogurt (my usual breakfast, but heavier on the granola), a decaf coffee (between the heart meds, the ADHD meds, and planning to get pregnant soon, I figured I should cut out the caffeine), and another kale smoothie, then got ready to go. Got to the race in time to use the bathroom one last time. I brought 4 Huma gels with me (Huma seems to be the only one that doesn't upset my stomach), and took one about 15 minutes before starting. I accidentally ended up in Corral 10 instead of 9, so started the race I think around 7:42am.

Race

The morning started off cold, cloudy, and windy. High 30s, with fairly steady 20mph southward winds, and the race started off going north, so the first few miles we were running into the wind. Miles 1-3 sucked, but I managed to stay within the easy pace range according to my watch (if you don't use one of the Garmin plans, it gives you a range to stay within, and beeps at you if you go above or below, which is super handy), so I felt good about it. Around mile 3, all I could think was, "you just have to finish." Finally, we rounded the first bend toward First Landing State Park, and the trees blocked the wind, so I took off my jacket. I walked a bit for my first Huma gel and some water at about 3.4 miles. Things got better from there, the sun came out, and running surrounded by trees was really very pleasant. A bald eagle flew over the course, to everyone's delight.
Around mile 6.5, I walked briefly for my 2nd gel and water, and then really hit my stride, such that my Garmin was constantly telling me I was going too fast. Because I had only planned to run the first 10 miles, I figured I had at least 3 more in me, so I ignored it and kept going. Miles 7-9 were amazing with the wind now at my back, and I felt great! Took another gel at about 9.5. My 2 hour easy run ended shortly after that, and Garmin told me to cool down, but I still felt good, so just kept going. It was about this point I did some quick mental math, and realized that I might manage 2:45 or faster, if I could just keep running. So I did. My legs finally started to feel tired around 11.5, but my lungs felt good, my HR was only in the 150s, and I felt strong other than the tired legs, so I kept pushing. I passed the 2:45 pacer. At about 12 miles, I realized I could maaaaaaybe PR, if I didn't slow down too much.
For the last mile, I just kept thinking "you can do this, you can do this, you can PR, just keep moving." My legs were sooooo tired, but I kept moving them. I upped my cadence to around 180, because the shorter steps felt better, even though I'm usually more comfortable at 170. We came around the final turn onto the boardwalk, and I saw the finish line flags. At this point the half and full courses met up again (full split off shortly before that, kept going south, then turned around and came back), and I realized there were marathoners running next to me, albeit going literally twice as fast. For some reason, that energized me, and I pushed as hard as I could for the last stretch. I saw my husband looking for me right before the finish line and called out so he'd see me, then ran through the finish, in 2:38:13, a PR of 1:25 better than my first half. Average HR of 148, high of 160.

Post-race

Had some snacks from the race, then went home and had more snacks, a bath, and a nap. Ate a big lunch, did some stuff around the yard, then a relaxed evening. Got a somewhat frustrating night of sleep as my legs were pretty sore, but just muscle sore. So far, I'm pretty sure I didn't injure myself.
I'm tired today, but I feel so incredibly amazed at how much of a difference I felt between this race and the last 3. I don't know how much of it was the fueling vs. the heart medication, but either way, it feels SO GOOD to know I can run again, and to know that I can actually make real goals now. I was feeling so disheartened by the last year and a half of things getting harder and harder, and now they're getting so much easier again. I will unfortunately have to go off the heart meds later this year when we try for a baby, because it's not safe during pregnancy, but I am extremely hopeful that I can gain enough of a solid base to be okay without it (I'm told that it can have permanent effects). Either way, I'm going to continue trying to eat better, because I do think that was a large part of it. I can't say for sure I had RED-S, because I'm not underweight and I've never intentionally tried to restrict my calories a lot, but because I do forget to eat, I probably did.
I'm going to keep working through my current training plan, and run the planned half at the end of April along my usual route. My goal is 2:22, and Garmin thinks I can do it. We'll see. From there, I would still really like to do a full, but we'll see how the summer goes. For now, I'm just going to keep working on my base and trying to get faster.

2023.03.20 14:57 AlarmEquivalent6089 I got into an emotional power struggle with my mom over a yes or no question regarding my grandmother's plans, and setting boundaries has been draining.

Last weekend I was on the phone with her, the same phone call when she brought up the topic of my grandmother who was returning to her home country (Taiwan) this month. It was the fourth time we had talked about it, including when she asked my dad the first weekend of March. In February I had told my mom that my grandma would be returning in March when she asked when my grandma would be returning, so in March my mom switched to a yes or no question: Has she returned?
My parents are divorced for over 20 years. My mom and grandma have been estranged and have neither talked nor seen each other in 15 years. During the phone call I suggested to my mom that I could give her my grandma's home phone number in Taiwan and she could call her, which my mom determined to be sarcastic. I told her that I had informed her of this matter and did not want to repeat what my dad said. I did say I was not a part of my grandma's plans in any way. She shot back that there are 31 days in March; my grandmother could be returning any day of the month, so I questioned if that was important to her. My mom accused me and my dad's side of the family for being secretive, mysterious, and defensive for refusing to answer a random yes or no question and questioned if this was our "family culture." According to her, she did not intend to probe but only to ask. I asked her why she asked my dad and then me the same question. She retorted that it was one thing to ask him and another to ask me. Not long after, she hung up the call because she got upset over my hurtful suggestion.
40 minutes later I texted her to apologize for my inappropriate remark, that I used poor communication skills that rubbed her the wrong way and that I just wanted to close past chapters. I understood why she was upset and concluded by hoping that we had reached a sense of closure.
A few days later my mom texted back starting with "Now you decided to inform me that you wanted to close chapters..." The gist of it all was that it would've been better had I informed her earlier instead of shutting her down, making that hurtful and what she deemed to be a sarcastic suggestion, and refusing to answer a simple yes or no question. She concluded by reminding me that she was always there for me when I wanted to talk about my feelings and share my issues with her.
Thanks to the support that I have gotten from Redditors about not being the man in the middle, not getting involved in a conversation between two adults, I now have had the opportunity to set boundaries with my mom. I sent back a long text, starting with "I understand where you are coming from with yes or no questions...close ended questions are not probing questions. I just do not want to get involved in a family dynamic involving two or more people....nor do I want to be involved in a 3 way conversation meant for two people." I went on to say that theoretically speaking, if I have a question regarding somebody, I go to that person. I understood that this was not possible due to family estrangement, so I offered some future scenarios where I, taking into account my sarcastic remark, would say things like "I am not going to answer for other people in my family, please do not direct this question to me, if possible, please direct it to the person you are asking about, I do not want to get involved." Essentially I did not want to answer for or speak on behalf of my family members, and I stated that I have no control over whom she reaches out to, what questions she asks, what answers she gets. I could take generic questions about how my family is doing, all other questions are redirected. And if anyone reaches out to me on behalf of someone else I would not respond. Text, meet, call, I arrange this kind of thing directly.
Five days later my mom began her reply with a question: "I did not ask to be a messenger between parties or engage you in 3 way conversation did I? In fact I was the one who advised you not to do that and draw the line remember? I hope you can see the differences in these situations." She went on to state that any genuine question or comment could be read negatively if the receiver is guarded or has little trust. She would not bring up anything related to my family members in the future if doing so made me sensitive, and that my dad isn't always honest, so what's the point? She reminded me that my sarcastic response could damage a relationship and that my way of communication to my mom was not acceptable, but my apology was accepted this time. My explanation could have come first! She also reminded me to work on my communication skills."
I took mental notes as I was reading this response and it felt like an emotional power struggle. She misdirects the mistrust between her and my family members onto me. In doing so she used my guilt as a weapon, then projected everything back onto me and my dad's side of the family. Not discrediting what she said about my dad, but if any family is divorced for 20 years, they have no ties whatsoever. Sure my grandmother lived with me for a period of time and she is more than welcome to ask how she is doing, but I do not have to continue answer for her plans in any way. Furthermore she believes she is entitled to set boundaries for me...all while I was trying to take a stand and say no!
Thoughts on this situation? Someone recommended to me that I should not reply to her any further, because then I would be feeding her manipulation tactics. I was definitely tempted to reply back with something like "I am not here to attack or take sides with anybody. It is well within my right to not speak on behalf of another adult..I have no control over the mistrust, how my dad answers you, and how you feel..." Now I recognize it would be draining and pointless.
Prior to her latest reply I shared my situation with a colleague and even she believes I do not have to be the "monkey in the middle" if my family is divorced and estranged. It seems that the vast majority believes this. I just find it so draining to engage with my mom. My healthy boundaries are perceived with contempt and are then met by her toxic boundaries. I am reaching out to ask for advice. I have gotten to a point where I am wondering if, a few years from now, I should cut off contact with her.
I am 23, technically I can go no contact but I want to continue to set healthy boundaries with her. In the past I have been on good terms with her because she paid for my college tuition and had partial custody of me. I also ran away from my problems before and had moments where I just did not want to engage with people. Now I realize if I continue to run away, then I am not truly growing. So I want to give myself this opportunity. Preferably I want to use grey rocking, it's just harder to do it over the phone than over text.

2023.03.20 14:55 AlarmEquivalent6089 I got into an emotional power struggle with my mom over a yes or no question regarding my grandmother's plans, and setting boundaries has been draining.

2023.03.20 14:48 Smart_Number2741 5 Year old son is acting out at school only on the days his dad drops off/picks up

My son started kindergarten this year, and has struggled with behavior and making friends. We have gotten him on an IEP and he is getting the support he needs day to day in class, he is actually starting to excel!
His father and I have a 2-2-5-5 schedule and share 50/50 custody.
His dad will frequently tell me he had to get onto our son because he threw a fit in the grocery store, or at his parents house on a visit for not getting his way.
Unfortunately because of our work schedules, son has to be in a before and after care program.
On days I am dropping him off, he gets up around 6, we leave my house at 6:30, and is dropped off around 7. On the days he is returning to my house, if I pick up, I get him at ~5:45 and we get home about 6:15.... I live 25 miles from his school and work 45 miles from his school. He attends school in the district his dad lives in because it is better than where I live.
There are days where my fiance will pick him up as early as 4, but it depends on where he is working if it makes sense for him to get him, or go home and start dinner... And son has expressed that he wants to stay longer if we get him any earlier than that.
When his dad is dropping off, Son is being woken up at 5 am, dropped off at 6 (its a 5 minute drive from his dads house to his school), and the time he picks up varies from 5-right at 6 pm when the center closes.
At the start of the school year and when we first signed him up for the school in this district and begore and after care program, his dad was going to be working 6:30-2:45, and the plan was he would pick him up most days around 4-4:30 and drop him off to me at a halfway point or I would come to his house and get him so he wasn't spending 12 hours at school everyday... as I had accepted a job 40 miles away from sons school.... then he changed jobs without telling me.
There is alot of underlying things with this situation, but its been months of different behaviors in different settings at school, and they have all correlated with his dads days. The last 3 weeks, Son has had a particularly hard time at the before and after care only on the days that his dad is picking him up or dropping him off at school. These are not small behaviors, he has thrown chairs, scissors, tried to leave the school, hid from the program teachers, cleared desks and tried to rip things off the wall.
There was 1 day in those weeks that he acted out, and when he saw me, he goes "I thought daddy was getting me today"...
At home if I ask him to not jump on the couch, or to "clean his room" (consists of putting toys away, making his bed.. which is just him throwing his blankets back, and bringing down his small clothes basket downstairs) he says "daddy doesn't make me do that" or "I wouldn't be in trouble at daddys".
When I have talked to his dad about the behavior stuff at home he says "He's still young for that" or "I don't care if he does that here, that's your problem".
I have expressed concern over the amount of time he is at school, his dads outlook is "Other kids do that, hes gotta get used to it".
I am almost at my wits end. The kid that the after care program and the school has described doesn't sound like my sweet empathetic, funny, happy little boy.
He is capable of so much more than what his dad gives him credit for. Its like his dad heard the school say he has behavioral problems and just gave up on parenting him or pushing him to do better.
Between all this stuff with the school, and historical stuff where his dad has introduced him to 3 different romantic partners in 2 years one of which had kids that son got attached to, and son coming home and asking me why daddy was punching the wall.. I am so close to going for more custody once I have a different job that would allow me to pick him up and drop him off in a schedule that makes sense for him!
Is that awful??? Am I being selfish and taking the easy way out?

2023.03.20 14:46 AlarmEquivalent6089 I have gotten into an emotional power struggle with my mom over a yes or no question regarding my grandmother's plans, and setting boundaries has been draining.

Netlist, Inc. (OTCMKTS: NLST) Major Runner as Patent Player Set to Start Jury Trials in Texas on April 17 with Final Pretrial Conference Set for March 27

ByBoe RimesMarch 19, 2023 01028📷
Netlist, Inc. (OTCMKTS: NLST) continues to rocket northbound with power as we get closer to jury trial in Texas against Samsung starting in April. NLST has quickly emerged as the number one most traded stock on the otc bulletin boards with dollar volume topping $3.5 million on a slow day on Friday. Just 2 years ago NLST was the darling of small caps rocketing over $10 per share, now after dipping below $1 in December, NLST is once again red hot with huge buying and little selling the stock hit highs near $4 earlier this month. After some consolidation NLST Is once again moving northbound with power; a break over $4 and NLST really takes off. NLST does not dilute, and the stock has virtually the same share structure as it did in 2021.
This is a really exciting time for Netlist as the jury trial in Texas against Samsung starts on April 17 with a final pretrial conference set for March 27. The trial is expected to last about a week. Netlist CEO CK Hong recently said: “We’ve invested extensively over the years in the IP enforcement process and look forward to seeing the fruits of our labor and the validation of our intellectual property in the coming months. As the Company’s revenues continue to grow recently topping $161 million in 2022, Netlist continues to WIN in court. The upside is enormous as the aggregate of the multiple infringement lawsuits Netlist is pursuing against Samsung, Micron and Google both in the US and in Germany could very well yield significant settlements and we could see multiple resolutions in 2023. Much more on the upcoming court dates below. We will be updating on NLST when more details emerge so make sure you are subscribed to newsytrends.com by entering your email below.

Netlist recently reported Q4 and full year 2022 financial results. Revenues in Q4, 2022 fell compared to Q4 2021 however for the full year the Company saw growth reporting revenues of $161.6 million in 2022, compared to revenues of $102.4 million for the full year ended January 1, 2022. Net loss for the full year ended December 31, 2022, was ($33.4) million, or ($0.14) per share, compared to a net income in the prior year period of $4.8 million, or $0.02 per share.
📷As Netlist product sales continue to grow, the other more exciting part of the Company’s business is its patent infringement lawsuits against Samsung, Micron, Google and others such as Monolithic Power Systems Inc. The financial prospects of Netlist patent infringement lawsuits are significant. Some of the biggest in history are Intel vs VLSI Technology (2021) – $2.18 Billion and Pfizer vs Teva Pharmaceuticals (TEVA) & Sun Pharma (2013) – $2.15B. In June 2020 in a landmark case for the Company, Netlist was victorious in a 12-year battle in the patent courts against Google. A 3-judge panel at the US court of appeals, in a unanimous rule 36 decision, upheld the decision of the lower court and found in favor of Netlist. Google “Waived” their appeal rights to SCOTUS and the 912 patent was reissued with 78 claims upheld.
Following that, Netlist won against SK Hynix in a deal that included a $40 million signing bonus, a $600 million dollar supply agreement at advantageous terms, a patent sharing agreement that gives netlist access to Hynix portfolio of 5000 patents free of charge, and now Hynix is Netlists partner. Also, Netlist won an important court decision in their favor in the Google case however as Samsung had supplied the patent-infringing memory modules to Google, the Judge decided things could wait while the court in the Netlist-Samsung case decided if Samsung had violated Netlist’s patent. More recently Samsung filed an amended complaint against Netlist which was dismissed and as the Company stated: “The partial dismissal means Samsung cannot pursue a separate action on the patents Netlist first asserted in Texas, and now cannot carry out its alleged obligation to protect Google from the ‘912 Patent in Delaware.”

During the conference call on February 21 Netlist CEO CK Hong talked extensively on the Company’s lawsuits stating:
📷“Netlist made significant progress in 2022 with its Global IP Enforcement campaign. Our continuing goal is to ensure our innovations are secured by high quality patents and that those patents are being fairly licensed by marketplace implementers…In Netlist’s action against Samsung in the Eastern District of Texas, there were a number of favorable developments in 2022 and now in 2023, we approach the culmination of this case in the form of a jury trial. As a reminder, this case addresses Samsung’s infringement of six Netlist patents covering LRDM, DDR5, and high bandwidth memory, or HBM. In December, the court issued a claim construction order, largely adopting Netlist’s position for many of the claim terms at issue, creating the basis for establishing Samsung’s infringement. More recently, Judge Gilstrap rejected Samsung’s second motion to stay the case and allowed Netlist’s request for additional deposition, testimony and fact discovery. This case has now proceeded into the conclusion of the expert discovery phase with a final pretrial conference set to start for March 27. The jury trial was moved up two weeks to accommodate the court’s schedule and is set to begin April 17. We expect the jury trial to last approximately one week. Judge Gilstrap is also presiding over Netlist’s case against Micron for infringement of the same six patents. Claim construction is scheduled for that case for July 2023. The jury trial is scheduled for January 2024. There’s a second set of cases against Samsung and Micron in the Eastern District of Texas. Judge Gilstrap consolidated these cases because each involves a 912 patent. The 912 patent and related child patents, claim constructions for that consolidated case is set for October, and a trial date for both is set for April 15, 2024. Mr. Hong noted that Netlist’s case against Google in the Northern District of California remains stayed pending the outcome of the second Eastern District Texas case against Samsung. The Netlist case against Micron in the Western District of Texas remains stayed pending the resolution of the four remaining IPRs Micron filed against Netlist patents, but will eventually proceed to a jury trial given the PTAB’s denial of institution on Micron’s IPR petition against the 608 patent. On October 2020 Netlist will have a claim construction hearing and the declaratory action that Samsung brought against it in Delaware. The jury trial for this case has been scheduled for 2025 and now includes Google as a party to the proceedings. The cases in Germany against Google, Samsung and Micron are also moving ahead as expected. Final one day oral hearings are set for upcoming May 3 for Micron, September 5 for Samsung and October 9 for Google, all in Dusseldorf….We view Samsung’s latest attempt to invalidate an important 912 claim on Google’s behalf as an abuse of the IPR process. In the past several months, I’ve written a couple of articles in the industry publications about our thoughts on the detrimental effects of IPR abuses on the patent system and the broader innovation economy. These are available on the company’s website. We’ve also visited with Congress in recent months in order to provide our input as they consider much needed legislative reforms on the current patent law. On January 5, 2023, USPTO Director, Kathi Vidal exercised her authority and brought Samsung’s 912 IPR proceedings under her review. Director Vidal cited the importance of the case to both the USPTO and the patent community, and deciding to take this under her personal review. She stayed the 912 IPR pending the outcome of her review, and on February 3, she entered a decision requiring the assigned PTAB board to reevaluate Netlist’s request for discovery on the admitted relationship between Samsung and Google. She also ordered that if the Board determines Google is a real party of interest under Samsung’s petition, the Board must vacate its institution decision and deny Samsung’s petition. We’re pleased that the Director Vidal elevated this request to her review and hope that the board will take a closer look at all the facts underpinning Samsung and Google’s relationship. In summary, we’ve invested extensively over the years in the IP enforcement process and look forward to seeing the fruits of our labor and the validation of our intellectual property in the coming months.”
