2023.05.29 03:33 hbydzy Some tour stats, plus a 2024 US tour?
The impetus for this post is seeing how successfully their recent US festival performances have been and guessing that Band-Maid has a high probability of being invited to US music festivals in 2024. If that happens, they would be stupid to say no. And if they say yes, then it would make sense to plan additional US shows around those festivals. We will then see more groans that “Band-Maid only cares about the US”—though they still could still tour
both Europe and the US next year.
I wanted to look at some touring statistics to explain why US tours are the most sensible option right now. I don’t make this case out of personal interest. Though I reside in the US, I’ve never seen them live—so if anything, I have the most vested interest in a European tour because Vladimir Chupin posts the best fancams! I just want to explain that there are sensible objective reasons to tour the US and to counter the completely baseless accusations that “Band-Maid only cares about the US.”
To make the case, I have collected the touring data from setlist.fm and YouTube-viewing analytics posted on another forum. The datasets are posted
here.
YouTube viewing metrics We have few methods of quantifying Band-Maid’s popularity, so I’m relying on global viewing statistics for Band-Maid’s YouTube channel, ranked by the top 75 major cities as of mid-May 2023, posted on another forum. Since I don’t know which analytics service was used, I can’t vouch for the methodology or level of accuracy. In the absence of alternatives, this is a good-enough gauge of popularity for current purposes.
Europe ranks lower than many other regions in terms of love for Band-Maid Here is a breakdown of the numbers of views, ranked in order of popularity:
Region | Views (based on top 75 major cities) |
Japan | 5.9M |
Asia (non-Japan) | 1.2M |
USA | 798.1K |
South America | 372.3K |
Europe | 356.5K |
Mexico | 288.2K |
Australia | 115.5K |
Canada | 47.8K |
Eighteen US cities appear in the top 75 list, compared to eight European cities. The three top viewing cities in the US alone account for more YouTube views (388.5K) than all eight European cities that appear in the Top 75 list combined (356.5K).
Mexico City alone accounted for more YouTube views (244K) than the three biggest European cities on the list combined (London, Moscow, and Paris, total 238.2K)
North America (1.1M) comes close to overseas Asia (1.2M) in terms of YouTube views, while Europe is outranked even by South America, which Band-Maid has never visited.
How viewing popularity compares to the number of shows performed If Band-Maid were to plan overseas tours solely based on YouTube popularity, they would prioritize S/SE Asia, then North America, and then South America, before visiting Europe. But what do the touring numbers say?
Put the US aside for a moment. Prior to COVID, Band-Maid’s most overseas shows had been in Europe, where they performed 16 times (12 one-man shows, 4 gigs at conventions).
Regions where they have performed infrequently, disproportionate to their popularity: - Asia (outside of Japan): 3 one-man shows and 4 festivals (despite 1.2M views)
- Mexico: 2 one-man shows, 1 TV appearance, and 1 upcoming show (despite 288.2K views)
Regions they have never performed in, compared to popularity: - South America: 372.3K views
- Australia: 115.5K views
- Canada: 47.8K views
Band-Maid overseas tours have historically favored Europe over all other regions From their first overseas show in 2016 to the start of pandemic lockdowns, European shows outnumbered all other overseas shows combined.
- Europe: 26 shows
- USA: 9 shows
- Asia: 9 shows
- Mexico: 2 shows (plus one TV appearance)
The US was late in the band’s consideration but proved a popular market The US is the newest region that Band-Maid has begun touring in. Putting aside early appearances at two conventions, Band-Maid did not include the US in its tours until 2018, two years after incorporating Europe, Asia, and Mexico in its tours.
Keep this in mind:
Before the pandemic, they had only conducted two US tours. Compare that to Europe, where they performed four tours over
five different visits to Europe (excluding four performances at two conventions).
And yet their US visits proved fruitful. In 2019, which was only their second US tour, they had
sold out all four scheduled shows. They added a fifth show which sold out as well. (I found a
comment by one poster that their 2018 Amsterdam show sold out, but could not find similar information about any of their other European shows.)
Band-Maid can now perform more shows in a single US tour than elsewhere To make overseas touring worthwhile, you want to cram in as many shows as possible and reach the largest audiences as possible.
It is only now, in 2023, that the number of US tours has matched the number of tours performed in Europe. However, the reason they have performed more
shows in these US tours is because there are now more venue opportunities in the US than in Europe.
Before the pandemic, their biggest overseas tour was either the 2018 European tour, where they performed six shows over nine days, or the 2016 European tour, where they performed seven shows over two separate visits to Europe in four weeks. They have never performed at a European music festival.
Compare that to the recent US visits:
- For their 2022 US tour, they performed 13 one-man shows (almost all sold out) and one festival in under three weeks.
- For the first part of their 2023 North American tour, they performed 7 one-man or headlining shows and two festivals in under two weeks.
- For the second part of their 2023 North American tour, they will perform 8 one-man shows plus Lollapalooza within two weeks.
It is highly unlikely they can match those numbers with any European tour, even if they perform at a European music festival, which hasn’t yet happened. Putting festival prospects aside, the next time they tour Europe, it will be because they
want to, and not because it is the most lucrative, the most logistically and financially sensible location, or the best way to reach untapped audiences. So European fans should be especially grateful when the band does return to Europe, rather than think, “It’s about time!”
What has Band-Maid said about the prospect of a European tour? Has the band really forgotten Europe? Numerous social media and forum comments have claimed that Band-Maid has “forgotten that Europe exists”—often in an insulting, pouty, or dramatic manner. But is that true? Here are some recent comments the band has made:
Sankei Sports (2023.02.23):
Saiki said, “We like to surprise our fans, so please look forward to it,” and Kobato said with a smile, “We want to do an EU tour, too.
Miku on TikTok live (2023.03.09):When Ohrenje commented, “I hope you come to Europe next year,” Miku replied:
Right, po, Europe, we’ve always been wanting to go there, po. Well, it’s pretty hard, yeah, we’ve been unable to go there because of the COVID pandemic … moreover this year is pretty hard schedule-wise because of our 10th anniversary, even though I wish we could go there, po. Like tours in the US and in Japan.
First of all, Japan … we haven’t been able to visit smaller cities in Japan, so we decided to go around there first, po.
Those of you from Europe, please wait for a while, po.
KissFM Kobe interview with Miku and Saiki (2023.04.20):
When asked which countries they wanted to visit again, Miku answered the Netherlands and Saiki answered Mexico. (The Mexico City show was announced a few days later, so Saiki must have known they were returning to Mexico).
This is not an exhaustive list of what the band has said about returning to Europe, just recent instances that I can recall. For good reasons, they never explicitly say they will perform somewhere until the deal is finalized and an official announcement is made.
Why the 2023 North American tour makes sense Many people have speculated why Band-Maid are performing in the US this year and not Europe. Many have suggested high costs of touring Europe, while others have countered that other Japanese bands are currently touring Europe. First, we shouldn’t lump all Japanese bands together. They have different priorities in terms of their popularity level, the amount of time they’ve been around, and their touring history, so they have different needs in terms of penetrating particular markets and other goals toward success and financial viability.
We don’t need to speculate much to see how sensible this year’s touring schedule has been. If we take Miku at her word (and the facts seem to support it), a primary objective for the band’s 10th anniversary was to hit smaller cities in Japan. For 2023, they have 28 live gigs in Japan, including their two largest shows ever. If we go by YouTube ratings (and no doubt sales), Japan still is their biggest market by a long shot, notwithstanding the common claims that they are more popular abroad (different metrics). It doesn’t make sense to abandon Japan in favor of Europe.
Next, they got the opportunity to perform at three different music festivals in the US, including the “legendary” Lollapalooza. This is a great opportunity to expand their audience in a way that one-man shows cannot achieve, so it would be stupid to decline. In order to make best use of their US visits, they need to plan a US tour around the festivals. Their deal with Live Nation makes it possible to play more shows than ever—certainly more shows than they have ever played in Europe. One festival is three months apart from the other two, which means they have to make two separate trips to the United States, but it also makes it possible for them to return to Mexico, which has a huge following. Their touring schedule is now packed: 49 shows, not including TV and online performances.
Should they have compromised this schedule and the chances of recouping their costs in order to play five or six shows for a smaller market in Europe—which they have historically shown the most favor to?
Who has the right to feel personally betrayed that Band-Maid has not performed in their region recently? Unless one of the band members is your wife or mother, no one.
The criticisms I see from
some European fans (
not everyone!) can approach unhealthy and parasocial—as in, “You’re not showing me love. Are we breaking up?” or “You’re spending more time with the US than with me.” No one should interpret a tour gig as a measure of a band’s personal love for you. Bands don’t decide which countries to tour simply on personal whims. (To take one amusing example, Billy Bob Thornton’s band toured Canada even though he
infamously derided his Canadian audience as “mashed potatoes without the gravy.”)
It hasn’t even been a year of touring yet! Finally—and this is very important to keep in mind—when they finish their 2023 US tour dates, they will still have only been performing overseas
for less than a year since pandemic restrictions were lifted. It’s unfair to say they haven’t played in Europe in four years without taking into account that they couldn’t play
anywhere in nearly three of those years because of a global pandemic.
They have done 46 shows in the US and Japan since last year. For 2023, they have 49 scheduled performances, including their two biggest one-man shows ever. If they had taken it easy and not done any overseas shows, they wouldn’t be receiving so much criticism from European fans. So in a way they’re being penalized for
working too hard, while being criticized for
not working hard enough since they didn’t cram Europe into their full schedule. (Some critics have remarked, “They have such-and-such dates free, why can’t they play in Europe then?”)
The fact is that Band-Maid has shown Europe more love than the numbers would merit. For the first time since they started touring overseas, they are making inroads in a region that isn’t Europe. The only way we can categorize their decision—made in conjunction with management and promoters—as foolhardy is to prioritize one’s personal feelings as a fan over the needs of the artists themselves to make an impact.
It will be great if they return to Europe in 2024, but if they are also given opportunities in the US in 2024, we shouldn’t attack them for it, and we certainly shouldn’t take it personally.

2023.05.29 03:13 tmux-vim Key fob problems
Hi, I am wondering if anyone has experienced similar problems:
Today, the key fob would not open the doors nor would it start the car once inside. I figured the battery was dead. No big deal. I plugged it into the key fob port in my vehicle and while the push to start button lit up, the car did not start and the "no key" light kept flashing on the dash.
Is the fob completely busted? This was very unexpected for me. I was guessing the key fob port uses RFID and if that isn't working something must be very, very wrong.
As a side note, the entire apparatus attached to the physical key (the metal one inside the fob) is destroyed so I can't attach the fob to my key chain. I lose it all the time. I also realized today that it's basically impossible to actually use that key without the plastic being attached.
I was thinking of buying this
(link to amazon) and trying to remove the original un-smithed key and replace it with mine but I don't know if I would have to break the plastic to do this. Could someone maybe check their key and see if it would be possible to do this?

2023.05.29 02:24 duckduckduck21 Whatever happened to the Paranoia PC game (Internet rabbit hole)
I was looking through my Steam wishlist today and came across Paranoia: Happiness is Mandatory which I've now had on my wishlist since 2020. In that time, I've watched the release date come and go, only to be replaced with "Coming Soon", and no one seemed to be able to find any information about it.
But today I came across a PC Gamer article from a year ago that I thought I'd share since I know the question has been asked a couple of times before on this sub. Enjoy!
https://www.pcgamer.com/court-documents-may-explain-the-disappearance-of-paranoia-happiness-is-mandatory/ [C&P below]
Two years ago, Orwellian sci-fi RPG
Paranoia: Happiness is Mandatory was removed from sale within weeks of its release. The reason for its delisting has remained a mystery, but a set of court documents unearthed by
Gamekult shed light on the situation.
The
court documents detail a complaint lodged by publisher Bigben Interactive, AKA Nacon, against Paranoia's rights-holders in October of 2021. Greg Costikyan and Eric Goldberg, two of the creators of the Paranoia tabletop RPG, are named in the complaint, which is apparently about a breach of a license agreement.
PC Gamer has obtained Costikyan and Goldberg's answer to the complaint and counterclaim of their own, which was filed in United States District Court in the Southern District of New York on March 11. According to this document, the trouble began when Bigben published a press release announcing a release date of September 10, 2019, without Costikyan and Goldberg's approval, and in spite of "their concern about advertising a potentially unrealistic release date".
The publisher then provided a pre-release master of the game for approval in which "software bugs and inconsistent/poor user experience issues" were responsible for "a product significantly below commercial standards" and, as they put it, "release of this version would tarnish the [Paranoia] brand."
While the publisher agreed the game wasn't ready yet, Bigben then announced a revised release date of November 14 via another press release issued without Costikyan and Goldberg's approval. A subsequent version of the game presented for their review in October was apparently still buggy enough that, at their request, the publisher provided "a new spreadsheet listing 74 combined major and minor bugs" that were known to remain.
Paranoia: Happiness is Mandatory was then released without the rights-holder's permission or even knowledge, exclusively on the Epic Games Store. On learning this, they wrote to Bigben demanding its removal multiple times, before going directly to Epic with a DMCA request. As a result, the game was withdrawn from sale on January 24, 2020.
The court case is ongoing, with the most recent document, which is from Friday, granting an extension.

2023.05.29 01:57 itsGreghere Thank you, and goodbye!
Proud former owners of a 2005 4Runner Limited V8, purchased to tow an old Airstream trailer we lived out of on the road for a year starting in 2019 (yes, weird times during the pandemic). We sold it last year with 275,000 miles and bought a new 2022 RAV4 Hybrid SE, wanting to stay in the Toyota family. We really wanted the XSE with a hitch and a couple technology options, but were told by our dealer that the high trims were impossible to get. After turning down lower spec options, 5 months was long enough to wait and we took the SE.
After 6 months, we were bummed with the first new car purchased both of us had ever made. The cloth seats were scratchy and clung to every dog hair, the infotainment felt the same as my 2009 Prius, and worst of all the MPG was a disappointing ~35 (mostly winter, mostly short trips in town).
We randomly stopped in to check out the Hyundai Ioniq 5 and ended up trading the RAV in for one the very next day. After incentives the Ioniq came out to the same $42,500 sale price that our RAV was (after $2,500 dealer markup and options) and they gave us almost MSRP on trade.
Sorry, not sorry. We fell out of love with Toyota and the Hyundai EV is in another league for the same money. All the best to you all! Find me at
Ioniq5 moving forward...

2023.05.29 01:34 Tranquilizing1 Input needed: Should I go for this 2019 Hyundai Elantra w/ 129k miles. for $12,394? (It was previously a company car)
Dealership has 2019 Hyundai Elantra for sale. sticker price is $12,394, 129k miles. It was previously a company car that looks to be consistently well maintained, according to the history report that the dealership provided. Clean title, no accidents/damage. They crunched the numbers for me and determined that my payments would be $250/mo for 60 mo (8.99% apr, most likely cause I'm a first time bar buyer, credit otherwise is decent). Affordability is a non issue; the payments fit well within my monthly budget. I'm also putting 3k down. Dealership said they just got the car in today and still need to inspect it and take car of any issues before they actually sell it. The main thing that concerns me is the mileage. Does this actually sound like a good deal or should I walk away since the milage is already pretty high? Are Hyundais able to last a long time, possibly to 200k miles?

| A YG Cintree finally popped up on Chrono24 and i jumped on it. Since I don’t have 500 words, here’s Hodinkee: With its elongated case and dial and its cabochon crown, the Cartier Tank Cintrée is among the most desirable of the vintage Tanks. It was first released in 1921, four years after Cartier designed the first Tank wristwatch for the American General John Pershing, in 1917. The original Tank delivered to Pershing, which went on to be known as the Tank Normale, was subsequently offered in just nine serially produced pieces in 1919. The Cintrée, which was the just the second Cartier Tank to come to market, was an evolution of the Tank Normale. As you can see in the pictures below, the original Cintrée was, as its name suggested, a curved, slimmed-down take of the Tank Normale, and a strong early indicator that the Tank would prove fertile ground for future Cartier design innovations. For a really in-depth dive into the Cartier archives, including a look at an original Cintrée, check out this HODINKEE story from two years ago. It bears mentioning that vintage executions of the Tank Cintrée were made in extremely limited numbers, and examples that remain in original condition come up for public sale very infrequently, making them virtually impossible to find. And when they do pop up, they command top dollar. This example in platinum with a matching platinum bracelet is a perfect example of what I'm talking about. submitted by HBC3 to Watches [link] [comments] |
2023.05.29 01:17 GuineaPigPrincess Mini Cooper 2018-2019 Used at Dealership Options/Advice
Hi from Canada.
I am trying to buy my very first Mini used from the dealership. I am looking for some advice on what a fair price might be for each or if one model is way better than the others.
The three different Mini dealerships I am looking at (all 3 door):
2018 Mini Cooper S, 37k km, $25,150
2019 Mini Cooper, 42k km, $25,500
2020 Mini Cooper, 64k km, $25,990
The 2018 model, the only Sport... however I would never use the sport function... is the only one without a backup camera. However, it is also the closest dealership to me.
The other 2 options are about 1.5h drive away, however, again these models have backup cameras. While this feature I would very much appreciate it is not necessarily a dealbreaker.
Also, does anyone know if any of the used vehicles for sale by the mini dealerships come with some sort of paid maintenance schedule?
Thank you for any and all advice.

2023.05.29 01:09 lumiesck I threw away all my merch, posters, etc
So… this has always been something I’ve had a hard time with and would like to get some insight. When I was 12 I discovered MCR- that was 19 years ago. My sister was 2 years younger than me and we both became obsessed with them. My youngest aunt who is just 10 years older than me introduced me at a younger age to her music- cradle of filth, smashing pumpkins, Alice In Chains, RHCP, evanescence, etc. I was already into all of that but when I discovered MCR, I felt like it was mine. like I had discovered something that was no one else’s and completely identified with their style, emotions, music, etc. We got the revenge CD and fell in love with every song, immediately we HAD to find out more about this band, so we went to Target and got the Bullets CD and fuck, that was even better. Went to our first concert in 2007, my mom was waiting for us in the car and their manager saw her, asked her ‘are you here for the concert?’ And she said ‘no I’m just waiting for my daughters’ she was wearing an MCR shirt and he said ‘do you wanna see the show?’ And of course she said yes, he weaseled her backstage, she took pictures of their instruments, bus, equipment, stage, and then they sat her in the audio/lights section and she enjoyed the show from there. She didn’t meet the guys but that was MORE THAN ENOUGH. We were enjoying the show without knowing any of this because we had flip phones and we couldn’t txt or send pictures without getting charged- we were just supposed to call her when the show was over. When we left, we met my mom at the car and when she showed us the pictures, we completely lost it- hugged, jumped around, and cried. How amazing and well deserved. Got the originally umbrella academy, every poster I saw at Walmart, FYE, hot topic, etc. plastered them in my room. Got band tee shirts from hot topic, My Chemical Romance was everything for us. Not only was the music the best music I’ve ever heard, but their messages in interviews shaped the way I am today still. Gerard saying they didn’t like groupies and to say FUCK YOU to anyone in a band that was trying to take advantage of you. They were/are always so unproblematic (although HUMAN duh) and kind. Bullets and Revenge shaped me, TBP came around and I recorded their MTV debut just in case I was gonna miss it, but of course I didn’t. Watching them perform TBP for the first time live at the VMAs on top of a building felt… weird. I was 14/15 at that time and I didn’t feel a connection with this song but it was still rad! I watched the performance and felt a little empty but still loved them. My sister was in middle school and I was in high school at this point- she shared such a nice story with me and how we gained a bestfriend. She was in PE and had a really sad face (she was also wearing H.I.M. shoes iykyk) a random girl came up to her and asked her what was wrong and why was she so sad? Her response ‘my favorite band is not the same’ and her friend said ‘are you talking about MCR’s performance last night?’ And there they became bestfriends. MCR was always a staple in the way I did everything. I won a statewide poetry contest because of them. We eventually got used to the black parade album and loved every song but especially the B side. Wow, what a beautiful feeling and whirlwind. Eventually I got married and started to do my own thing, Killjoys/CW came out and it wasn’t really my thing but still loved them. And then they announced their breakup in 2013… I was living with my husband already and my sister called me ‘hey, go to the MCR website, read everything’ I thought it was a new better album, or new merch. Was I wrong.. I read Gerard’s open letter to his fans and fucking lost it. Especially the last paragraph- to paraphrase ‘My Chemical Romance will always live inside all of you- because it’s not a band but an idea.’ WHAT??! Are you serious? You saved my life FFS. I drove to my parents’ house immediately and went to the ‘holy grail’ our closet that had everything MCR. Took out our posters, shirts, CDs, comic books (original umbrella academy), hats, etc. I gave things away to my friends that still liked them and the rest I sold at a yard sale. Other stuff I took to Goodwill. My sister CONVINCED me to keep the discography so I gave them to her and told her to keep it in a safe place where I couldn’t see it. Man.. why did it hurt so much? Why did a band make me feel so much pain? Thank God she saved the CDs because I hate myself for all of this. I stopped listening to them and kept it moving. Don’t know any of Gerard’s hesitant aliens songs or any dunes songs. I just ignored all the noise and moved through life as of MCR never existed. They got back together in 2019 and coincidentally I was going though my divorce, my sister called me and she was gonna buy tickets to see them but we weren’t lucky enough. Our bestfriend was living in LA and went and sent us videos. Wow how lucky! I got hooked again and eventually we bought tickets to 2 shows on the east coast and we saw them twice. They sang Vampires Will Never Hurt you… my favorite song in the world. I cannot describe our emotions. I love my sister and this as more than I love anything else. I kicked myself over the merch and stuff I gave away for so long but idc anymore. I don’t even care if they don’t have a new album, if they are happy- I’m happy. I would hate for them to feel the pressure again to just pop a random album. I love MCR with every single one of my veins until the day I take my last breath.

2023.05.29 01:01 AutoModerator Weekly Copyright Reminder
This is a weekly reminder post of this sub's stance on potential copyright infringement. This is a serious issue that needs to be kept in mind when creating and listing NFTs.
Original post by
u/HurleyBird1 Quick disclaimer: I AM NOT A LAWYER. THIS IS NOT LEGAL ADVICE - THIS IS SIMPLY INFORMATION WITH WHICH TO EDUCATE YOURSELVES AND PREPARE YOURSELF FOR LEGAL ADVICE FROM A LICENSED SOURCE.
Now that that's out of the way. My credentials are: MBA, with a bit of business law classes under my belt.
I want to give a quick explanation of how copyright works - and I'll do so through quick blurbs n some myth/reality bullets.
Source:
copyright.gov (US)
- Subject matter of copyright: In general28(a) Copyright protection subsists, in accordance with this title, in original works of authorship fixed in any tangible medium of expression, now known or later developed, from which they can be perceived, reproduced, or otherwise communicated, either directly or with the aid of a machine or device. Works of authorship include the following categories:(1) literary works;(2) musical works, including any accompanying words;(3) dramatic works, including any accompanying music;(4) pantomimes and choreographic works;(5) pictorial, graphic, and sculptural works;(6) motion pictures and other audiovisual works;(7) sound recordings; and(8) architectural works.(b) In no case does copyright protection for an original work of authorship extend to any idea, procedure, process, system, method of operation, concept, principle, or discovery, regardless of the form in which it is described, explained, illustrated, or embodied in such work.
- Myth: I can use any image/song/video/writing I want.
- Reality: No. Not true at all.
- Myth: Well they never said it's copyrighted.
- Reality: Upon publication (and even while a work in progress) a work is automatically protected via copyright under US Law.
- Myth: Well they never sold it.
- Reality: It doesn't have to be commercialized to be protected.
- Myth: Well it was a long time ago
- Reality: Possibly true...as long as the creator is deceased (or if multiple creators, the last living one is deceased) and the required time has passed...although this gets tricky with "estates."
(d) Duration of Rights.—(1) With respect to works of visual art created on or after the effective date set forth in section 610(a) of the Visual Artists Rights Act of 1990, the rights conferred by subsection (a) shall endure for a term consisting of the life of the author.
So what's this thing I hear called "Fair Use?"
Straight from the source:
- Limitations on exclusive rights: Fair use41Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include—(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;(2) the nature of the copyrighted work;(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and(4) the effect of the use upon the potential market for or value of the copyrighted work. The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.
Uhh...help me translate that please... (here's a decent official translation:
https://www.copyright.gov/fair-use/more-info.html)
- above...if it's non-profit educational use, you're usually good to go...if it's for money or trade (commercial nature) then you're usually NOT...unless YOUR piece is "transformative"
Transformative uses are those that add something new, with a further purpose or different character, and do not substitute for the original use of the work.
- Myth: Well this is paid for in Algos, not USD so it's not "commercial"
- Reality: IT IS commercial. You could even barter for bacon and it'd be commercial. It's an exchange of one good/service for another good/service.
- Myth: My piece with Batman inside a card is "transformative"
- Reality: No, unfortunately, more-than-likely the courts would say it's not. A good litmus test is..."If Warner Bros Entertainment (owner of Batman) wanted to make an NFT/ASA "Batman card" would yours compete with it or be possibly mistaken (by a reasonable person - so in America think 8th grade education) for real merchandise? Probably...thus it's not transformative enough.
"nature" gets a little tougher. This looks at protecting the "creative process." Thus, using other works of art is less-likely to be protected than using factual sources - like historical photographs since it's easier to "create art" and thus "transform" factual pieces than other art pieces. This is also talking to things like "parody." Satire is NOT protected. "Parody" is. What's the difference? LegalZoomputs it well: While a parody targets and mimics the original work to make a point, a satire uses the original work to criticize something else entirely. Another way to look at it is that satire uses another work as a way to comment on something happening in the world that has nothing to do with the original work.
- Myth: I added a different border, extra planets, and some blur effect to MTZ's World of Light - it's a new piece of art.
- Reality: Not likely the courts will see it that way.
- Myth: This guy added a filter, some burn effects, and collaged a bunch of newspaper headlines together - isn't that a violation!
- Reality: Probably not...the courts would probably see this as a creation of art out of factual sources.
amount/substantiality in relation to the whole...this is where using clips of songs that are only like 5 seconds long works! But using more than that...runs into problems. This is tough to decipher too...as some songs are EASILY identifiable from just 5 seconds (Ice, ice, baby) - and thus NOT fair use. But some aren't. Usually you're safe using a very small clip of a song or video - especially if you're adding more to it. But this is a dangerous game to play - and there's places to get free audio (some sources below)
effect of the use - this is probably the biggest one. Courts will look at simply...does YOUR work affect the sales or potential for sales of the copyright owner. Of note...this is looked at at the time of the issue being brought to the court, not at the time of sale. For example, let's say my batman card sells for 10 Algos today, but Algorand BLOWS UP and soon every NFT is on Algorand. And now my OG Batman NFT is seen as one of the first Batman ones and official. Warner Bros gonna sue the shit outta whoever owns it at the time they sue to get the rights to all sales of that NFT. So that person is left holding an empty bag when Warner Bros wins in court.
- Myth: Well they're not commercializing it NOW so I'm safe.
- Reality: Technically, yea Warner Bros probably won't spend the money to go after the OG artist and the hands the asset passed through...HOWEVER, they may. That's their right. Who knows - the Napster days showed us the lengths companies will go to. EVEN BIGGER HOWEVER, the last person holding it when Warner Bros DOES decide to go after that Batman NFT...uh oh for them - they just lost their asset.
- Myth: Well it's been like a year, and no one has brought up copyright. So I'm good.
- Reality: If this was in a normal market...maybe this argument would work. If McDonald's let you sell a Ronald McDonald poster for like a year on Amazon with no issues, some court may say "bro, you took too long to bring this to us." HOWEVER, with cryptocurrency being so new (and Algorand being so little known/discussed), most courts would see it as "reasonable" that a copyright owner failed to exercise their rights within a year - possibly even a decade. (Updated because I realized last example dealt with trademark not copyright :o)
So what am I safe to use?
US Government works (mostly)...any deemed free to use by creator...and any a copyright lawyer says they have your backs on (cuz now they're liable).
Here's some great sources for free use items (please add to this list below if you know of some!!!):
Pictures:
https://buffer.com/library/free-images/ (Unsplash is one of my faves)
Music:
https://www.wix.com/blog/photography/2019/11/27/free-music-for-videos/ Video:
https://blog.hootsuite.com/free-stock-videos-sites/ You'll notice there's a lot of "shoulds" "coulds" "probably" etc. This is because copyright cases are all unique and go to the courts. The best bet is to go with stuff you KNOW is free and fair-use. If not, I'd look up copyright law, consult supreme court cases concerning copyright, and ultimately, talk to a lawyer.
AGAIN: I AM NOT A LAWYER. I AM NOT PROVIDING LEGAL ADVICE. I AM SIMPLY PROVIDING INFORMATION. THERE MAY BE ERRORS ABOVE THAT COULD CAUSE SUBSTANTIAL DAMAGES - CONSULT A COPYRIGHT ATTORNEY IF YOU WISH TO RECEIVE LEGAL ADVICE.

2023.05.29 00:01 MrsNacho8000 My parent's house sold at tax sale. The buyer asked me to sign a paper "for insurance." Need advice for trying to protect my dad's money.
To make a long story short, my mom died in 2019 and after that, my dad ran into some mental health problems, causing us not to speak for a few years.
After we got that straightened out, I found out that my parents' house was sold at tax sale. It sold for more than what the taxes were, so according to the county tax office, my dad is due about 15k, which the county told me would be processed this summer after the hearing.
It was public record who bought the house, so a quick internet search found an email address, and I figured it was a long shot but I emailed the buyer to ask for some sentimental items that were in the house. Luckily she responded and let me get some pictures and some of my mom's items out of the house.
Now, she just emailed me asking if I would sign a paper saying that I don't have any claim to the house. She said it was for title purposes only because she's trying to get insurance for the house.
At this point, I don't want to have any claim to the house (and I have no siblings) but I DO want to protect the 15k that my dad is supposed to get and I'm worried about him receiving this money if I sign this paper. I also don't know why she wants me to sign it as the house always belonged to my parents, I never had any ownership of the house. I do want to help her any way I can since she was so nice in letting me get my sentimental items.
Should I sign this paper? If I do, will my dad still get his money?
I appreciate any advice.

2023.05.28 22:43 m3rbles First Car
I'm looking for my first car, and using CarFax, I've narrowed it down to a few different options.
- 2022 Nissan Sentra
- 2020 VW Passat S
- 2020 Nissan Sentra SV
- 2020 VW Jetta
- 2019 Honda Civic LX
- 2021 Nissan Sentra S
- 2020 Nissan Altima S
- 2020 Toyota Corolla LE
Because I'm using CarFax, I can see the miles on the car and any records of accidents or service. Is there anything I should know about any of these cars, and anyone's personal opinions on them are more than welcome and greatly appreciated! I know next to nothing about cars, and any help at all is worth its weight in gold. I have no personal preference towards any of the cars, so whatever one is the best works for me. Thanks in advance!

Hey all, it's been a couple years and I'm trying to sell some stuff before a big move. I'm not super up-to-date on state laws, but I will check your state's laws before shipping any items to make sure we are 100% legal and above-board.
I take Paypal G&S or FF or venmo. I'll ship the cheapest option, all prices are shipped to CONUS. Priced low to move things quickly. I'm only open to offers on bundles OR if you send me a recent comp sale that's cheaper.
Please comment and/or PM, I won't see reddit chat messages.
- SB Tactical folding adapter - only works with non-functional buffer tubes (not an AR). I used to have this installed on a Kriss Vector. $75
Burriss Fastfire 3 red dot - works well, comes with box and tools. Used to have this installed on Kriss vector with a little rail riser block thing. Will throw in rail riser block for free (with this item or any item honestly) if you can use it. $90 SOLD Red dot and riser - Cheap buffer tube, I think milsepc? I used to have a SBA3 on this, so whatever size that is. $20 on its own, or $10 in a bundle
- QTY 11 PSA branded alumnium 30 rd AR mags, all date stamp March 2019.
$9 $8 each while PSA has them on sale for now, or $85 $80 for them all (I think this is a good price shipped, but let me know if I'm off here). Edit: Willing to ship in batches of 4 or more. If you want less than 4, I’d ask you chip in towards shipping. - Leather Glock 43 IWB holster, with 2 magazine holsters. Honestly, just pay shipping and I'll round it up to the nearest $5 for my trouble.
- De Santis pocket holster for Glock 43 (I think), should be this guy. Honestly, just pay shipping and Ill round it up to the nearest $5 for my trouble.
- Little trigger holster thing for Glock 43 - either pay shipping like items 5-6, or I'll throw this in free with any purchase.
- Kydex Glock 19 IWB/OWB holster. I feel like this might have been made by a regular person, I think I bought it on here years ago, not sure if it's a brand or what. $25
- Gatcrank - silly little fun toy, this is an older version. $20

2023.05.28 22:22 Simple-Bother3300 No building control. Freeholder selling. Should I apply for regularisation?
Hello,
I'm looking for some advice as I'm a bit stumped as to what to do, I realise this is my own fault partially and now I need to rectify it but I'm not sure what's the best way to go about it.
I bought my leasehold flat in 2016 and it's ground floor with a basement (the same size as the whole ground floor of the flat) which was labelled as storage in 2019 I had it converted to living space and the bathroom moved down there. (All the other flats in my area have also done this)
In this period my old freeholder sold to my new freeholder (sale did not complete until 2021 and we were not notified until after the sale was complete that it was even being sold) I had permission from my old freeholder to perform the works.
When I started the building works I was in a abusive relationship and finally managed to leave him (he was sorting all the works though unfortunately when he owned half the property) and in that time the builders also disappeared with £30k and so I got new builders who continued the work but I didn't do enough research and now it seems they never applied for planning permission or building regulations.
The things that they did are new plumbing/ tanking the basement/ water tight the basement/ knocked down a non supporting wall and put a beam in/ new stairs/ the put a clear panel in my floor to let more light into the basement and a new extraction system/ I believe they also dug the basement down slightly but that was 2017 before I was in charge.
One of the flats in my building is now having the freeholder apply to forfeit the leasehold due to something else and so I looked into it and have realised all the things I didn't do and am concerned about possibly the same thing happening to me, I do believe the freeholder is selling so I don't know what would happen if this happened or if that would change anything.
Any advice on how to go about sorting this out/ what to do? Who I could call for advice?
