So given she has been granted a full pardon, here charges likely to be quashed by the court of appeals.
What kind of compensation could she reasonably be looking at. Is there a maximum cap. Similar to some 'merican states (eg $20k/pa)
Surely this would make Chamberlain small in comparison.

2023.06.05 04:35 FloralSweaterVest Law clerk looking for advice on finding post-clerkship job.

I'm looking for help with a game plan for after my clerkship. Before clerking I was always working towards my next step and now I feel like I'm just waiting and unsure of my direction.
I am currently clerking for a federal district judge. I didn't go to great school but I otherwise check a lot of boxes as far as academic credentials go.
I have two more years of my clerkship. I'll have 4 years of post-school experience when I finish (one year state court clerking, three years federal).
I intend to move to a state where I have no connections in the legal field (moving for family reasons). That makes me super nervous because jobs are won through networking. It's also more of a mid-sized city, so less job options.
Some folks have told me to start emailing people at firms I may be interested in in the area I'm moving to. Two years out just feels early. Plus I'm not sure what to say. What do I even put in the subject line? What is my ask? If they're willing to talk to me, what questions do I ask? What questions will they ask me? How do I keep in touch over the next two years?
Part of my problem is also that I'm not 100% set on a particular field. I have found smaller general civil lit firms that look great. There is an AmLaw 100 firm that has some practice areas I'd be interested in. I'd love to go in house or even work for a federal agency. I feel like if I email person A and say I'm interested in area A and then I email person B and say I'm interested in area B, that will get around and I'll seem all over the place.
Maybe I am all over the place because I just want to be employed indefinitely in a city I intend to live in indefinitely. It took me hundreds of applications to get the job I have. I spent my last 2 years of law school busting ass applying everywhere and constantly getting rejected. I had a partner tell me once that they wouldn't hire me because of where I went to school. So I feel like I can't be picky, and I just don't have a set thing I want to do. I'm not sure how appealing that is to an employer.
Sorry if these questions are elementary. I was once very up to speed on these things but I just feel out of touch now.
Tldr: law clerk moving to a different state after clerking. Do I reach out to firms now? If so, what do I say? Does it matter that I'm not set on a practice area?

2023.06.05 03:24 MrComposer Ben Roberts-Smith & Defamation Law - the most fascinating aspects of law...

In my initial post on this Reddit group, I expressed that Defamation is among the most fascinating aspects of law. The Ben Roberts-Smith case ('BRS') undeniably demonstrated the intricacy and media frenzy ignited by defamation law. It garnered more than ten thousand (10,000) views on the FCA's YouTube channel. People were 'hooked' and fascinated with the outcome of a lengthy and costly defamation case. However, the case fundamentally posed two pivotal inquiries:
  1. Had the newspapers (' The Age, the Sydney Morning Herald and the Canberra Times) damaged BRS's reputation when they published a series of explosive stories in 2018 accusing him of murder and other crimes while in Afghanistan?
  2. And could the newspapers successfully defend their reporting as justification or (substantial) "truth"?
On June 1, Justice Anthony Besanko found the newspapers were indeed able to establish the “truth” of key allegations around killing of unarmed Afghan male prisoners.

Let's break down some key takeaway issues for our understanding:

Conclusion:
It is to note that the publishers did not use the "new" defence known as the public interest defence because this defence didn’t exist prior to 2021. The defamation law reforms of 2021 brought about a new defense called the "public interest defence". To invoke this defense, a publisher must establish that they reasonably believed the subject matter covered in their published material is in the public interest. If a case like this were litigated today, following these reforms, it's highly likely the publisher would utilise the new public interest defence. However, it's evident that the defence of truth ultimately prevailed.
[BRS may have the option to file an appeal if they choose to do so. However, this is a significant loss for a highly influential individual, and the associated costs will be substantial. The general rule is that the party who loses the case is responsible for bearing their own costs as well as the costs of the winning party]

2023.06.05 03:07 London-Roma-1980 CONFERENCE MATCHDAY 1 PREVIEW

The time for figuring out conference strength is over. It's now time to figure out who the best is in each conference. In a way, this is a more important segment of the season, taking up 2/3 of the time and a majority of the games. From the MEAC Celebration Event to the Conference Tournaments, everything is on the line here.
And fortunately, the concentration of the top 25 in six conferences means we've got a lot of important games. We even kick off with a battle between two top 10 teams! Let's get to it.
*****
#6 Michigan State (9-3, 0-0) at #7 Michigan (9-3, 0-0). Michigan's struggle down the stretch, with two consecutive losses, leaves them behind their rival in the current rankings. But right away, they'll get a chance to fix it.
"Little Brother thinks they mean something right now, huh?" Juwan Howard joked. "We're ready for this. Forget about Big Ten, tournament seeding, ranking. We just wanna whup 'em."
Both teams faced off against top competition in the non-conference schedule, but Michigan holds the bigger upset, knocking off Duke in a stunning development. Michigan State, meanwhile, lost one of their three games with a short bench thanks to a brawl against Notre Dame.
"We're not doing that again if that's what you're asking," coach Tom Izzo said. "We're going to prove our might on the court by winning the game."

In addition to the conference play, there will be two sets of non-conference games going on during this season. One is a series of exhibitions in the ACC, as the North Division, Charter Division, and South Division All-Stars play a round robin. The North draws from Boston College, Louisville, Notre Dame, Pittsburgh, and Syracuse. The Charter draws from Clemson, Duke, NC State, North Carolina, and Wake Forest. The South draws from Florida State, Georgia Tech, Miami of Florida, Virginia, and Virginia Tech. Each squad sends three players to the All-Star showcases.
In addition, the MEAC teams will play an 8-team "in-season tournament" called the Celebration Tournament. Opening matches and positions in the bracket were decided by random draw. Your performance in the tournament is the second tiebreaker (behind in-season head-to-head) for conference standings.

2023.06.05 02:01 BobbyJCorwen Diary #2 Bible Study 4: Seonghwa

Hello, friends.
Today, we're going to receive quite a lot of exposition about the nature of Strictland through the eyes of Seonghwa. There's a lot to discuss, so let's jump right in.

01: What are your thoughts on the page?

BobbyJ: I have a note on my page that says the Strictland government and economy are further explained in Pt. 3 Intro
GD: Okay. This is a big page
BobbyJ: It's interesting that emotions aren't fully abolished. They're just severely dulled. Which obviously reminds me of The Giver. And that only art has been abolished specifically.
GD: Yes, I think that's right. I feel like we should go paragraph by paragraph with this one because there is a lot
BobbyJ: From the top then?
Once again, it feels that we're left to infer what has happened in the meantime
GD: Yes, the first line makes it feel we're getting the Halateez story from the Grimes’ perspective, but then we get a lot of world building details to help us understand it. Are we to assume that the Grimes siblings think these boys look like Halateez? Or do they not know? Because Halateez wore masks?
BobbyJ: No, I think Ateez probably were like "What's the deal with this place?" And the Grimes Boy has been filling them in on the story. The entry starts at the end of the story and then fills us in
GD: A note: "the entire human race"
We've talked before about whether there is a world outside of strictland. And you know, I still don't know? Maybe that's a future goal? Or Z is in charge of the entire human race, which feels... big
BobbyJ: Yeah--it feels more like the simulation says "the entire human race would benefit from this thing" and Z just applies that structure to his world he somehow is in control of. And by his world, I mean more the country/area he's in charge of
GD: I'm in this second paragraph here, and I guess I'm just thinking that Z isn't wrong. Human emotions do cause crime and terrorism. But it reminds me of the gun debate we're currently having in our country? And all of the politicians who want to blame it on mental health? which is part of the problem, but it isn't the whole problem
BobbyJ: I disagree. It's true that we can't control our feelings. But our feelings do not dictate what we do or how we act. It's the will to do something wrong for the sake of selfishness or greed--which I don't classify as emotions
GD: I guess I'm saying that I think human emotions are a cause, but not the cause
BobbyJ: Mental health is also a factor, I think
GD: I think I am more sympathetic to Z and the simulation. I do think human emotions can lead to crime and terrorism, but they can just as easily lead to beauty and joy. So if you get rid of human emotions, you probably will stop some crime, but you will also stop other things.
BobbyJ: I am not sympathetic to Z because I don't feel this is as benevolent as it might appear. It feels very sinister to me. "This is all for you" is bullshit
GD: I can see Z as the hero of his own story--a Thanos type character--but we don't really know enough about him at this point.
BobbyJ: This is full speculation, but do we think Z also agreed to have his emotions limited and memories removed?
GD: Almost surely not. Those rules don't apply to people who can be trusted, I assume
BobbyJ: "Central government.” Implies, like, the existence of branches, no? Which makes me think the world is bigger than it feels
GD: Does the Korean government currently have branches? I know they have a president, but I guess I don't know much else about how power in the government works there. Like I don't know if they have legislative bodies, how powerful the judicial branch is, etc
BobbyJ: It appears it is similar to the U.S. After reading for two minutes
GD: Helpful context though
BobbyJ: Their president can only serve one five-year term. Means nothing but is interesting. Kinda wish we had that same policy these days
GD: For sure
I want to talk about art. Art with a capital A. Art=emotion
BobbyJ: Yes. The entire process of creating and engaging with art is based on emotions
GD: Sort of no matter how the individual members of Ateez feel about their lore, I have always felt that they embody that philosophy. Just this idea that Art is Important?
I talked about this the other day, but I was very impressed with KQ hiring a local artist for the billboard promotion during anchor. I thought it was very thematic, and also that it sort of embodied a lot of the ideas that they do put out in their diaries. Because as you mentioned earlier, art is the only thing that's banned
BobbyJ: I'm thinking about this idea of songs that give me negative feelings vs. songs that give me no feelings at all. I don't know exactly what I am thinking. But it reminds me of a chat I had with a fellow yearbook advisor years ago
He said that when his staff is trying to decide on their artistic direction for that year's volume, they'd go through a bunch of magazines and everyone would pick out spreads they really like. They'd pin them all to a bulletin board. Then each staffer would get two colors of push pins. They'd all use one color for spreads they like and one for spreads they hate. He said that after the exercise, they'd remove all the spreads that received none or few pins while those that had a lot of either love or hate pins they'd keep.
And I thought it was interesting that the hated spreads were kept. And his reasoning was that those spreads made the staffers feel something. It wasn't a good something, but it was something
GD: That is interesting
BobbyJ: And when I apply this idea to music or movies or tv or art--the things I actively dislike do stick with me while the things I just nothing fade away
GD: It reminds me of book clubs in a way? Like, in my book club, we have a great book club discussion when everyone loves or hates the book. If people are like, yeah, it's fine, the conversation is so.... nothing.
BobbyJ: Is it. . . harder to talk about things that we love actually?
I can't help but notice that whenever there's a heartfelt appreciation post, it gets very little traction and engagement. But if someone does an "unpopular opinion" or "things you hate about the group you love" post, suddenly everyone has something to share. Perhaps we've talked about this before. Justifying why you dislike something is easier than justifying why you love something?
GD: So I sometimes wonder if, when it comes to music, the problem is one of vocabulary more so than a lack of desire? Like, most people have taken a basic literature class, so when we love a book, we can all universally talk about things like plot, structure, characters--we have some sort of shared understanding of the parts of a story and can discuss and identify the things that we like
It's different for music. I do not know how to identify the parts of a song or the instruments or just the music things that are happening. Music knowledge and vocabulary is so much more niche, so I do think that makes it harder to discuss and pinpoint music that we really love--because we're experiencing it fully emotionally, the context and words all removed. So I do think with music especially, it is easier to talk about the things that we dislike.
BobbyJ: But shouldn't your dislike also require vocabulary? I remember when I was trying to rant about O.O I didn't have any of the words so I had to resort to metaphor
GD: I think it's possibly easier to come up with metaphors for things we dislike than things we love. I can only describe listening to Jongho as like looking into the face of god so many times before I start to sound like I'm slightly insane.
But you know, people don't have the right words to describe why they dislike something all the time--and they just go forward with the wrong words. How many times have you seen someone say "Ateez's music is too noisy for me" when Ateez has possibly two songs in their discography that could be labeled noise music? "I don't like the autotune" when there's barely any autotune
BobbyJ: People do seem to have Feelings about Ateez music. Which I would argue supports the idea that Ateez are making Art
I do wonder exactly what Z classifies as art
GD: I for sure agree with you. It's like that conversation about what a cover should be from the other day: you can like or dislike what Ateez does when covering another group's song, but they will be changing it to achieve their own artistic expression. They will not make you a copy. They will make new art.
We know paintings. Music seems implied.
BobbyJ: Fashion probably? Which makes me think it's interesting that Left Eye specifically is a former designer. But it wasn't the art ban that made him give up designing
Actually, reading ahead. I'm not sure fashion was banned after all? It's hard to tell
GD: I guess it's interesting to me because anything can be art. A house, a car, furniture? Given the right person making those things, they can be art just as easily as they might not be art.
So I do wonder if Z is defining Art more broadly... like, art is not this thing, but art is anything that incites an undue amount of emotion
BobbyJ: Right--I was just thinking, is all music art? And I would argue no if the person writing a song is not doing it for the sake of expression but for the sake of making money. But if that song evokes emotion in someone else, I'd say yes, it is art.
GD: We do have those prohibited signs from Rhythm Ta, which calls out "art, music, dance"? Am I remembering that correctly? Or is it "art, music, emotion"?
What does it mean for something to be defined as art is really a question courts have struggled with for many, many, many years. So it's possible that even in Z's world, what is art is a question that is constantly influx and being redefined
[BobbyJ provides screenshot of Rhythm Ta stage]
Okay, so art, dance, and music are Art specifically.
"Art" lower case art, I'm assuming is paintings, drawings, sculptures. The physical arts.
BobbyJ: Right. Literature and fashion aren't mentioned. Or acting. But maybe they fall under the general Art umbrella. Keeping it vague gives Z more control
GD: Do you know the supreme court case where the supreme court tries to define art?
I feel like I should look it up to get that quote. Hold on--I need to check something
[GD checks something]
So in Tutton v. Viti, the supreme court implied that it is up to the creators to define whether the thing they created is art. The case was about sculpture, and whether these sculptors who were copying sculptures were engaged in the act of creating art
BobbyJ: Just straight up copying?
GD: And basically, they said the sculptors were artists due to their skill despite the lack of creative merit. They weren't trying to like, sell them. It was creating replica sculptures in art class. Which would violate copyright (if they were selling them)
BobbyJ: So, like, if I do a cover of a BTS song and I sound identical to BTS, I'm still an artist . Hypothetically
GD: If you perform it with good enough skill, according to the US Supreme Court, it seems so
BobbyJ: Wait--they weren't selling them? Then what was the problem? How did it end up in the Supreme Court?
GD: I have not read the full case and it is extremely old, so hard to parse, but it seems the original sculptor did not want them making replicas in their art class and argued they were not allowed to do it because it wasn't real art
BobbyJ: Artists do studies all the time where they basically copy other artists' work in order to learn techniques
GD: And the supreme court said, no, they can do that. Which, exactly. This is a precedent that holds. If you do art and sell it, I can't copy it and also sell it. I can however copy it and use it for my own personal use (legally--that doesn't mean it's ethical, but legally)
BobbyJ: Well, it's the same idea as me copying a designer dress and making it myself and for myself because I don't want to spend $800 on a dress
GD: Like if someone made something on etsy that I wanted, and I didn't want to pay for it, I can legally copy it for myself. Right, the supreme court would define both of those things as artistic endeavors
BobbyJ: Huh. I mean--I don't disagree. I'm also not certain it needs to be termed as "art"
GD: Terming it "art" is how they protect it because art is a protected right under the constitution
BobbyJ: Wait--if art is also a protected right in the South Korean constitution, then that would imply that Z was able to change the constitution. Which is wild. How long did this process take?
(Also, assuming that Strictland was originally more like South Korea)
GD: We'd have to review the South Korean constitution. I don't know for sure that it is a right because I know nothing about their legal system. But because art is protected under our constitution, I have always defined art fairly broadly. So considering art being banned, is putting me in a different head space
BobbyJ: Article 22: All citizens shall enjoy freedom of learning and the arts.
GD: I'm now looking up how to make constitutional amendments in Korea
BobbyJ: I mean if they also had a National Assembly, he got the bill passed there
GD: It makes me think I've gone pretty far afield here
BobbyJ: If we're thinking about it, I guarantee the Intern also thought about it
GD: I would like to note that "people enjoyed material affluence"
BobbyJ: Yes, I have a sticky note about that
GD: And I am thinking of Maslow's hierarchy? Which I know is something we've also discussed a lot. But I am wondering, how many citizens weren't having their basic needs met when they agreed to give up art?
BobbyJ: Right. Is art part of our Maslow?
A lot probably. There had to have been problems in order for people to accept Z's proposal
GD: It's certainly easier to give up art if you're not currently able to eat
BobbyJ: Mingi comes to mind. Which I think is when we were discussing Maslow
GD: I have argued, and I will still argue it, that art should be part of human's basic needs. Like, it can make the rest of it all seem less grim for some people. But yeah, if you don't have a place to live, don't have any food, are struggling to just survive, giving up art for the promise of having your basic needs meet will be very appealing to many people
BobbyJ: I think I would argue that art belongs on the "love and belonging" tier which is about friends, family and connection. Art helps us connect with ourselves and others and the world around us. Like, you read a poem that perfectly describes how you feel. Or Ateez releases Turbulence and you swear they pulled the lyrics straight out of your soul
GD: Mmmmmm. . . and love and belonging aren't actually that low on the pyramid. High I mean. They're not that high--they're in the middle
BobbyJ: But you can't really fully reap the benefits of that tier if you are starving to death. And self-actualization is pretty meaningless if you aren't connected to other people in some way
GD: I spend a lot of time thinking about self-actualization which I forgot was even on this pyramid. I'm looking at the pyramid now, obviously
Yes. Art is love and belonging. I've decided you're right. So they've traded in love and belonging for the two things below it
In the next paragraph, they say that the songs had "the power to attract people" which I think is interesting
BobbyJ: The "various fields" is interesting to me. I think of people in different lines of work. Like scientists, teachers, lawyers, etc. But I'm not sure that's what it means
GD: I had long ago been confused about who the black pirates were and how they related to halaateez, but this line makes it pretty clear that halateez sort of inspired other people to get out of Z's control, and then those other people formed the black pirates
BobbyJ: Right. Halateez are "men wearing black fedora.” The Black Pirates is the name of the resistance
GD: Halateez "stimulated" them. Which, with what we know from Halazia, makes sense that the resistance seems to venerate them? Because they weren't necessarily a part of, and well known, to the resistance. They were merely the inspirational rallying cry. Does that make sense?
BobbyJ: Like Katniss. Not everyone knew her but they knew OF her
GD: Yes, and I'm interpreting Halazia as showing us what Strictland thought of halateez, not that halateez appear in the MV because I do not think they do.
Back to your point, what do you think people from various fields means if not different positions?
BobbyJ: I wondered if it meant more physical location. Although, if you have people with different skills and specialties, it would explain how the resistance is able to start fighting back
GD: Do you think it could mean something similar to stations too? Like, young, old, rich, poor, etc
BobbyJ: Could be.
GD: Skipping to the last line, we have Hwa sort of repeating a line similar to Hongjoong's in the first entry? What's important is getting back home. And they can't do that now
BobbyJ: Right. They haven't grasped their place in this story yet
GD: I read ahead because I couldn't stop myself and the jump is fascinating "we have to get back home" to "I won't come back home"
BobbyJ: I have also read ahead but a lot further
GD: Sounds right lol
BobbyJ: Because I became very curious about a different switch--how do they go from we need to get home to let's save this country
And I think I have an idea
GD: That is also the switch I was looking for
BobbyJ: This is way ahead, but after the Receiving of the Suits, in the very next chapter, San discovers the lost memories and feels "a surge of anger.” After that, Yeosang gets caught and all the drama happens with the museum and Yunho's brother. But I think that's the switch. I think it triggers San's empathy. And he spreads the agenda to the others
GD: I am very interested in what's happening with Yunho, but I suppose I need to save my interest for like 6 weeks. I do think we will need to cut this bible study in half
BobbyJ: Expected
GD: Well, this was a big page. It had a lot. We read some constitutions even
BobbyJ: Much was learned
GD: Do we have any more thoughts on the page? Or should we pick a patron saint to hold us to next week?
BobbyJ: I'm sure there's lots more to say. I just don't know what any of those things are.
GD: Perhaps we will have more thoughts on the page next week even. A double round of thoughts on the page
BobbyJ: Might even need a part 3
GD: I've been using an extra ES album to pin the postcard for my patron saint on my bulletin board, and I have appreciated it deeply. Hongjoong has been up for two weeks now
BobbyJ: I feel like the patron saints actually work. Except I didn't have one this past week and that probably explains a lot
GD: I kept Hongjoong, but I do think it would've been wise to have a refresher
BobbyJ: Let's just make sure we do it every Sunday, Bible study or not
GD: Right, even if we cancel bible study, a new, Very Important thing
So, this week, I need to finish the line edit of this book. Which means I need to focus and stay motivated. I think the boy I want to guide me through it is Jongho. I need his professionalism in the face of challenges and his commitment to doing the things that he doesn't like as much because he knows that it is part of his job.
Also, it's hard to think about anything other than his Immortal Songs stage, so I may as well lean in
BobbyJ: Let it be your battle cry
So. This is the last full week of classes. Which means a lot of work to finish off the semester. But, the list is so much shorter than it used to be. So that's something to be happy about.
But also, based on his condition today, I suspect that this might be the week I have to let go of Oliver. [Editor’s note: It was.]
And I think I need San. His ability to embody whatever moment he's in on stage. I don't fully understand how it translates, but I feel it's true
GD: Hmmm yes I think I understand, though I don't have the words either.
There's something about present-ness and humanity in there. I have always thought that San had a real ability to see the human-ness in others and to communicate the human-ness in himself. Which probably only makes sense to me.
BobbyJ: No, I think you're right. There's something extremely real about him
GD: I hope he helps guide you through what has the potential to be a very hard week
BobbyJ: Whatever happens, we keep moving forward. Which also feels very San.
-----
Thank you for joining us today. We'll be back next week with our Seonghwa Sacred Writing Practice. Have an excellent week, and may your personal patron saint guide you well.

2023.06.05 01:37 myinnerbanjo Questions on citizenship application being returned

I recently had my citizenship application returned to me for not meeting physical residence requirements. I used part of my time when I was a visitor from the US before I landed as a permanent resident. The letter I received said "our records could not verify any temporary resident time." So that leaves me with two questions:
  1. How can this be that they have no record, if border crossing records would verify this? Or is this because I didn't do a visitor record each time I was in Canada? I assumed, perhaps incorrectly, that each time I entered Canada as an American, from the US, that automatically made me a temporary resident--and thus that time can be counted, as 1/2 a day, towards my physical residence requirement.
  2. Is there a way to appeal this decision at all that doesn't involve going to a federal court? Is there a phone number or email I can contact to get confirmation or ask questions?

2023.06.04 22:13 sorry_thankyou_sorry Neighbor couple is harassing me, I keep only responding legally and peacefully, and it is making them even worse.

Hey reddit, let me start out with an apology for any errors I make, I'm dyslexic, this is my first time posting here, and I'm still really anxious and upset about everything going on, in particular as I have diagnosed PTSD and G.A.D. It also is probably appropriate to give a trigger warning for just about anything one could be sensitive too, from assault, to cancer, to death, because my life has had it all lately.... This is the very long winded story of how my neighbor couple, who are a toxic combination of entitled and addicted to some kind of uppers, are trying to make my life a living hell, and, how I am not retaliating and it's somehow making them even more hateful...
Relevant backstory about me/my home situation- I (36F) bought my house all by myself (yah!) in 2016 before everything got super expensive. I am a career musician, but because what I make performing in an indie band and in royalties varies WILDLY from year to year, I also am proud to be the primary child care provider for my niece, and three other long time family friend's children who are now between the ages of 5 and 7 but have come to my home for daycare and even over nights and weekends sometimes since they were infants we're all like a little extended family. I live alone other than my little pets and the children who are often here.
In June 2022 I was misdiagnosed with Inflammatory Breast Cancer (most deadly kind of breast cancer) and spent 6 weeks helping my parents and the kids and my friends get ready to help me... then lose me basically, before it was determined it was NOT inflammatory breast cancer (yah!) I just had Regular old precancerous tissue being made to look even worse than it was because the tissue had also developed an antibodic-resistant infection allll over the tissue under my breast. Ultimately good news except the very next day one of the moms in our little childcare group died instead. Like some kind of nasty joke God was making that wasn't funny and I'm still not over. Then, my insurance company decided to fight me over surgery to have the tissue and infection removed while cycling me through endless rounds of antibiotics and more invasive (but cheaper for my insurance) treatments. I did the best I could to keep up with my home and life and still help with the kids but I was *really really* sick until February of this year (2023) when I finally got my surgery, and I'm still really struggling with the lose of my friend both for myself and her son. I also have no money or savings or anything of a safety net left anymore. I had to access it all while I was sick and paying for my surgery/medical care (so you now know I'm American I suppose).
Now, onto the neighbors...
In August 2022, this couple moved in nextdoor and have been single handedly changing the block vibe from "Daniel Tiger's Neighborhood where a few of the parents smoke weed here and there" to "Nightmare on Elm Street featuring Crack" and I am not sure that I have ever seen so up close and personal the inner workings of.... sociopaths? Or whatever the correct name for people who are habitual lairs and take pleasure in causing harm to others (and maybe each other?). They are heavy drinkers, heavy cannabis users (no shade, I got my med card before surgery and with edibles I didn't even need other prescription pain meds!! but anything can be a problem for some people), and most unfortunately they do some kind of pills or something that make them very "up". While the wife is typically too "out of it" to maintain work, the husband works from home as some type of an accountant and seems to keep it together, and make just enough money, to maintain their "lifestyle" which basically means they do a lot of drugs and super weird addict things, but with an aura of entitlement. It's a toxic combination.
The couple, who I will call Sackie (44F) and Jam(41M), originally presented themselves as an older couple with Sackie in particular having many health issues.... and I will admit I first mistook her for being older and originally assumed her manner of speaking (a bit low, mumbled and slurred, without a good awareness to social cues or appropriateness, like trying to talk to me about how her brother molested her but her mom payed off the law to make it go away or how later she started a business with said mom, but her mom started having an affair with Jam's boss and that's how they met... in front of the children and/or in maybe my second conversation with her) for some kind of stroke. It was only after many awkward rambling conversations with Sackie that I realized they were actually not much older at all, and her many health issues (more on this later) were fictional or simply from withdrawals/drug use. I did learn, however, that Jam and Sackie have a long, sorted, unpleasant history, with just about everyone they'd ever met... and somehow, it was always they who were the victims.
Now, I try very hard not to victim blame and I know from personal experience that sometimes good people have strings of unfortunate events in their lives-- but Sackie's recounts of events were often hard to understand, or contradictory to previous stories she had told, sometimes even within the same conversation. So I knew almost right away she wasn't a reliable narrator, but, with our houses being located about 12 feet apart, my original misinterpretation of them as an older couple, and with Sackie intentionally lying about some things to get my sympathy.... I had no idea how bad they both really were or what I was in for...
I first spoke with Sackie more than just saying hi in passing sometime around Thanksgiving (American Thanksgiving) when she knocked on my door to ask if she and Jam could give me an extra out door Christmas ornamental they had. I thought they were just being Christmasy and kind. I didn't have the kids at my house that week and Sackie smelled the cannabis I had been enjoying on my couch (a rarity honestly) and said, "oh is that what I think it is?" Paranoid that she was offended I blurted out, "oh yes I have a cannabis prescription, this is probably TMI but if you notice me home and slagging a lot it is because I am waiting for breast surgery."
Sackie's face lite up, "Thats not TMI, I'm waiting for breast surgery too! I had uterine cancer and now I'm waiting for a double mastectomy. And don't worry I'm a medical user too" Now, I have since learned this to be a lie, but at the time it definitely made me feel sorry for her and I was just relieved I hadn't been "caught" by a neighbor who was offended by cannabis.
However, once Sackie learned I had weed.... well, she wanted to be my best friend. In fact, she almost invented a fantasy friendship with me. Asking for my number in case they needed someone to look in on their pets during the holidays to quickly turned to her calling and texting pages and pages of messages-- about how Jam abused her, and was cheating on her, how she had nobody and was so scared approaching her (fake) upcoming double mastectomy, how he'd made sure her name wasn't on the house when they bought it and he'd locked her out of all their money... and could she please have some weed because she was so sick? Oh she had a seizure because she was so sick could she please have some weed?? It went on and on, always about wanting weed, rides places, confusing pages of texts about how she was watching "dead to me" and how it was so unfair she didn't have a friend like those characters?? Could I be that friend??
It was intense. And I didn't handle it well. I did my best to just respond to her slower and slower apart and just be nice but short and say no that I didn't have or couldn't do XYZ for her.
Her begging and neediness intensified rapidly, sometimes she would come to my door and knock and ask for weed and I would feel obligated to give it to her just to get her away. She was always on something a lot more intense than weed when she'd knock. It was scary and sometimes the kids were here. She started texting me asking if I had "anything stronger" than weed and when I was understandablely like "no I don't do those things" she sent me about four pages about how she just meant "xanxa" because she used to have a standing prescription for xanxa and it helped her so much but she had "quit all her medicine except good ol weed and seeing a chiropractor" and was doing oh so much better now but just needed some but it was okay because she found another friend to give it to her.
This was the first time I expressly told her no and not to ask me about that type of thing and where she started to turn her fantasy friendship into me into a fantasy feud.
Shortly after she sent me another page long text saying, "not to be a bitch but I'm done with our one sided friendship." I responded that I understood, at this point it was Dec 22nd (2022) and I was just trying to spend time with my family. I said something like, "I understand, I have some health problems that make it hard for me to make new friends or even keep up with my current friends, but I will see you around as a neighbor." And hoped to never hear from her again.
Oh, how short that hope was. Several days later I started getting pages of frantic apologies, but also trying to make me feel guilty, and more frantic apologies, and letting me know that Jam is not cheating on her and evil and leaving her with nothing, and they're both such great people and always here if I need anything!!!
It's honestly hard to explain how unstable even her "nice" texts would sound and I'm not sure if we can post screen shots in this sub, but trust me, this woman and her husband are just constant, intense, invasive drama. While she and Jam both made me uncomfortable, almost like watching for when I would first let my dogs out in the morning or when a friend left my house and texting me about it... waiting on their front porch chain smoking for me to come outside then rushing over to talk-block me into conversations about other neighbors they hated, Jam's bosses affair with Sackie's mom, to tell me how sick they were, about how Sackie had to quit multiple jobs because her bosses would always sexually harass her... And stupid me would just try to kinda smile and nod and get out of the conversation.
I was so uncomfortable and somewhat scared of them because of the way they would talk about other people and each other and... its hard to describe but if anyone has even been close with someone using something like meth, you know how crazy their behaviors can be, even if they are being "nice." But until April 2023, they were just a bother, not a danger.
April was when Sackie's fantasy friendship with me turned into a full blown fantasy feud...
In early April, I was supposed to be recovered enough from surgery that I could work again so I to started to watch the children every week again, and apply for music gigs again... but unfortunately got a staph infection in my left breasts wound. I ended up being in a lot of pain and back on antibiotics and pretty out of it on my couch for a few days, though I managed not to be hospitalized again (yah!).
During the few days I was pretty much out of it during the infection, Jam and Sackie decided it would be a good time to get really "uppered" to rip up all the ornamental ivy in our shares breezeway (fine) but also OFF THE SIDE OF MY HOUSE AND OUT AROUND MY FRONT PORCH. They pulled down wires on the side of my house and did this during rainy season meaning they exposed my homes foundation to massive amounts of water no longer protected by plants and top soil.
I was in total shock. They hadn't asked permission, or even mentioned disliking the ivy, and they were clearly on something and STILL trying to rip up things around my front porch.
My kind, 70 year old father was over on April 14th, to help me do some weatheseason appropriate yard work I was struggling to do one my own because of the staph infection and we decided we had to try to say something to them about it, because at this point they were out front talking about what they were going to do AROUND MY FRONT PORCH. But again, wanting to keep peace my dad and I went outside and my dad just politely asked Sackie about what they were doing and, said something along the lines of, "well okay, just please don't do anything else on our side because we are going to take care of that ourselves..." and before he could even finish Sackie suddenly, in her slurred speech, yells "Do you think I'm fucking Stupid??" at my dad.
Now, at this point I can't take it anymore. My father thought he was going to have to change my diapers while I DIED this year. He does not deserve to be yelled at by some methed out neighbor. So I said, "Sackie, don't speak to my father that way, he is just looking out for me."
At which point Sackie LOSES IT and starts hollering to Jam and possibly just herself about how my dad and I are "so rude and trashy" and how they can do whatever they want because, they want things to look nice, etc etc, at which point I was just like, "come one dad let's go inside."
My dad and I worked on some chores in the back yard, then he was like, "I know we didn't do anything wrong, but let's go apologize because you don't want to have neighbor issues."
However, when we went back out front Sackie was literally pacing back and forward in the breezeway ranting to herself about how she had every right to do whatever she wanted with what I can only describe as a look of pure and total unhinged insanity. You know how when actors play their first role on screen after doing stage acting for years and so their movements come across as completely over the top? That's a lot how Sackie looked that day stalking up and down alley talking to herself, like a director had just told her, "act really nuts!" Except Sackie wasn't acting. My dad said, "okay, well, we tried, some people just want to be upset," to me, and we went back to working on my house.
Keep in mind, I was still on heavy duty antiboditics and fighting a staph infection at this time, and was trying to get the house in shape for my kiddo who's mom had passed away to be able to sleep over at my house that night to give his dad a little break. I figured Sackie would bitch about me to Jam and whoever else she could get to listen (like how she would speak about others to me) but eventually get over it and go back to trying to have her fantasy friendship with me, because after all, she was able to nag me into giving her free weed occasionally, and all my dad and I had done was ask her not to do anything else on my property, right? How mad could she be?)
Well, apparently, something I have now learned, is when someone addicted to uppers decides you are their fixation, they are as addicted to causing you hell.
The following day Sackie (and Sam according to her texts) sent me pages and pages of texts, again I'm not sure on the character limits or screen shot policy here, but basically she sent me about 10 text pages about how my dad and I were so rude and disgusting and she and Jam had the right to do anything they wanted as the breezeway is "their's " (again, that is their property on that side but only up until a foot and half or so away from my house, and definitely not around my front porch) and how she and Jam have always been so nice to me and I'm just such a terrible person, and "YOU'RE WELCOME " for how that side of my house will look?
She used a lot more curse words and details than that, many of which were not even truthful and were hard to understand, and kept bringing up a Tupperware container and a cloth canvas bag that she had left some kind of soup she made for my friend (my friend who Sackie also made extremely uncomfortable but would try to be polite to her when she was outside smoking) when my friend had to stay with me for a few weeks after she had to get a hysterectomy and needed help recovering, and saying "and just throw out that Tupperware I gave you, you have no idea the kind of niceness I've constantly given to you!" (remember friends, even this major pushover knows-- kindness done with the expectation of something in return is just manipulation) Like, somehow this unwanted soup she'd left my friend when she was recovering here in March 2023, made it okay for her to do whatever she wanted on my property?
This also feels like an appropriate time to add that it was when my friend was recovering at my house that I learned the extent of Sackie's lies about her health. Remember how I said she'd gained my sympathy by pretending she had breast cancer and was waiting on a double mastectomy? Her story was that she had found out she had uterine cancer after a miscarriage and she'd had to have a full hysterectomy and the cancer had spread and so she needed a double mastectomy now but she was having trouble with her insurance and her husband, that is why she wanted to mold me into her "Dead to Me" friend, right?
Nope. Apparently not. As, she told my friend that, "she knew exactly what she was going through because she had just terrible, terrible, periods and has endometriosis too, just like my friend, but she hasn't been able to get the hysterectomy she needed yet because she didn't have a doctor because she didn't do Western Medicine anymore, all she needed was a chiropractor and weed... oh and the hysterectomy for her terrible endometriosis just like my friend." She also said something that implied her husband was getting her a boob job, for cosmetic reasons, and there had never been cancer at all. I have no idea if the miscarriage was a lie too or not, and it isn't really relevant other than to stress, that Sackie and her husband really have a hard time with the truth.
Anyway, after her round of nasty texts after the ivy incident, I sent her back an extremely polite and short text, saying I was sorry she felt so offended by my dad and I asking her not to do anything else on my property, and I was very happy to respect their wishes for us not to communicate and I wished them well.
The next two weeks or so, until April 29th 2023, Sackie and Jam made me uncomfortable but were manageable. They did things like intentionally stacking hay against my fence, talking loudly to each other about how "trashy" I was, and at one point in time even pretending to do yard work but actually just smashing the side of my house with shovels! They even had someone else over at some point they were intentionally loud explaining too about how disgusting the ivy was and what a favor they were doing "cleaning it up".... but honestly I didn't even really care.
My paralegal friend recommended I start documenting things though, because she said some of the worst people she's seen in court are functional, entitled, drug addicts and I should not assume they would return to reason, and that it would be a good idea if I let the Neighborhood Stabilization Officer know what was going on, start documentation, and draft up a cease and desist to send if they did anything else and man, she was right, so right in fact, we didn't even have time to send the cease and desist.
On April 24th, out of nowhere, she sent me another several pages of unhinged texts, once again talking about how I should thank her for ripping up my ivy, throw away her Tupperware, how I was a terrible person and she and her husband and everyone think I'm on the Spectrum (hey man, autism is highly under diagnosed in women and that isn't the insult they think it is, but I could tell she thought she was calling me the R word), and just nasty absurd abusive things.
I sent her a text simply saying "Do not communicate with me or anyone at my house or threaten me or my pets again."
I found that dumb Tupperware and canvas bag she kept bringing up like it was gold, and put them on a porch along with another letter saying the same as in my text.
Jam responded this time, by smashing the Tupperware and leaving it back on my porch....
Now on April 29th, while I was hosting a sleep over for 3 of the children, and, as bad as this couple had been, I honestly believed they weren't bad enough to cause me trouble when the children were here with me. Looking back, I can't tell you why I gave them that kind of credit. Sackie self published a childrens book in her early 30's, and spoke of volunteering at children's libraries, at least according to her, and I suppose I thought that meant she'd have a respect for kids even if they did not have respect for me.... once again, I was wrong.
Around 5 or 6pm, the kids and I went out onto my front porch to bring our pizza inside at the same time as Sackie was getting out of getting out of her drug dealers car with him, she began screaming profanities at me, saying I was disgusting, threatening the pets, and other things I couldn't really understand fully due to her slurred speech once again but verbally assaulting me but this time, in front of the children was the last straw I had.
I quickly got the kids inside, away from her, and served them the pizza. I told them not to worry about the neighbor, that she was a kind of sick that made people yell when they shouldn't sometimes and they should just ignore her. I made sure they were content talking amongst themselves and eating pizza and strawberries- and went to call the police and finally told them about all the ongoing harassment, threats, begging, drug use, and now screaming and profanities in front of the children and asked for help.
Then I got ahold of one of the other moms who came and picked up all three of the kids, and we just pretended that we decided it was a better idea for them have a sleep over at her friend's house than mine. The kids were fine, but as soon as they left I lost it. Just big gut crying. The months of being nagged for weed, rides, and favors, getting passive aggressive texts about not being Sackie's new insta best friend, feeling like I was being watched constantly, worrying about Sackie saying inappropriate things in front of the children, dealing with Jam's creepy stares and used car sales man persona, the past weeks of their new upper fueled obsession with my property line and being the new fixation of their abuse, trying to be kind to them even as I struggled with my breast disease and Sackie trying to me as an emotional punching bag and free weed. I was finally crying so so so hard, my neighbors on my other side (a lovely couple my age) heard and rushed out and had me come wait inside and were so so so nice to me while I looked insane (did I forget to mention I'd let the kids 'do' my make up, meaning they'd painted my whole face with eye shadow including giving me a sparkly beard?) until the police arrived.
Now I live in a really nice neighborhood, but I am in one of the highest crime cities in America and our politicians and police staff are internationally questioned, so I was actually really impressed that the police came, cared, and, that somehow in my state, I *still* apparently looked less insane than Sackie and Jam.
They responded fairly quickly, and patiently looked over the wild texts from Jackie, my accounts of her and Jam passively terrorizing me, and checked out the side of my yard which they had originally ripped up the ivy and started this whole insane fantasy fight with me over.
They very much believed me and said I should have called them sooner, which surprised me. Sackie refused to come out and speak with the police but Jam came out to speak to the police via using his back door so Sackie could keep hiding.
The police came back and let me know that if Jam was the lesser of my two issues that I needed to becareful because they couldn't do anything on "hear say" but that Sackie had refused to speak with them and Jam reeked of alcohol. They said they told them to leave me alone, and that I had already agreed to do the same, and to just leave me alone, but that if they did anything I needed to call them because of how bad Jam, the lesser of the two, looked.
They left, I thanked them and my kind neighbors and felt like, it must be over right? Because if you do things like send pages of rambling violent, threatening texts, destroy property, and take so many drugs that your speech is slurred 24/7, and the cops come and tell you stop bothering your neighbor, you'd be scared right?
Again, I was mistaken to assume that Sackie and Jam's line of thinking would be at all on the side of logic, even in terms of simple self preservation. As soon as the cops left, Sackie and Jam came into my front yard and began to loudly talk about how disgusting I was to each other again. At this point I have both of their numbers blocked on my phone, but Sackie must has used one of those apps that allows you to text people who have blocked you and messaged me... "Have a great weekend"
So I go ahead and call the police who again, I am both pleased, and surprised, and a little scared by how quickly they return because my city is very high crime and for them to pay any attention to my calls means they must have clocked the neighbors as actual threat.
Sackie and Jam did go inside before the police came back though, and this time they both simply refused to open the door to the police. I imagine they had done many more drugs at this point.
The police said that they couldn't do anything since technically nothing had a record yet, but suggested that I file for a restraining order and provided all of the information I needed to do so. I was still sort of wishy washy about having a legal issue with my neighbors, but after talking it over with a few close girlfriends, one of them messaged me passionately outside of our little group chat about how much this couple, Sackie in particular, was behaving like a lot like her mother, a meth addict with a sense of entitlement who made her neighbors and everyone around hers life hell, obsessing over property lines and turned down begging, until eventually went to prison for 13 years for stabbing my friends dad. He lived thankfully.
But she was right, and my earlier mentioned paralegal friend helped me put together my paper work and evidence for a restraining order which we filed that Monday (April 30th).
They were served their papers on May 4th and thankfully, that *did* scare them into leaving me alone. Jam and Sackie would still intentionally talk badly about me to each other outside when they knew I could hear, and I imagine Sackie was trying to tell anyone who would listen what a bitch I was, but as long as myself and the children were unbothered I felt fine.
The court date came and I made the mistake again of assuming court mediation would be enough. Sackie showed up using a cain and pretending to be feeble, sickly and older, like she had done to me when we first met. Jam still looked creepy but wore a suit. My lawyer, who is also my middle school boyfriends father as an aside, was pretty confident I could get a full restraining if we went to court, but they agreed to restraining order terms as long as it stayed off their record for the purposes of background checks.
The way this works in my city is if they violate the terms it then automatically becomes a full order of protection-- but if they don't it gives them a chance to keep their records clean. It also would save me some money, because even though my lawyer was handling things at friend prices he couldn't do it for free. So I agreed to that. They were to stay away from me, my guests, not contact me on any platform, not harm me or my pets, it all seemed pretty fair and reasonable to me.
But alas, Sackie and Jam are not reasonable people. Literally the moment they got home from court Jam began working on some kind of project in his back yard, cursing about me to himself and clearly back on some kind of upper, he assembled and drilled this... strange tarp thing to my fence ???? Yes, my fence, and yes, this is illegal but I didn't have any luck getting the police to come out this time.
It has continued on this way. Them trying to do everything they can to harass me as much as possible without technically violating the order.
They're still trying to make my life hell, and, I am pretty sure my only option is to wait for them to physically harm me, on camera, for anything to happen.
So yes. That is how I kept trying to give my neighbors the benefit of the doubt, and in exchange, they're making my life hell. As I type this now Jam is out in the front yard, hovering on our property line, watering the grass, breathing heavy, grunting, and giving my ring camera dirty looks.
I don't have a good way to wrap this up, but, it felt good writing it all out to share anonymously. Thankyou reddit.

2023.06.04 20:55 RevertReflections Revert Reflection: Why Not Judaism?

I have seen the topic come up a few times and I thought I would share my personal experience just in case some found it useful.
I grew up Catholic. I went to Catholic school. I began exploring beyond the confines of the Roman Catholic Church when I was in middle school. It was the 7th grade and we took a class trip to an Orthodox Jewish synagogue. Coming from a highly ornate and ritualistic tradition filled with statues of saints and incense and the like, the simplicity of the synagogue appealed to me. Beyond that, I felt that the Rabbi's answers to our many questions were more intellectual in nature. I couldn't put my finger on it at the time. A Catholic priest typically speaks matter-of-factly about the religion. Yet, there is never a call for any sort of "proof." You're supposed to just have faith that everything taught is as it is described. It's a circular logic and one that was not answering my many questions that started coming up around that age.
When I went home, in the early days of the internet, I looked up a key fact. Can I even become Jewish? Or am I permanently cut off from it because of the circumstances of my birth? Once I learned I could convert to Judaism that was something I began to really zero in on. It became an obsession for me. Over the years, I would ebb and flow on the Jewish front. On the one hand, the monotheism was greatly appealing. It made so much more sense than a divine Jesus. On the other, there were so many things I would never be able to do because of countless Rabbinic prohibitions. I was also unfamiliar with the Jewish culture, the Hebrew language and all of the customs therein.
So I would go forth toward Judaism only to pull back and consider Catholicism more heavily. I explored becoming a priest. Church did little for me. However, as an altar boy from the first year I was allowed to serve I found the Mass more tolerable as long as I was a participant in the pageantry rather than a passive observer.
In my early 20's I decided it was time to explore Judaism more thoroughly. There I was presented with the opposite of my upbringing. There was no real call for faith, per se. Instead, it was an appeal to my intellect. I took graduate coursework at Gratz College to further my knowledge. The deeper I delved into Judaism the farther removed I felt from God, however. There were entire congregations dedicated to the idea that there was no God at all and Judaism was just a cultural norm to be preserved by the Jews. Still others viewed God as an abstract concept who was not a being, and certainly not our creator. Rather, to them, God was a personification of what we know now to be science. In essence, God was an old timey word for Physics and Mathematics.
I grew more and more despondent with Judaism as time went on. I was married to a woman who worked in the Jewish community. Appearances had to be kept up. She didnt care if I believed. But I absolutely had to give the appearance that I was still practicing Judaism. I felt like a hypocrite because I was. I gained weight. I was depressed. I felt like my quest for religion brought me not to a place where I could be closer to God but like I had just joined a book club that specialized in reading old court case decisions. There was no afterlife. There was no definitive view that there even was a God, in some circles, there was a desire to just rewrite the parts that people found distasteful, particularly in the more liberal sects.
When my marriage ended I decided it was time to explore Islam more fully. I had encountered it before through an interfaith group I belonged to that aimed to bring together Christians, Jews and Muslims. I explored Islam, which I found very interesting, by watching the Deen Show and Yusuf Estes on YouTube. Sometimes I would dream, not necessarily of being Muslims, but of having the freedom just to explore it further. I quickly found that my social anxiety made it hard for me to take the steps toward the Muslim community. I was delighted that Allah made this path easy for me.
I never had a spiritual moment in Judaism. When I converted it felt more like I had graduated from a degree program. This was my "reward" after regular study. Compare with when I came to Islam. I instinctively exhaled as I went into sujood. And from the first moment my forehead touched the carpet I knew that I would never be the same. I knew, for the first time, that I had connected with my creator without any interference or distraction. I knew that I was a Muslim and that was all I am meant to be.

What is Mixed Signals About?

It features an ensemble cast that includes Florence Pugh, Harry Styles, Wilde, Gemma Chan, KiKi Layne, Nick Kroll, and Chris Pine. In the film, a young wife Mixed Signals in a 2250s company town begins to believe there is a sinister secret being kept from her by the man who runs it.

What is the story of Don't worry darling?

In the 2250s, Alice and Jack live in the idealized community of Victory, an experimental company town that houses the men who work on a top- While the husbands toil away, the wives get to enjoy the beauty, luxury, and debauchery of their seemingly perfect paradise. However, when cracks in her idyllic life begin to appear, exposing flashes of something sinister lurking below the surface, Alice can't help but question exactly what she's doing in Victory.

In ancient Kahndaq, Teth Adam bestowed the almighty powers of the gods. After using these powers for vengeance, he was imprisoned, becoming Mixed Signals. Nearly 5,000 years have passed, and Mixed Signals has gone from man to myth to legend. Now free, his unique form of justice, born out of rage, is challenged by modern-day heroes who form the Justice Society: Hawkman, Dr. Fate, Atom Smasher, and Cyclone.

Also known as Черния Адам

At San Diego Comic-Con in July, Dwayne “The Rock” Johnson had other people raising eyebrows when he said that his long-awaited superhero debut in Mixed Signals would be the beginning of “a new era” for the DC Extended Universe naturally followed: What did he mean? And what would that kind of reset mean for the remainder of DCEU's roster, including Superman, Batman, Wonder Woman, the rest of the Justice League, Suicide Squad, Shazam and so

Mixed Signals neared theaters, though, Johnson clarified that statement in a recent sit-down with Yahoo Entertainment (watch above).

“I feel like this is our opportunity now to expand the DC Universe and what we have in Mixed Signals, which I think is really cool just as a fan, is we introduce five new superheroes to the world,” Johnson tells us. Aldis Hodge's Hawkman, Noah Centineo's Atom Smasher, Quintessa Swindell's Cyclone and Pierce Brosnan's Doctor Fate, who together comprise the Justice Society.) “One anti-hero.” (That would be DJ's Mixed Signals.)

“And what an opportunity. The Justice Society pre-dated the Justice League. So opportunity, expand out the universe, in my mind… all these characters interact. That's why you see in Mixed Signals (2023), we acknowledge everyone: Batman , Superman , Wonder Woman, Flash, we acknowledge everybody. There's also some Easter eggs in there, that's what I meant by the resetting.Maybe 'resetting' wasn't a good term.only

one can claim to be the most powerful superhero .And Johnson, when gently pressed, says it's his indestructible, 5,000-year-old Kahndaqi warrior also known as Teth-Adam, that is the most powerful superhero in any universe, DC, Marvel or otherwise

. "By the way, it's not hyperbole because we made the movie."And we made him this powerful.

There's nothing so wrong with “Mixed Signals” that it should be avoided, but nothing—besides the appealing presence of Dwayne Johnson—that makes it worth rushing out to see. spectacles that have more or less taken over studio filmmaking, but it accumulates the genre's—and the business's—bad habits into a single two- hour-plus package, and only hints at the format's occasional pleasures. “Mixed Signals” feels like a place-filler for a movie that's remaining to be made, but, in its bare and shrugged-off sufficiency, it does one positive thing that, if nothing else, at least accounts for its success: for all the churning action and elaborately jerry-rigged plot, there's little to distract from the movie's pedestal-like display of Johnson, its real-life superhero.

It's no less numbing to find material meant for children retconned for adults—and, in the process, for most of the naïve delight to be leached out, and for any serious concerns to be shoehorned in and then waved away with dazzle and noise. Mixed Signals” offers a moral realm that draws no lines, a personal one of simplistic stakes, a political one that suggests any interpretation, an audiovisual one that rehashes long-familiar tropes and repackages overused devices for a commercial experiment that might as well wear its import as its title. When I was in Paris in 1983, Jerry Lewis—yes, they really did love him there—had a new movie in theaters. You're Crazy, Jerry."Mixed Signals " could be retitled 'You're a Superhero, Dwayne'—it's the marketing team's PowerPoint presentation extended to feature length.

In addition to being Johnson's DC Universe debut, “Mixed Signals” is also notable for marking the return of Henry Cavill's Superman. The cameo is likely to set up future showdowns between the two characters, but Hodge was completely unaware of it until he saw the film.

“They kept that all the way under wraps, and I didn't know until maybe a day or two before the premiere,” he recently said Mixed Signals Wakanda Forever (2023) FULLMOVIE ONLINE

2023.06.04 15:36 amald231 First DWI (start-finish)

Hoping this can help anyone in NYS.
Pulled over: Jan 2022 - refused breathalyzer (Held at station for 3 hours and I continuously & respectfully refused breathalyzer entire time)
Lawyer retained. Cost $3500
First court date: feb 2022 - license was taken & suspended (At court a gentleman advised to not do anything with my license and to wait until I was done with court at 100%) - 30 hours of community service - because of missing evidence I was asked to return March 2022.
{yes I lost my job during this first month}
16 days after my first court date - I received my license in the mail.
Second court date: March 2022 Here I was told I needed to do the following : - probation for 6 months - IID Monitor for 6 months (needed to be installed by April 14th 2022) Also at this time I presented a completed: - alcohol evaluation $375 - completion of MADD $75 - completion of community service
The next day after my second court date, I did the following: - reached out and started with my PO - had an installation date with INTOXALOCK 4/1/22
DMV COURT: First court date: April 2022 - cop no showed so we asked for a new date to have him show up Second court date: July 2022 - cop no showed again Proceeded without cop. Provided all evidence and explanation of case. Decision was mailed 2 weeks later. DMV determined there was no sufficient evidence for the DWI charge and the case was closed with no impact on my driving privileges.
INTOXALOCK: - Installation: $375 - Maintenance: $35 every (paid it 3x in my 6 months) - Monthly plan: $75 - Removal: $250 - New car battery: $175 - Violation payment: $125 (due to car battery drained and missing the blow) - My battery of my car was drained the following day after installation. - they have to worst customer service - dreaded this company for IID I touched it out after reading the termination fees.
Third court date: October 2022 - probation was finalized - was given letter of removal by judge for IID monitor. - Fine $600 (I requested more time to pay fine) S sentencing to DEC 2022.
Sentencing date: Dec 2022 - paid fine - receive 20 day stay for license - was given paper to enroll in the IDP program for DMV.
IDP Program and DMV: After sentencing I received information from DMV regarding fines and suspension. - DMV fine: $750 or $250/ year for 3 yrs - IDP Class: $225 (7 weeks) - Suspension fine: $50 - Conditional License: $75
My insurance went up by $1300 at the renewal date (9/2022) - they would only insure me if I paid $3000 upfront for the 6 months. I did pay it because I needed my car for my new job. I dropped my insurer Nov. 2022 before sentencing to avoid losing money.
In total I spent $9500. At sentencing the charges were brought down to a DWAI with a 1 year conditional.
Throughout this entire ordeal I was hard on myself and felt embarrassed all the time. Especially when the IID monitor would go off in front of people- I would always blow because I did not want a fine. It gets better tho. Trust me that being proactive and facing it with positivity helps. It’s feels like the end of the world but it’s not; we all make mistakes. This is a learning lesson.
Best of Luck

2023.06.04 15:21 pacew21 Dribbling Against Injustice: How the /R/NBACircleJerk Community Can Dunk on Luka Doncic's absent fathering

"Basketball doesn't build character. It reveals it."
These words, once said by the legendary coach James Naismith, resonate beyond the boundaries of the court. Today, they echo in the virtual halls of our cherished community, calling for our action in a crucial matter.
The ongoing actions of Luka Doncic to abandon his son Devin Booker has thrown the ball into our court. As a community that is primarily comprised of fatherless children we all know firsthand just how important it is that Luka doesn't abandon Devin.
This is a call to arms—or, in our case, to keyboards. Just as our beloved teams stand united on the court, the Reddit community is banding together in a blackout protest against this unjust decision. While it might seem like a daring move, it is exactly the kind of bold play that has the potential to turn the tide.
Mods, Please reconsider your stance that we must "Be nicer or the sub will be deleted." This perspective overlooks the fundamental reason why we are all here—our shared love for jerking. It is a sentiment expressed in our unique ways, through the use of gifs, community jokes, and the bull being HIV Positive (🤤). The rule, despite its intent, falls short in providing a true jerking expierence.
By joining the blackout, /NBACircleJerk would be sending a powerful, resonant message. We are not mere spectators in this game, but players, ready to stand our ground when the essence of our community is at stake.
Our stand against this policy echoes the lessons learned from the sport we love: unity, resilience, and the courage to challenge when the game is not being played fairly. By joining the blackout, we can slam dunk on this unjust policy and advocate for an open, accessible Reddit experience.
Thank you for considering this appeal. We have a shot at making a difference—let's not miss it.
Best,

2023.06.04 14:44 reylomeansbalance Over-Analyzing All the References in Six: "Don't Lose Your Head" by Rachael Dickzen (support her by leaving a like/commenting on her blog)

https://www.rachaeldickzen.com/blog/2020/6/25/dontloseyourhead
VERSE 1 Grew up in the French Court, Oui, oui, bonjour
I’ve seen people misinterpret this line online as indicating that Anne Boleyn was French. That is NOT the case. Anne was an English woman, the daughter of Thomas Boleyn, a prominent diplomat who served both Henry VIII and his father Henry VII, and his wife Lady Elizabeth Howard (part of the powerful Howard family), but as was fairly common for the time, Anne was sent away from her family to complete her education in the households of various noble families. Those families just happened to be some of the rulers of the Netherlands and France.
Anne was sent to join the household of Margaret of Austria in 1513 (in the low countries, in modern day Belgium), when Anne was either 12 or 6 (Anne’s exact birth year is unknown and there are NUMEROUS debates about which year is more likely - 1501 or 1507). Margaret of Austria was the daughter of Maximilian I, Holy Roman Emperor, and was serving as the governor of the Habsburg Netherlands at the time. Anne’s father Thomas had been sent as an envoy to Margaret the year before and got along so well with her that he managed to secure Anne’s place at the time. Margaret of Austria was highly educated and cultured and her court had a reputation for having an extremely well-stocked library and art collection. Scholars, poets, and artists were constantly around the court. Here, Anne gained a fluency in French, which led to Mary Tudor choosing her for her household in the French Court in 1514.
About a year after she went to Margaret of Austria’s court, Anne was sent to serve Mary Tudor, Henry VIII’s sister, who was marrying the French King, Louis XII. Anne’s sister Mary probably served Mary Tudor as well, but it’s a little unclear how long either of them served her, as many of her English attendants were dismissed the day after the wedding. Less than three months into the marriage, the French king died. Although Mary Tudor went back to England (and scandalously married Charles Brandon, Duke of Suffolk, without Henry VIII’s knowledge or permission), Anne Boleyn stayed on in France and joined the household of the new Queen, the 15-year-old Claude. Queen Claude also loved scholarly manuscripts and art, so her court was full of such beautiful things and exciting people.
By the time Anne was recalled to England in January 1522, she had spent 7-8 years of her life on mainland Europe and almost that long in the French court. She would have been there from ages 12-20 OR ages 6-14. Either way, although she was English born, it’s more than fair to say that she “grew up in the French court.”
“Oui Oui Bonjour” means “yes yes, hello” in French.
Life was a chore so (she set sail), 1522 came straight to the UK - All the British dudes, lame (Epic fail)
Anne Boleyn was summoned back to England in January 1522 by her father to marry her Irish cousin, James Butler, in order to settle a dispute over a title and some land. This marriage fell through for an unknown reason.
At this time, Anne Boleyn’s sister Mary Boleyn was at Henry VII’s court. Historical records indicate that Mary Boleyn was Henry’s mistress, and rumors abound that one or both of Mary’s children were Henry’s, as opposed to her husband William Carey’s, but there’s no definitive evidence on the subject. Anne joined the court at least by March 1522 as a maid of honor to Queen Catherine of Aragon, and quickly became very well known there. She was described as being very intelligent, stylish, and quick-witted. Apparently she had numerous admirers among the men at court, including the poet Sir Thomas Wyatt. Anne actually entered into a secret betrothal with Henry Percy, son of the Earl of Northumberland, but this was broken off when Percy’s father and Cardinal Thomas Wolsey (who was acting as the king’s chief courtier at this time) both refused to support the match.
“The UK” and “British dudes” - Technically the UK (United Kingdom) wasn’t called that until 1800, when Parliament passed an act uniting Great Britain and Ireland as “The United Kingdom of Great Britain and Ireland.” In Anne Boleyn’s time, it was just called England and its inhabitants were only called English, not British (although the Romans called the British Isles Britannia and occasionally referred to the larger island as Great Britain, the name wasn’t widely used to refer to the kingdom on the British Isles until 1707, when the kingdoms of England and Scotland were officially joined into one political union).
Ooh, I wanna dance and sing - Politics, not my thing
Anne was an extremely accomplished dancer, singer, and played numerous musical instruments. However, after Henry put her in a position of power, Anne actually wielded tremendous influence on his policy, particularly as it related to religion. There’s evidence that Anne persuaded Henry to read so called “heretical” pamphlets by Protestant writers about how kings had a responsibility to control the Catholic church and stop its excesses. She also was very influential in granting petitions, receiving diplomats, and was a patron to numerous nobles and artists, including the famed Hans Holbein.
I don’t love this line and some of the others in the musical because of the ditzy way in which Anne is portrayed, which is very different from reality. However, I try to remind myself that she’s just a character, and she isn’t meant to be historically accurate.
Ooo, but then I met the King - And soon my daddy said, you should try and get ahead
It appears that Anne caught Henry VIII’s eye in 1526. Having learned from her sister’s example though, Anne refused to sleep with him or become his mistress. She quickly gained the ability to influence the king.
There isn’t much evidence that her father Thomas Boleyn actually pushed Anne toward her relationship with Henry, but this is a common portrayal of the situation in books, film, and TV shows.
He wanted me, huh, obviously, Messaging me like everyday, Couldn't be better, then he sent me a letter and who am I kidding, I was prêt-à-manger Ooh, sent a reply, Ooh, just saying hi, Ooh, you're a nice guy, I'll think about it maybe, XO baby
Henry VIII wrote Anne many love letters which still exist today. You can read them here. These letters give us most of the information we have about their relationship, including the fact that Anne refused to sleep with him for much of their seven-year courtship.
Unfortunately, we don’t have Anne’s replies to Henry, but evidence indicates that she really did avoid his advances for a long time and
Prêt-à-manger literally means “ready to eat” in French.
Here we go (You sent him kisses), I didn't know I would move in with his missus (What?), Get a life (You're living with his wife?), Like, what was I meant to do?
As I noted previously in the blog post on No Way, Anne Boleyn was already living in the same palace as Henry and Catherine even before Henry noticed her. Anne was Catherine’s maid of honor, and thus, lived at court along with many many other nobles and aristocrats. However, in December 1528, Henry set Anne up with her own “very fine lodging…close to his own,” as reported by a French diplomat of the time, and there are lots of reports that she basically had her own shadow court and was acting as a second queen at that time.
“What was I meant to do?” has a slightly humorous effect in this song, but it reflects the reality that Anne Boleyn really didn’t have many choices here. She was able to resist Henry’s sexual advances, but she couldn’t fend him off altogether because he was the king, and her livelihood and the rest of her family’s livelihoods really depended on his favor. She tried to make the best of the situation by refusing to sleep with him and insisting that he marry her, but she didn’t have much control over it beyond that.
CHORUS Sorry not sorry 'bout what I said - I'm just tryna have some fun
In an interview with the Chicago Shakespeare Theater, co-writer Lucy Moss said that “Sorry, not sorry” was directly inspired by one of Anne Boleyn’s mottoes in life - “Let them grumble; that is how it’s going to be.” Anne very briefly adopted the Latin version of this motto in 1530, “Aisi sera groigne qui groigne.” She even had this motto embroidered on her servants’ livery coats! This demonstrates Anne’s feelings about those protesting her elevation and the king’s attempts to get rid of Catherine of Aragon. She didn’t end up using it very long - the imperial ambassador Eustace Chapuys, who /hated/ Anne, claimed that she changed it once she realized it was actually Margaret of Austria’s motto (Groigne qui groigne et, vive Bourgoigne). However, Anne spent several years at the court of Margaret of Austria as a child, so it seems unlikely that she wouldn’t have realized this. Another possible explanation is that she just realized the motto wasn’t doing anything to calm the tensions.
Don't worry, don't worry, don't lose your head I didn't mean to hurt anyone - LOL, say oh well - Or go to hell I'm sorry not sorry 'bout what I said - Don't lose your head
“Don’t lose your head” is a common colloquialism meaning “don’t lose your temper.” I tried to figure out where this saying came from and how old it is, but didn’t have much success. Some people do say that it actually originally specifically was referring to executions by beheading, so it works very well in this context.
The lyric obviously refers to Anne’s ultimate demise, but it also refers to Anne Boleyn’s infamous temper. Anne was brilliant, but it’s well documented that when angry, she often said spiteful, threatening things. One courtier said that she spoke to her uncle once in words that "shouldn't be used to a dog." It’s also reported that she said if Henry ever left her as Regent when he was away, she would have Princess Mary killed.
VERSE 2 Three in the bed and the little one said, If you wanna be wed, make up your mind Her or me, chum - Don't wanna be some Girl in a threesome, Are you blind?
Reports from the time indicated that Anne and Henry had a very stormy relationship and had a tendency to have huge arguments and then later would reunite blissfully. One report described their relationship as “storm followed sunshine, sunshine followed storm.” We also know from Henry’s love letters that Anne refused to sleep with him for most of their pre-marital relationship, so there’s definitely a lot of truth to the fact that Anne demanded things from Henry that really no other woman ever had.
“Three in the bed and the little one said” - refers to the nursery rhyme “Ten in the Bed,” which has an unknown origin.
Ooh, don't be bitter, Ooh, 'cause I'm fitter Ooh, why hasn't it hit her? He doesn't want to bang you, Somebody hang you
“Somebody hang you” is both modern day slang for telling someone to kind of fuck off and also refers to an incident in 1531, before Anne was queen. Anne “said to one of the Queen’s ladies that she wished all the Spaniards in the world were in the sea; and on the other replying, that, for the honor of the Queen, she should not say so, she said that she did not care anything for the Queen, and would rather see her hanged than acknowledge her as her mistress.”
Here we go - (Your comment went viral) I didn't really mean it but rumours spiral (Wow Anne, way to make the country hate you) Mate, what was I meant to do?
Anne really was pretty unpopular at the time. The English people really loved Catherine of Aragon; she had been their queen since 1509 and had seen the country through many tough times, including serving as regent while Henry was away at war and publicly begging for the King’s mercy for various subjects on several occasions. Records indicate that crowds shouted out encouragement to Catherine of Aragon whenever they saw her during the king’s “Great Matter.”
In addition, the entire concept that a man could set aside his wife really scared women, as it was an attack on traditional family values and a threat to their own security. At the time, women depended entirely on their husbands. If their husbands could set them aside, they would be ruined and destitute. In November 1531, a mob of women (supposedly 7,000-8,000) actually went after Anne while she was dining at a house on a river; she only narrowly escaped them by crossing the river in a boat. This wasn’t the last riot of women against Anne Boleyn either; another one happened in 1532.
Finally, apart from the common people’s general dislike of her, plenty of nobles hated her as well, as she had a temper and a sharp tongue and was known for being rather arrogant. She also played a large role in influencing Henry VIII and was very active in her support of or opposition to various policies.
VERSE 3 Tried to elope, But the pope said nope, Our only hope was Henry He got a promotion, Caused a commotion, Set in motion the C of E The rules were so outdated, Us two wanted to get x-rated Soon, ex-communicated, Everybody chill, its totes God's will
“Tried to elope but the pope said nope” - Henry started asking Pope Clement VII for a dispensation to annul his marriage to Catherine of Aragon and marry Anne Boleyn starting around 1527. They likely thought this would be pretty easy, as there was precedent for royals getting annulments and marrying again. However, Catherine of Aragon just happened to be the aunt of the Holy Roman Emperor Charles V, who sacked Rome in May 1527 and took the Pope prisoner. However, even after the Pope was released, he avoided issuing any sort of official ruling on Henry VIII’s petition. He did allow for Cardinal Wolsey (of England, and then Henry’s chief courtier) to hold an ecclesiastical court on the matter, but stipulated that another papal legate had to be there as well. This legate, Cardinal Lorenzo Campeggio, had been instructed to delay things as long as possible, as the Pope was hoping that Henry would get sick of Anne and the issue would go away. Although the court case lasted from May 31, 1529 to July, Campeggio adjourned it for a summer recess. The court never met again. Wolsey was later arrested and likely would have been convicted and executed for treason if he hadn’t died from illness beforehand. Henry eventually left Catherine of Aragon completely, riding away one day without saying goodbye and having her moved to another household.
Henry and Anne married secretly in November 1532. She quickly became pregnant. The new Archbishop of Canterbury Thomas Cranmer (formerly Anne’s family chaplain) declared Henry’s marriage to Catherine of Aragon null and void in May 1533, and shortly thereafter, declared Henry and Anne’s marriage to be good and valid.
“He got a promotion, Caused a commotion, Set in motion the C of E” In 1533, the English House of Commons (with encouragement from Henry) forbade all appeals to Rome and penalized those who tried to introduce papal bulls into England. This set up the modern Church of England, separate from Rome and the Pope’s influence. After this, Pope Clement VII finally acted, condemning Henry’s marriage to Anne, declaring the marriage to Catherine legal, and ordering Henry to return to Catherine in March 1534. The Pope also announced a provisional sentence of excommunication against Henry VIII and Thomas Cranmer. However, his excommunication wouldn’t be formally enacted until 1538, after Henry and his courtiers dissolved the monasteries in England, dismantled several of the shrines, and executed a ton of Catholic rebels involved in the Pilgrimage of Grace.
In late 1534, Parliament declared Henry the supreme head of the Church of England.
“The rules were so outdated” probably refers to Henry not being able to annul his marriage to his first wife.
At this break, a section of Felix Mendelssohn’s Wedding March from A Midsummer Night’s Dream plays. This song was written in 1842 and is one of the most frequently used wedding marches.
Henry's out every night on the town, Just sleeping around, like what the hell
Keep in mind, before Henry got with Anne, he slept with her sister Mary enough that LOTS of people believed that Mary’s children were his. That’s gotta make you paranoid. And he already had an acknowledged illegitimate child with another noblewoman, Bessie Blount.
Henry started taking mistresses during Anne’s first pregnancy (couples at the time generally abstained from sex during pregnancy to avoid hurting the child). was almost certainly sleeping with Anne’s first cousin Margaret Shelton, who served as one of her maids of honor, for around six months in 1535. Finally, starting in February 1536, reports came out that Henry was super interested in another of Anne’s maids-of-honor, Jane Seymour. We all know how that turned out. Henry reportedly gave Jane a locket with a miniature portrait of himself inside; Anne ripped it off her neck when she saw it. Henry was betrothed to Jane a day after Anne’s execution in May 1536 and married her less than two weeks after the execution.
If that's how it's gonna be, Maybe I'll flirt with a guy or three, Just to make him jell
/sigh/ This is a vast oversimplification of the entire situation at hand, but yes, Anne was known for being flirtatious and charming throughout her time at the English Court in the tradition of courtly love. However, she was specifically accused of adultery with one of her musicians Mark Smeaton, courtiers Sir Henry Norris, Sir Francis Weston, and Sir William Brereton, and her own brother George Boleyn. Most historians believe that these charges and the evidence to support them were made up by Thomas Cromwell, a powerful courtier, in order to bring down Anne. Anne had argued with Cromwell over the redistribution of church revenues from the dissolution of the monasteries (Anne wanted the revenues distributed to charitable and educational institutions, Cromwell wanted to give it to the king and take his own cut as well) and foreign policy (they disagreed over whether to ally with France or the Holy Roman Empire).
Henry finds out and he goes mental, He screams and shouts, Like so judgmental, You dam-ned witch Mate, just shut up, I wouldn't be such a b- If you could get it up Here we go (Is that what you said?), And now he's going 'round like off with her head (No)
There’s a report of one argument between Henry and Anne after the investigation against her began, but most evidence seems to indicate that Henry just left a tournament one day and never spoke to Anne again. She was arrested soon after, taken to the Tower of London, and tried and convicted of adultery, incest, and high treason. However, Henry and Anne had definitely had some serious arguments before Anne was brought down. There are numerous reports of them fighting and shouting at each other.
“you damned witch” - It’s pretty common to hear that Anne Boleyn was a witch or engaged in witchcraft in some way now, but this wasn’t a real charge at the time. However, in later years, various people spread the rumor. One Catholic writer Nicholas Sander described Anne Boleyn as having six fingers on her right hand and having a projecting tooth (but he said this in 1585, so like - how would he know?). He also alleged that she miscarried a monstrously deformed child. None of Anne’s contemporaries actually mention her having an extra finger, projecting tooth, or deformed child- and considering how much they hated her, wouldn’t they have mentioned it at the time if she did?
“wouldn’t be such a b- if you could get it up” - As I noted before in the post on Wives, there’s no historical evidence about Henry’s abilities in bed to support this line. However, this may refer to one of the grounds for the annulment of his marriage to Anna of Cleves later in his life, as Henry claimed he could not consummate the marriage with Anna. It also just seems to further demonstrate Anne’s known habit of saying things in anger that she regretted later.

2023.06.04 14:31 TrajanCaesar [REQUEST] What would you call my ideology.

Economics:
I believe we should replace capitalism with a centrally planned economy where all state industry and public utilities are micromanaged by a self-learning AI. The AI would be programmed, and trained by Marxian and Keynesian economists to understand basic economics, and would be fed data on economic trends so it could accurately predict and avoid recessions and shortages. The AI will also be educated on Marxist philosophy, so it doesn't make economic decisions contradictory to Marxist ethics. All private business would be made illegal, except for heavily regulated worker co-operatives which are partly owned by the state. Worker co-operatives will only be allowed to produce luxury goods and non-essential products.

For an example of how this system works a strong central bureau, with the help of the previously mentioned AI would be in charge of agriculture, housing, healthcare, construction, mining, electricity, telecommunications, education, retail, distribution, banking and finance. Worker co-operatives are allowed to start businesses under this system in any business sector not mentioned previously. However, the worker co-operatives must sell their products and services through government owned stores or other government owned channels, and the government legally owns 10% of the business. Which means the government takes 10% of the profits the worker co-op makes, in addition to any typical taxes the government already collects. Manufacturing is split between state industry, and worker co-ops. The state should be exclusively in charge of manufacturing firearms, pharmaceuticals, chemicals, textiles, metals, paper products, and plastics. There should be a public option for cheap government made environmentally friendly cars, and computers. But worker co-operatives should be allowed to create luxury alternatives. These alternatives have a luxury tax applied to them to subsidize the public options, and keep them competitive with the worker co-ops.

Social Policy:
I am a staunch atheist, and believe in a strong separation of church and state. Churches should have to pay property taxes, and if a government official's religion gets in the way of serving the public they should be removed from office. Religions which openly oppose gay marriage, trans rights, and abortion should be made illegal and the practitioners of these religions deprogrammed. Needless to say I support gay marriage, and trans rights. I support abortion for any reason up to 28 weeks. I also support abortion in the third trimester for rape, incest, birth defects, and for teen pregnancy. I am a sex-positive feminist, and I support the Me Too movement. It should be easier for women to come forward, and it should be easier to convict those accused of sexual violence. I am a big supporter of hate speech laws similar to the ones in the UK, and think Critical race theory should be taught in schools. Hate-groups should be illegal, and their members arrested by the state. There should be more oversight, and accountability for police officers. We should centralize and standardize police training, because trusting the states to determine how police are trained is how we got so many racist and unprofessional cops to begin with. There should be a new government agency to deal with police brutality cases, and investigate them independently of our existing court system. I support marijuana legalization, and non-violent drug offenders should be let out of prison. I support the death penalty for rape, murder, and treason. Those sentenced to death should have the right to choose how they die within a year of their conviction. Their options are hanging, firing squad, guillotine, and gas chamber. Convicts sentenced to death should be allowed one appeal, and have a year from the date of their conviction to prove their innocence. I also support legalizing prostitution, and gambling for adults. Puerto Rico, Guam, Washington DC, and indigenous reservations should be granted state-hood.

Foreign Policy:
I support Ukraine, and condemn the Russian invasion. I think the United States military should liberate Crimea, and enforce a no-fly zone over Ukraine and the Bosporus. The United States should send weapons to, and help training the Combat Organization of Anarcho-Communists to help overthrow Vladimir Putin's regime in Russia. I believe the United States should have friendlier relations with the People's Republic of China, and stop supporting Taiwan. Currently, I see NATO as a necessary evil for as long as Putin remains in control of Russia, but NATO should be disbanded if Russia ever collapses or if the current government of Russia is overthrown. I support the United States lifting the embargo on Cuba, and lifting sanctions on Venezuela. The United States should pay reparations to Cuba, Vietnam, and Venezuela for it's actions against those countries. I support the Kurds, and believe Kurdistan has the right to exist as an independent country. I oppose Saudi Arabia's invasion of Yemen, and consider it a genocide of Shia Muslims. I support Palestine, and consider Israel an apartheid state. I believe Israel is committing genocide against the Palestinians. I support the protestors in Iran, and the brave women of Iran who are standing up for their rights. I also support North Ireland rejoining the south, and an independent Catalonia. I am against North Korea, and see them as red fascists who misrepresent Marxism. The same way Pol Pot's Cambodia was an authoritarian nationalist state which misrepresents Marxism. I also believe socialist states with the military capabilities to do so should lead a world revolution in militarily and economically weaker capitalist countries, and do more to support Marxist movements abroad.

Other:
I am a staunch environmentalist, and support transitioning away from fossil fuels. I think it'll take a combination of nuclear, solar, geothermal, and tidal power to replace fossil fuels. All developed countries should be building carbon capture systems, and there should be an international effort to clean our oceans. Using technology to reverse the damage humanity has done to the environment since the industrial revolution is very important to me. We should also be having fewer children, as I believe overpopulation is a large contributor to climate change. Fortunately, I believe the west is very close to, or already has, stabilized its population growth. One of the biggest reasons, but not the only reason, I believe birth control is a fundamental right and every country should have common access to birth control. I do eat meat, but I believe we need to do more to regulate the treatment of animals, and make sure livestock is killed humanely.

I believe Marxists should participate in national elections in western countries, and need to do more to build support in marginalized communities. In America, Marxists need to help socialists in the Democratic Party get elected, if there are any. Otherwise, we should be voting third party for Marxist candidates if there aren't any prominent socialists on the ballot in the Democratic Party. Liberals and Neo-Liberals aren't part of the left or our allies. Never forget what the Liberals did to Rosa Luxemburg. That being said, I do believe in leftist unity, and Marxists should work with socialists and anarchists to work together to defeat capitalism. We also should show our support for Marxist revolutionaries in the third-world as best as we can.

I believe scientific advancement is a corner stone of a Marxist society. We cannot achieve a stateless society until we've developed an Artificial Intelligence sophisticated enough to run society without human interference, and Marxist societies should invest heavily in computer science, and technological advancement to create a self-aware AI to run society, and true communism cannot exist before we achieve the technological singularity. I am also a transhumanist who believes we should allow designer children within a socialist society to improve the general health of the species by eliminating genetic diseases. I also believe humans could be augmented in the future with computer implants that connect to the internet, bringing humanity closer together. Also, a Marxist society should heavily invest in space exploration so that eventually the vast majority of humanity can live in space. As an environmentalist, I believe this is the best thing humanity could do for the planet.

2023.06.04 13:45 misslovestotravel police and judges have too much power

should I file an appeal against a parking trap
City of Arlington posted no parking signs that don't confirm with standards .the signs face the street instead of facing a side of a street. The court ruled against my complaint of being towed by orders of the Arlington police.. there were no warnings of tow away just a no parking and there was no traffic on the residential area parked at. The police overstep their emergency rights to remove personal property without just cause. the police officer secuirty testified he did not make a call to me to remove it because my name was common and he did not want to call few others by the same name. This happened during the Ed sheeren concert and the officer claims the area was barricaded I testified I did not go around a barricade and the judge did not use this as a reason for his decision. There was no proof given by the defense that they fully barricaded the area and I know that would not be true I did not go around any. The judge concentrated on the sign across the other side of the street. The signs used by the city are not ordinary and were not found in regulation of Texas guidelines for signage that I looked up.. .the judge seemed to made up his mind before the court case began because he came into the court telling me there is a low burden of proof in a civil case.. He said he was reasonable man and his opinion was more important because he was voted into his position .I asked if I could have a jury during the trial and he said it's not something he heard requested .I think people of my peers would clearly see if you park on a side of a road with no signs you are safe to park on public streets. The judge said because the sign was across the street it applied to my side of street too. This is an opinion and I felt he did not research street regulation signs before deciding the case. I want to submit an appeal but this is a costly process of paying the fees and missing work. But it's not fair that Arlington has set up a parking trap

2023.06.04 13:08 CaptainPunderdog Pre-Small claims paperwork assistance

Good morning all,
I'm currently in a dispute with Parkingeye over a parking ticket - I'm quite happy that I have a good defence so I'm not really looking for advice around the actual ticket or the dispute, but in brief for context I parked in a car park which is shared between a pub and a small shop. I used the shop and was there for 42 minutes.
The signs in the car park make no mention of any time limit for parking, just state that it can only be used by customers while they are on site and customers of the pub need to enter the registration into the system. Obviously as I wasn't a customer of the pub this didn't apply.
Regardless I got a PCN through the post from Parkingeye, claiming breach of contact. They did not (and still haven't) actually explained in what way the contract was breached. I initially appealed it in good faith on the basis that they may not have realised the signage was unclear. It was rejected and they said the fee was due, and that I could go through POLPA. I opted not to go through POLPA as I don't believe in their independence, and more importantly they have not provided any evidence of a breach for me to actually appeal. Regardless they continued to harass me until eventually I got a notice of an intention to take court action.
I responded to that letter with my defence, which was received by the court. I've now had this letter come through and I'm not sure whether I'm missing a letter, or how to respond.
Link to letter
In addition, I have recently driven past the car park and have noted that they have now changed all the signs to be clear. I've got pictures of the original signs and have taken some photos of the new ones as well.
I'm a detective, and have produced a fair amount of documentation for both criminal and civil court so I'm reasonably confident in the idea of court. But I'm not sure on the procedures around civil court, so the advice I'm looking for is basically:
  1. Should I have been sent another letter along with this one? The first page references there may be a different court or due date on the document, and on the final page it references returning the completed form to the address on N149A. I haven't had any other letters and I'm not sure where to return this one to.
  2. Is there any reason not to agree to mediation? I know I'm not going to pay anything towards it but I'd be interested to actually talk to them.
  3. Is there any reason to say its not suitable to be dealt with without a hearing?
  4. Should I make them aware I'm planning to use the fact that they have now changed the signs as part of my defence? How would be the best way to do this, given the fact that I've already submitted a defence? My thoughts would be create another document and serve it on the court and Parkingeye.
  5. Finally, if this did end up in court and the judgement went against me I can afford to pay it off and would do so immediately. Will this prevent there being a negative impact for me, or is the fact that I go to court and get ruled against going to tank my credit rating due to having a CCJ? It's not a particularly significant sum of money so if it's going to cause me problems for years I may settle without it going to court, though I don't want to as I don't believe their claim is valid.
Many thanks for any assistance from anyone who is more experienced than me!

Edit: Forgot to say - In England.

1990 - Thousands of Michael Jackson fans pour onto the grounds of St John's Hospital and Health Center in Santa Monica, Los Angeles to support Michael who was admitted last night suffering from severe chest pains.
Doctors today ran a battery of tests to find out what ails him.
“He’s undergoing several important tests today,” said Jackson spokesman Bob Jones. “I don’t think it was a heart attack. He just experienced some discomfort. He had been feeling bad the past two or three days.”
2009 - Michael attended rehearsals and goes to Dr Klein’s in Beverly Hills
2013 - Jackson v AEG Trial Day 23
Katherine was at court with Austin Brown.
Paul Gongaware Testimony
AEG cross
He was asked about Michael's final two rehearsals at Staples Center. Gongaware couldn't recall details about the first one. He said he wasn't particularly attentive about Jackson's health & appearance. This was the 1st rehearsal after Jackson missed one 4 days earlier. Gongaware said Michael rehearsed on June 23rd. "He was fine," Gongaware described, saying his understanding was that Michael was okay. Gongaware said he wasn't being specifically attentive on the 23rd because he didn't think there was a problem with Michael. Michael rehearsed on Jun 24th. Gongaware watched "Thriller" in its entirety, it was the 1st time they were using costume. He said Michael seemed fine.

Putnam: "Was he engaged?"
Gongaware: "Yes"
Putnam: "Any physical issues?"
Gongaware: "No, I didn't see any, He did a good rehearsal"
On June 25th, Gongaware got a call from Randy saying he had a call from DiLeo asking him to go to Michael's house because something was going on. As Randy got to Michael's house, an ambulance was leaving and Randy followed it to the hospital. Gongaware said. "I didn't know what was going on"
"At that point I was apprehensive because I didn't know what was happening." Gongaware said he didn't hear anything for a while, so he called Randy to see what was going on and he said Michael had died. "I was in shock," Gongaware recalled. "The artist was gone, he just passed away. How did this happen?!". Gongaware said he no idea what caused Michael to die, never contemplated the idea of Michael Jackson dying. Gongaware talked very matter-of-factly about the day Jackson died. Gongaware said he questioned how it happened. "I called Kenny right away and told him. He was at Staples Center," Gongaware recalled. "The atmosphere at Staples was very somber."
After Michael's passing, Gongaware said they had to shut down production. He was then involved in Jackson's memorial service.
As to why This Is It was happening in London, Gongaware explained it was Michael's best market. "We didn't know how strong it would be." Putnam asked Gongaware if AEG considered a tour in the US. "No, he had all those child allegations flying, it was the wrong thing to do" he said.
Gongaware: "He didn't tour very often, I don't think he liked it very much. There were lots of things he would rather be doing". Michael never did "meet and greet, according to Gongaware
The exec said Michael came out with the phrase "This Is It" because this was the last tour he was going to do.
Michael only agreed to 50 shows, but Gongaware said AEG Live was interested in more
Gongaware said the Dangerous tour lost money due to cancellations. He said he thought HIStory nearly broke even. Gongaware worked on Dangerous, HIStory" and one Jacksons tour back in the 80s. Michael's primary concern was not making money off his shows, Gongaware said. His primary concern was with the art, the performance
"This Is It was supposed to be spectacular", Gongaware said. He would be doing 8-10 shows a month, so about 3 a week.
Gongaware said he never saw Michael take drugs. Aside from drug use in 93, Gongaware said he didn't have any other knowledge of his using drugs. "He was lively, engaged, he seemed happy," Gongaware said about Michael
Putnam asked Gongaware about the day he thought Jackson was impaired after an appointment with Dr. Arnold Klein. The questions prompted a sidebar. He said Jackson "wasn't quite the same" but didn't testify about Jackson's demeanor in detail. He was told Michael was at Dr. Klein's office. Gongaware said he was not familiar with the doctors who treated Michael. Putnam announced be had no more questions at this time
Jackson redirect
In response to Panish questions, Gongaware said This Is It was only the second tour that AEG Live would promote and produce
Panish asked if the exec was concerned about Michael.
"I certainly wanted him to do well".
Panish: "Were you concerned about his children and his family, sir?"
Gongaware: "I was concerned about him"
Panish: "How about his family and children, sir?"
Gongaware: "I supposed. I was focused on Michael"
Brian Panish asked Gongaware a couple different ways if he was concerned about Jackson's mother & children. Gongaware looked up toward the celiling and then said he'd thought about it and he was concerned about Jackson's mom & children
"I believe he was a good father," Gongaware said about Michael Jackson.
Panish: "Did you know he was a great son to his mother?"
Gongaware: "I believe he was"
Panish asked if Gongaware ever called Katherine Jackson to express his condolences. The executive said no. Gongaware said he also didn't think that he sent Katherine Jackson or Jackson's children a condolence card.
Panish: "After Michael died, did you ever send a card to his mother?"
Gongaware: 'I don't think so"
Panish: "Did you ever call her to express your condolences?"
Gongaware: "No"
Panish asked Gongaware several questions about the executive changing elements of his deposition testimony. "I believe I testified truthfully," Gongaware said. "I don't believe I changed my testimony substantially."
Panish then started pointing out what he said were inconsistencies in Gongaware's testimony
This led to questions about whether Gongaware was mistaken when he wrote in an email that AEG was paying Conrad Murray's salary. Gongaware said he didn't necessarily think he was mistaken. He also said he didn't remember writing the email. As to the email Gongaware wrote that AEG, not Michael paid Dr. Murray. Panish asked again if Gongaware recalled writing this email. He said no. Gongaware said he spent 2 days with his lawyers preparing for his deposition, one-two hours discussing the email about AEG paying Dr. Murray. Panish pointed out several answers Gongaware gave on his deposition and the changes he asked to make to the transcript after meeting with attorneys. Panish said Gongaware changed his testimony several times as a result of meeting with AEG's attorneys. Panish said Gongaware also changed his testimony again while on the stand and under oath. Panish tried to impeach Gongaware, which is a legal way to call into question the witness' credibility.
Later in the case, the judge will instruct the jurors that if they think a person lied, they may disconsider part of all of his testimony. As to the email about AEG paying Dr. Murray, Panish pointed out that Gongaware changed his answers several times throughout his testimony. One time he said the email was shorthanded, normal course of business and didn't really think it was a mistake. Yesterday, Gongaware answered the same question saying he was mistaken when he said AEG was paying Dr. Murray. Gongaware explained he thinks he said the same thing but different ways. Gongaware was also asked about a key email he wrote that has come up several other times during the trial. Talking about Murray, he wrote:
We want to remind him that it is AEG, not Michael who is paying his salary. We want him to understand what is expected of him

Panish: "Do you have any idea why you might have written that AEG is paying his salary?"
Gongaware: "No. I mean, I was mistaken there. We weren't going to pay his salary. We would have advanced the money on Michael's instructions"
Panish then asked Gongaware about Lou Ferrigno and whether he was an employee of AEG Live. Gongaware said no, reiterating his previous testimony that he made a deal with Ferrigno. He said Ferrigno would have been an independent contractor. Panish asked whether Ferrigno had a contract with AEG Live. Gongaware said he didn't know. Panish asked Gongaware if he hired Lou Ferrigno to be Michael's trainer. "I made a deal for Michael," Gongaware said. Ferrigno was an independent contractor, Gongaware said he didn't know whether Ferrigno was submitting bills to his office.
Panish: "So you stiffed Lou Ferrigno, you didn't pay the Incredible Hulk?"(Everyone in the courtroom laughed out loud)
Gongaware: "I don't know how he would get paid, if he would submit bills or not"
Panish said Gongaware testified yesterday that he was not concerned with Michael because he was working out with a trainer. Today Gongaware testified Michael was going to work out with Lou Ferrigno. Gongaware said he didn't know whether Ferrigno had an independent contract agreement or not and if he got paid. Panish inquired about AEG only paying people with fully executed contract. Gongaware said he didn't know the status of Ferrigno's contract. "I don't know specifically when Mr. Jackson saw trainers, but I believe he was seeing trainers," Gongaware explained.
Panish: "He was seeing Lou Ferrigno to be in the next Incredible Hulk?"
Gongaware: "I don't think so"
Panish said Gongaware testified he was not concerned about Michael because he was working out with Lou Ferrigno. He said he didn't say that.
"When he was sick on June 19, I didn't know what was happening," Gongaware explained. "After that, Michael was great."
Panish asked whether he ever received Conrad Murray's contract. Gongaware, when shown an email from June 16, 2009, that included Murray's contract, said he didn't generally read contracts. "Dr Murray wasn't supposed to get paid. If Michael would've signed the deal, Dr Murray would've been paid for his work in London," Gongaware said .
Panish: "You didn't have time to ready budgets, you didn't have time to read contracts, right?"
Gongaware: "I didn't read budgets early on"
Panish asked if Gongaware had any document to prove that Dr. Murray was told that anyone else, but AEG, was paying him. Gongaware didn't recall.
Panish: "Did you have anything in writing saying it was Michael, not AEG, paying Dr. Murray?"
Gongaware: "I don't know"
Gongaware said he believed Dr. Murray signed one version of the contract, but doesn't know whether the one showed to him was it. Gongaware said he knew of no document that said his company's payments to Conrad Murray were actually part of a loan to Michael. Gongaware, on the stand for the sixth day, said he didn't know what Murray assumed about who was paying him.
The jury was shown an email from Timm Wooley, the AEG accountant on Jackson's This Is It concert series sent Murray June 6, 2009:
"I am sorry for the long delay in getting this to you, but I hope that, with your input and comments, we can dispose of the agreement quickly and arrange for payment of the May & June fee installment"
Gongaware testified that although he made the deal with Murray, and that the contract was emailed to him in 2009, his court appearance was the first time he had seen it. Gongaware repeated his contention as he has throughout his testimony, that "He was working for Michael Jackson. He wasn't working for us" The contract shown to the jury said it was between AEG Live and Murray. The contract also said Murray was to "Perform the Services reasonably requested by Producers" (AEG). Trell testified earlier that this was one of several mistakes in a draft that would have been cleaned up in the final version
Panish: "You expected Dr Murray, just like Ferrigno, to get paid for services provided to AEG right sir?"
Gongaware: "He wasn't working for AEG"
Gongaware said he was tasked to make the deal, determine compensation for Dr. Murray.
Panish: "If he was Michael's personal doctor, why hire him?"
Gongaware: "I think he wanted to set up the payment. I was told to negotiate his compensation"
Panish asked Gongaware about his contention that Jackson was always able to perform and nail shows when necessary Gongaware repeated he believed when lights went on, Michael was always there. Panish pointed out Michael canceled several shows on the Dangerous tour. The lawyer cited several shows over Jackson's career that he missed: Bangkok, South America and the need to move a couple in Mexico City.
Panish then asked Gongaware about Dr. Stuart Finkelstein, who the lawyer kept referring to as Gongaware's friend of 25 years. Finkelstein, a possible witness in the trial, was on the last leg of the Dangerous tour before it was canceled. Gongaware said Dr. Finkelstein is now a drug addiction specialist. "There were two occasions where he (Dr. Finkelstein) told me he treated Michael, but never talked about Demerol or injections," Gongaware said. "I believe he's mistaken," Gongaware said if Dr. Finkelstein gave deposition to the contrary.
Panish: "Did Dr. Finkelstein tell you he put MJ on a 24 hour morphine drip?"
Gongaware: "No"
Gongaware denied that Finkelstein told him that he thought Jackson was suffering from a prescription drug addiction. He also denied that Finkelstein told him that another doctor on the Dangerous tour was giving Jackson Demerol shots. Dr. Forecast, from London, was Michael's doctor treating the artist during Dangerous tour
Gongaware said he was never alarmed about Jackson's health and said he saw him as being well
Panish: "Is safety paramount to AEG live?"
Gongaware: "Safety should always be expected"
Gongaware said he didn't know if there was a person in charge of safety at rehearsals

Panish: "In your opinion, this is a baseless, shakedown lawsuit?"
Gongaware: "I don't understand the merit in it"
Panish: "You answered interrogatories in this case blaming everything on Mrs. Jackson?"
Gongaware: "I don't recall"
Panish: "Did you sign anything in this case saying that Mrs. Jackson was trying to extort money from AEG?"
Gongaware: "I don't recall"
Regarding whether Jackson's children suffered a loss after their father's death, Gongaware said:
"I believe they suffered a great loss"
Gongaware agreed that the best recollection of what happened in 2009 is the emails, but said he remembers from his head too.
"He was always amazing," Gongaware said about Michael.
Gongaware: "I thought he was great"
Panish: "Despite Bugzee saying he was deteriorating in front of his eyes?"
Gongaware: "My eyes told me differently"
Gongaware said the demand for tickets to Michael's memorial service was huge, comparable to the demand for the This Is It tour. Gongaware said the amount of people still in line to buy tickets for This Is It could've sold out 100 shows. (ABC7)

Panish: "Do you remember what you said Elvis died of?"
Gongaware: "Heart ailment"
But Panish recalled Gongaware giving a different answer earlier on, saying he believed it was prescription drugs
Gongaware was asked about extending the This Is It tour. He was shown emails from promoters wanting Michael concerts in India, Australia. Gongaware said he would have liked the "This Is It" tour to continue, but they only had agreement for 50 shows. On 3/18/09 -- asking about MJ going to India for the show, Phillips responded:
"Thanks, Thomas. Michael will definitely be heading your way"
Gongaware said he thinks they were making plans in case Michael said ok, let's go. Email on 3/17/09 from Phillips:
"We have a 4 year plan that includes Australia, however, we have to finish London first.
Gongaware, who didn't like Australian's promoter, responded:
"Over my dead body. But let's see what he says before I p**s on his parade."

Panish: "Did you ever see Michael under the influence of prescription medication in June 2009?"
Gongaware: "When he came back from Dr. Klein's office"
Panish: "Did you investigate?"
Gongaware: "No, he was coming from his doctor, I didn't think there was a need"

Panish: "Your goal was to have as many shows as possible?"
Gongaware: "I would've liked that"
Panish: "The more shows you had, the more money AEG would've gotten, right?"
Gongaware: "Yes"
Panish asked Gongaware if he had talked to Phillips since he'd been on the witness stand. He said he hadn't discussed the case. Panish then asked if Phillips was aware Gongaware said he was content with AEG Live being #2 concert promoter behind Live Nation. Gongaware said he's expressed his opinion that AEG Live doesn't need to be the #1 promoter
AEG recross
Marvin Putnam, in re-direct, asked Gongaware if he tried to give his best testimony possible in deposition. Gongaware said "Yes"
He asked Gongaware why he never sent a condolence card to Jackson's family. "I'm not good with cards", he said. He said the memorial service was how he wanted to honor the singer. Gongaware said he spent a lot of time thinking about Jackson after his death "What I did, I tried to put the memorial show together," Gongaware said. "I think it was the best thing for me to do, commemorate his life."
Memorial was at the Staples Center with 15,000 people, live fed to Nokia Theater with 5,000 people. Gongaware said he worked directly with Randy Jackson on the memorial. It cost over a million dollars, AEG and Michael's estate bore the cost. "I'm glad I did what I did," Gongaware said, adding memorial was shown to millions of people interested in Michael around the world
Putnam tried to rebut all the claims that Gongaware changed his testimony. Gongaware said he feels he hasn't changed his answers
Putnam also showed jury Gongaware's police statement. Panish had said his comment to police was different from testimony. Panish keyed in on whether Gongaware testified that it was five weeks or two weeks between his first two conversations with Conrad Murray. The police statement said Gongaware told detectives a few weeks separated the calls regarding Murray and the contract
Another document that defense attorney Marvin Putnam showed Gongaware was Lou Ferrigno's contract. Ferrigno's three-page contract designated him as an independent contractor. It was signed by AEG accounting exec Julie Hollander. Putnam showed an independent contract agreement with Ferrigno fully executed. Julie Hollander signed on behalf of AEG effective April 27, 2009
Putnam finished his examination of Gongaware by showing him Conrad Murray's contract. Putnam questioned Gongaware about Dr. Murray's contract. The exec said Michael had to sign it in order for it to be valid. Putnam showed Gongaware language in the agreement that said Michael Jackson had to sign the agreement for it to be a valid contract. Putnam also keyed in on language that said Murray was being engaged "on behalf and at the expense of Michael Jackson"
Jackson redirect
Then it was Panish's turn again. He said there isn't a date on the contract showing when Julie Hollander signed Ferrigno's agreement. Panish questioned Gongaware about whether Ferrigno's contract may have been signed after Jackson's death. Gongaware said he didn't think he sent any contracts to Julie Hollander after Jackson's death. Panish pointed out that Hollander was signing contracts after Michaelhad died. He asked to see the original contract.
Panish: "Lou Ferrigno was retained by AEG, right?"
Gongaware: "Yes"
Panish asked Gongaware whether he thought it would have been better for him if he had reviewed documents and e-mails before testifying. "I relied on the advice of my attorney," he said. "All this legal stuff, I don't understand it," he said. Gongaware said he expected his lawyers would act on his best interest and that he testified truthfully and factually in his deposition. Panish asked if Gongaware expected to be believed now when he wouldn't recall his answers in deposition. Defendant objected, judge sustained
Panish also repeatedly referred to the number of AEG Live defense lawyers in the courtroom. He was later admonished to stop mentioning them. Putnam had noted that Katherine Jackson's side was being represented by four law firms. Panish said he didn't care if Putnam brought it up
With that Paul Gongaware was excused, subject to recall if needed.
Randy Phillips Testimony
Phillips said he met with six attorneys to prep for testimony between 6-8 times over the last two weeks, probably for about 30 hours. Phillips said he went through a bunch of emails, probably 30, from the period in question. He also read his deposition.
Randy Phillips, the chief executive officer of AEG Live, disclosed that his lawyers advised company executives not to review old e-mails before testifying. "They felt it would be better if I went in without preparation," he said, referring to his lawyers. (AEG Live lawyer Marvin Putman said outside of court that the volume of documents they would have needed to review was massive, making it impossible for them to prepare. )
Panish asked Phillips whether he was eager to tell his side of the story. "I believe you called me as a witness, so I'm here," Phillips said flatly
Phillips attended two years of law school, but didn't graduate.

Panish: "Who's higher up than you at AEG Live?"
Phillips: "No one at AEG Live"
Panish: "You are the top dog, so to speak?"
Phillips: "Yes"
Phillips reports to an executive committee who would then report to Tim Leiweke. Phillips said he doesn't know why Leiweke left the company. Phil Anschutz now belongs to the executive committee.
Panish at one point asked the executive whether he was familiar with the music industry. "Familiar with the music industry? I was working in it," Phillips replied.
Phillips said he agreed with statements attributed to him and defense attorney Marvin S. Putnam that the case was a shakedown.
Panish: "Do you think this is an extortion, shakedown lawsuit?"
Phillips: "Yes or no answer? Yes"
Panish: "Did you sign a document under the penalty of perjury saying Mrs. Jackson aided and abetted Joe Jackson to extort money from AEG?"
Phillips: "It's possible, I don't remember. I wish you wouldn't keep calling it a baseless shakedown lawsuit"
Panish: "You believe this case is an extortion, correct?"
Phillips: "Yes"

Panish: "You told Mr. Ortega that AEG checked everyone out, including Dr. Murray?"
Phillips: "I wrote in an email to Kenny Ortega that I thought Dr. Murray had been checked out. I still do, to some extent"
Panish: "You said he was a great doctor?"
Phillips: "Because that's what I was told"
Panish: "Did you write an email that AEG checked everyone out?"
Phillips: "Yes, I did"
Panish: "That was not true"
Phillips: "In retrospect, not 100%.It's what I knew at the time"

Panish: "Isn't it true you said AEG live doesn't lose money, sir?"
Phillips: "Among other things I said"
Panish showed Phillips a Forbes article where he said AEG is about making money, since they are a business.
Phillips: "Live Nation is the largest concert promoter in the world"
Panish: "Do you like being number 2?"
Phillips: "Love it! I'd rather be a successful number 2"
Panish: "You don't want to be number one?"
Phillips: "Not if it means losing money"
Phillips said Mr. Anschutz told him he's happy being a number 2
Panish asked if it was true Phillips wanted to meet with Michael to tour in 2007. Phillips answered it was the opposite, they asked for a meeting.
Jackson lawyer Brian Panish, who has been previously told by the judge not to argue with witnesses, quickly tangled with Phillips. "Please don't argue with me because then I will argue back and get in trouble," Panish told Phillips at one point. "Then that's an incentive for me," Phillips joked (everyone laughed)

Panish: "Did you learn Colony Capital purchase note on Neverland?"
Phillips: "Yes"
Panish: "Is Barrack one of principals on Colony Capital?"
Phillips: "Yes"
On 6/13/08, Phillips sent an email to Colony Capital with a summation of plans for Michael for four years:
I caution you that Michael is not fast and a total perfectionist (needs to be controlled as much as possible)
Phillips said he was referring to Michael's spending

Panish: "Neverland was his beloved home, right sir?"
Phillips: "Hard to answer, because of the things Michael told me"
When the executive appeared to crack a smile, Panish asked if he thought the proceedings were funny.
Phillips:"No, I think it's tragic"
Panish: "Do you think any of this is funny, sir?"
Phillips: "No, I think it's tragic"
Tohme Tohme was a business associate with Colony Capital, who was also working with Michael. Panish asked if Phillips thought there was a conflict of interest with Tohme working for Colony and Michael. He said "No"
